New Delhi , the 1st July 1972
S.O. 451 ( E ) .-Whereas the Supreme Court has , in its judgment delivered on the 24th November , 1971 , on the Writ Petitions filed by the manufacturers of Motor Cars in regard to the selling prices of the cars manufactured by them , directed the Central Government to review the prices of the three makes of cars manu- factured in the country every six months after taking into consideration the claims submitted by the manufacturers of the said cars for increase in the prices of the cars manufactured by them;
And whereas the Central Government has considered the claims submitted by the manufacturers of the said cars for increase in the prices of the said cars ;
Now, therefore , in exercise of the powers conferred by section 18G of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby makes the following Order further to amend the Motor Cars (Distribution and Sale ) Control Order , 1959 , namely:-
1. ( 1 ) This Order may be called the Motor Cars ( Distribution and Sale ) Control (Second Amendment ) Order , 1972 .
(2 ) It shall come into force on the 1st of July , 1972 .

2. For Schedule I to the Motor Cars (Distribution and Sale ) Control Order , 1959 , the following Schedule shall be substituted , namely:-

फा० प्रा० 451 ( प्र ) यतः उच्चतम न्यायालय ने, मोटर कार के विनिर्माताओं द्वारा उनके द्वारा विनिर्मित कारों की विक्रय कीमत के सम्बन्ध में दी गई रिट याचिका पर, अपने 24 नवम्बर , 1971 को दिए गए निर्णय में केन्द्रीय सरकार को , देश में विनिर्मित तीन प्रकार की कारों की कीमत , कारों के विनिर्माताओं द्वारा , उनके द्वारा विनिर्मित कारों की कीमत में वृद्धि के लिए प्रस्तुत किए गए दावों पर विचार करने के पश्चात् , प्रत्येक छः मास के बाद पुर्विलोकन करने का निदेश दिया था ;
और यतः केन्द्रीय सरकार ने उक्त कारों के विनिर्माताओं द्वारा उक्त कारों की कीमत में वृद्धि के लिए प्रस्तुत दावे पर विचार कर लिया है ।
अतः , अब, उद्योग ( विकास और विनियमन ) अधिनियम 1951 ( 1951 का 65 ) की धारा 18 छ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार मोटर कार ( वितरण और विक्रय ) नियंत्रण आदेश , 1959 में और संशोधन करने के लिए एतद्वारा निम्नलिखित आदेश करती है , अर्थात्ः-
1. ( 1 ) यह आदेश मोटर कार ( वितरण और विक्रय ) नियंत्रण ( द्वितीय संशोधन ) श्रादेश, 1972 कहा जा सकेगा ।
(2) यह 1 जुलाई, 1972 को प्रवृत्त होगा ।

2. मोटर कार ( वितरण और विक्रय ) नियंत्रण आदेश , 1959 की प्रथम अनुसूची के स्थान पर निम्नलिखित अनुसूची-1 प्रतिस्थापित की जाएगी , अर्थात्:---

स्पष्टीकरणः-- उपयुक्त विनिर्दिष्ट कीमत कारखाने द्वार पर कीमते हैं , जिनमें व्यवहारी का कमीशन सम्मिलित है और उत्पाद शुल्क, केन्द्रीय विक्रय कर और स्थानीय कर , यदि कोई हो, और परिवहन प्रभार सम्मिलित नहीं है । ये कीमतें 31 दिसम्बर , 1972 तक प्रवृत्त रहेंगी ।
