S.O. 474 ( E ) . In exercise of the powers conferred by sub -section ( 1 ) of section 15 of the Forward Contracts (Regulation ) Act , 1952 ( 74 of 1952 ) , the Central Government hereby makes the following further amendment in the notification of the Government of India in the late Ministry of Commerce and Industry , No. S.R.O. 241 dated the 25th January , 1955 , namely :-
In the said notification , the entry " ( iii ) mowraseed" shall be omitted.

का० प्रा० 474 ( प्र) . अग्रिम संविदा ( विनियमन ) अधिनियम , 1952 ( 1952 का 74 ) की धारा 15 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा भारत सरकार के भूतपूर्व वाणिज्य भौर उद्योग मंत्रालय की अधिसूचमा THE GAZETTE OF INDIA EXTRAORDINARY

सं ० का ० नि ० श्र ० 241 तारीख 25 जनवरी , 1955 में और आगे. निम्नलिखित संक्रोधन करती है , अर्थात् : -
उक्त अधिसूपना में " ( iii ) मनुष्या बीज " प्रविष्टि लुप्त की जाएगी ।

S.O. 475 (E ) exercise of the powers confarneck bar section 17, read with section. 16 of the Forward Contracts (Regulation ) Act, 1962 (741952 ) the Central Government hereby declares that no person shall , save with the permission of the Central Government, enter into any forward contract for the sale or purchase of ( i ) mowraseed (mahuaseed ) , ii) mowraseed oil ( mahuaseed oil ) and ( iii ) gram husk (gram chilka ) in any place in India. and fixes , under clause ( a ) of the said section 16 , the rate prevailing at the time at which the forward market in the said commodities closed on the date of this notification , or , if there was no trading on that date , on the last preceding date of trading , as the rate at which any such forward contract entered into on or before the date of thisof this notification and remaining to be perormed after the said date shall be deemed to be closed

का० श्रा ० 475 ( थ) अग्रिम संविदा ( विनियमन ) अधिनियम 1952 ( 1952 का 74 ) की धारा 16 के साथ पठित धारा 17 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा घोषित करती है कि कोई भी व्यक्ति सिवाय केन्द्रीय सरकार की अनुज्ञा के, ( i ) महुआ बीज, ( ii ) महुआ बीज का तेल और ( iii ) चने के छिलके के विक्रय और खरीद के लिए भारत के किसी भी भाग में अग्रिम संविदा नहीं करगा और उक्त धारा 16 के उपखण्ड ( क ) के अधीन नियत करती है , इस अधिसूचना की तारीख को उक्त वस्तु के अग्रिम बाजार के बन्द होने के समय प्रचलित दर , या उस तारीख को कोई व्यापार नहीं हुआ था तो व्यापार की पिछली पूर्ववर्ती तारीख को, ऐसी दर जिस पर इस अधिसूचना की तारीख को या पूर्व ऐसा कोई अग्रिम संबिदा किया गया हो मौर उक्त सारीख के पश्चात पूरा किया जाना हो, बंद हुआ समझा कएगा ।

S.O. 476 (E ) .-Whereas forward contracts for the sale or purchase of ( i ) mowraseed (mahuaseed ) , ( ii ) mowraseed oil (mahuaseed oil ) and ( iii ) gram husk ( gram chilka) in any place in India have been prohibited by the notification of the Government of India, in the Ministry of Industrial Development , No. 10 ( 2 )-IT / 72 - II , dated the 5th July , 1972 ;
And whereas the Central Government is of the opinion that in the interest of the trade and in the public interest, it is expedient to regulate and control non- transferable specific delivery contracts in respect of the said commodities;
Now , therefore , in exercise of the powers conferred by sub- section (3 ) of section 18 of the Forward Contracts (Regulation ) Act 1952 (74 of 1952 ) , the Central Government hereby declares that the provisions of sub- sections ( 1 ) and ( 2) of section 17 of the sald Act, shall apply to non- transferable specific delivery contracts in respect of the said commodities in the whole of India .

का० प्रा० 476 (अ ) यतः भारत सरकार के श्रौद्योगिक विकास मंत्रालय की अधिसूचना सं० 10 ( 2 ) -आई० टी० / 72- II , तारीख 5 जुलाई , 1972 द्वारा भारत के किसी भी भाग में ( i ) महुना बीज ( ii ) महुआ बीज का तेल और ( iii ) चने के छिलके के विक्रय और खरीद का अग्रिम संविदा प्रतिविद्ध कर दिया गया है;
और यतः केन्द्रीय सरकार की राय है कि व्यापार के हित में और लोक हित में उक्त वस्तुओं के संबंध में अनन्तरणीय विनिदिष्ट परिदान संविदाओं का विनियमन और नियंत्रण समीचीन है ;

श्रत , अब, अग्रिम संविदा ( विनियमन ) अधिनियम , 1952 ( 1952 का 74 ) की धारा 18 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा घोषित करती है कि उक्त अधिनियम की धारा 17 की उपधाराएं ( 1 ) और ( 2 ) के उपबंध उक्त वस्तुओं के संबंध में श्रनन्तरणीय विनिर्दिष्ट परिदान संविदाओं पर पूर्ण भारत में लागू होंगे ।

In exercise of the powers conferred by sub - section ( 1 ) of section 17 of the Forward Contracts (Regulation ) Act , 1952 ( 74 of 1952 ) , as applied to non - transferable specific delivery contracts in respect of ( i ) mowraseed ( mahuaseed ) , ( ii ) mowraseed oil (Mahuasced oil ) and ( iii ) gram husk ( gram chilka ) by the notification of the Government of India in the Ministry of Industrial Development , (Department of internal Trade ) No. 10 ( 2 )-Ι.Τ. / 72 - III , dated the 5th July, 1972 , the Central Government hereby declares that no person shall , save with the permission of the Central Government , enter into any non - transferable specific delivery contract for the sale or purchase of the said commodities in the whole of India except the following classes of such contracts:
(i ) Any non - transferable specific delivery contract for the sale or purchase of the said commodities which is performed wholly by actual tendering of goods and the payment of the full price therefor ; and ( ii ) any non - transferable specific delivery contract for the sale or purchase of the said commodities under which actual tendering of goods becomes impossible or unlawful owing to circumstances over which the contracting parties have no control .

का० प्रा ० 477 ( प्र ) . अग्रिम संविदा ( विनियमन ) अधिनियम 1972 ( 1972 का 74) की धारा 17 की उपधारा ( 1 ) , जैसा कि ( i ) महुआ बीज , ( ii ) महुआ बीज का तेल , और ( iii ) चने के छिलके के संबंध में अनन्तरणीय विनिर्दिष्ट परिदान संविदाओं पर , भारत सरकार के श्रौद्योगिक विकास मंन्त्रालय ( आंतरिक व्यापार विभाग ) की अधिसूचना सं ० 10 ( 2 ) -आई ० टी०/ 72- III तारीख 5 जुचाई, 1972 , द्वारा लागू होती है , द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार एतद्वारा घोषित करती है कि कोई भी व्यक्ति भारत सरकार की अनुज्ञा के बिना उक्त वस्तुओं के विक्रय और खरीद के लिए पूर्ण भारत में, मिवाय ऐमे संविदाओं के निम्नलिखित वर्ग के , अनन्तरणीय विनिर्दिष्ट परिदान संविदा नहीं करेगा :--
( i ) उक्त वस्तुओं के विक्रय और खरीद के लिए कोई भी अनंतरणीय विनिर्दिष्ट परिदान संबिदा , जो पूर्णरूप से वास्तव में माल देकर और उसकी पूरी कीमत देकर किया जाता हो , तथा
( ii ) उक्त वस्तुओं के विक्रय और खरीद के लिये कोई अनंतरणीय विनिर्दिष्ट संविदा , जिसके अधीन वास्तव में माल देना असंभव हो जाता हो या ऐसी परिस्थिति के , जिन पर संविदा के पक्षकारों का बस नहीं था , कारण अवैध हो जाता है ।
