Monopolies and Restrictive Trade Practices ( Third Amendment ) Rules , 1972
G.SR. 321 ( E ) , In- exercise of the powers conferred by Section 67, of the Mono- polies and Restrictive Trade Practices Act , 1969 ( 54 of 1969 ) , the Central Govern- ment hereby makes the following rules further to amend the .. Monopolies and Restrictive Trade Practices Rules , 1970 , namely: ----
1. ( 1) These rules may be called the Monopolies and Restrictive Trade Prac- tices ( Third Amendment ) Rules, 1972.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 4A of the Monopolies and Restrictive Trade Practices Rules , 1970 (hereinafter referred to as the saidaid rules ) , after sub - rule ( 4 ) , the following sub- ule shall be inserted , namely: --
" ( 5 ) Notwithstanding anything contained in this rule , if the Central Gov- ernment is of opinion that it is necessary or expedient so to do in the interests of the defence of India , security of the State or in the public interest , it may , by a general or special order , dispense with the publication of the general notice referred to in sub - rule ( 1 ) in respect of any undertaking or class of undertakings or in respect of any goods or services . "

3.In rule 5 of the said rules , after sub - rule ( 4 ) , the following sub - rule shall be inserted , namely: -
"( 5 ) Notwithstanding anything contained im sub - rule ( 1 ) , if the Central Government is of opinion that it is necessary or expedient so to do in the interests of the defence of India , security of the State or in the public interest , it may , by a general or special order , specify any other form of notice to be given under sub - section ( 1 ) of section 21 of the Act in respect of any undertaking or class of undertakings or in respect of any goods or services . "
4. In rule 6 of the said rules , after sub - rule ( 2 ) , the following sub - rule shall be inserted , namely : -
" (3 ) Notwithstanding anything contained in sub - rule ( 1 ) , if the Central Government is of opinion that it is necessary or expedient so to do in the interests of the defence of India , security of the State or in the public interest , it may , by a general or special order , specify any other form of application to be made under sub - section ( 2 ) of section 22 of the Act in respect of any undertaking or class of undertakings or in respect of any goods or services ."

एकाधिकार तथा अवरोधक व्यापारिक व्यवहार ( तृतीय सशोधन ) नियम , 1972
सा० फा०नि० 321 ( २) एकाधिकार तथा अवरोधक व्यापारिक व्यवहार अधिनियम , 1969 ( 1969 का 54 ) की धारा 67 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , एकाधिकार तथा भ्रवरोधक व्यापारक व्यवहार नियम , 1970 में और आगे संशोधन करने के लिए निम्मलिखित नियम एतद्वारा बनाती है, अर्थात्:
1. ( 1) इन नियमों का नाम एकाधिकार तथा अवरोधक व्यापारिक व्यवहार (तृतीय संशोधन) नियम , 1972 होगा ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. एकाधिकार तथा अवरोधक व्यापारिक व्यवहार नियम , 1970 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 4क में, उपनियम ( 4 ) के पश्चात् निम्नलिखित उपनियम अन्तः स्थापित किया जाएगा , अर्थात् :--
" ( 5 ) इस नियम में किसी बात के होते हुए भी, यवि केन्द्रीय सरकार की राय हो कि भारत की रक्षा, राज्य की सुरक्षा के हितों में या लोक हित में ऐसा करना आवश्यक या समीचीन है , वह किसी साधारण या विशेष आदेश द्वारा , किसी उपक्रम या उपक्रमों के वर्ग के बारे में या किमी माल या सेवाश्रों के बारे में उपनियम ( 1 ) में निर्दिष्ट साधारण सूचना के प्रकाशन गे अभिमक्त कर सकेंगी ) । ' THE GAZETTE OF INDIA EXTRAORDINARY

3. उक्न नियम के नियम 5 में, उपनियम ( 4) के पश्वात् निम्नलिखित उपनियम अन्तः स्थापित किया जाएगा , अर्थात्:-
" ( 5) उपनियम ( 1) में किमी चान के होने हुए भी, यदि केन्द्रीय सरकार की राय हो कि भारत की रक्षा, राज्य की सुरक्षा के दिनों में या लोक हित में ऐसा करना आवश्यक या समीचीन है , वह , किसी माधारण या विशेष प्रादेश द्वारा , किसी उपक्रम या उपक्रमों के वर्ग के बारे में या किसी माल या मेवाओं के के गारे में अधिनियम की धारा 21 की उपधारा ( 1 ) के अधीन दी जाने वाली सूचना का कोई अन्य प्रारूप विनिर्दिष्ट कर सकेगी । "
4. उक्त नियम 6 में, उपनियम ( 2 ) के पश्चात् निम्नलिखित उपनियम अन्तःस्थापित किया जाएगा अर्थात्
" (3 ) उपनियम ( 1 ) में किसी बात क होत हुए , भी, यदि केन्द्रीय सरकार की राय हो कि भारत की रक्षा , राज्य की सुरक्षा के हितों में या लौक हित में ऐसा करना प्रावश्यक या समीचीन है, वह किसी साधारण या विशेष आदेश द्वारा , किसी उपक्रम या उपक्रमों के वर्ग के बारे में या किसी माल या सेवाओं के बारे में, अधिनियम की धारा 22 की उपधारा ( 2 ) के अधीन किए जाने वाल आधदन के किसी अन्य प्रारूप को विनिर्दिष्ट कर सकेगी । "
