New Delhi , the 11th July , 1972 .
S.O. 484 ( E ) .--In exercise of the powers conferred by section 7 of the Finance Com- mission ( Miscellaneous Provisions ) Act , 1951 ( 33 of 1951 ) , the Central Government hereby makes the following rules further to amend the Finance Commission ( Salaries and Allowances ) Rules 1951 , namely : -
1. These rules may be called the Finance Commission ( Salaries and Allowances ) Amendment Rules , 1972 .
2. In the Finance Commission ( Salaries and Allowances ) Rules , 1951- ( i ) after sub - rule ( 1 ) of rule 2, the following proviso shall be inserted , namely :-
"Provided that where any person so appointed is given the rank of a Cabinet Minister he shall in lieu of the salary allowances and other facilities provided for in this sub - rule , be entitled to such salary , allowances and

other facilities as are admissible to a Minister ( not being Deputy Minis- ter ) under the Salaries and Allowances of Ministers Act , 1952 (58 of 1952 ) and the rules made thereunder ; "
(ii) in sub - rule ( 2 ) of rule 2 for the words " tour allowance " the words " daily allowanco " shall be substituted and after that sub - rule , the following provise shall be inserted, namely :-
"Provided that where the person so appointed is a member of Parliament he shall, in lieu of the allowances provided for in this sub -rule , draw a daily allowance for each day spent by him on duty as Chairman of the Com- mission at the same rate as is admissible to him under section 3 of the Salaries and Allowances of Members of Parliament Act, 1954 ( 30 of 1954 ) and he shall further be entitled to draw travelling allowance for any journey performed by him as such Chairman at the same rate as is admissible to him under section 4 of the said Act and the rules made thereunder: ";
( iii ) in rule 3 ,-
(a) in sub - rule ( 2 ) , ...
(A) in clause ( b ) , the word " and " occurring at the end shall be omitted and after that clause the following clause shall be inserted , namely : -
" ( bb ) to draw compensatory allowance at the rate of Rs . 75 / - per mensen ; and";
(B) for clause ( c ) , the following clause shall be substituted , namely : ---
" ( c) to draw no amount by way of house rent allowance" ;
(b) in sub - rule ( 3 )
(A) in clause ( b ) , the word " and " occurring at the end shall be omitted and after that clause the following clause shall be inserted , namely :-
"( bb ) to draw compensatory allowance at the rate of Rs . 75 / - per mensem ; and";
(B) for clause ( c) , the following clause shall be substituted , namely :-
"( c) to draw no amount by way of house rent allowance ." ;
(c) in sub - rule 4 ,-
(A) in clause ( b ) , the word " and " occurring at the end shall be omitted and after that clause the following clause shall be inserted , namely :--
"(bb ) to draw compensatory allowance at the rate of Rs . 75 / - per mensem; and" ;
(B ) for clause ( c ) , the following clause shall be substituted, namely :-
" ( c) to draw no amount by way of house rent allowance ." ;
(d) in sub - rule ( 5 ) in clause ( a ) for the words " tour allowance " the words " daily allowance " shall be substituted and after that sub - rule , the following proviso shall be inserted , namely :-
" Provided that where the person so appointed is a member of Parliament he shall , in lieu of the allowances provided for in this sub- rule , draw a daily allowance for each day spent by him on duty as a Member of the Corn- mission at the same rate as is admissible to him under section 3 of the Salaries and Allowances of Members of Parliament Act, 1954 ( 30 of 1954 ) and he shall further be entitled to draw travelling allowance for any journey performed by him as such member at the same rate as is admissible to him under Section 4 of the said Act and the rules made thereunder .";

( iv ) after rule 3 , the following rule shall be inserted , namely : -
" Leave salary admissible 10
Chairman and other members in certain circumstances ,
4. Where a person , not being a Government servant or a servant of th Reserve Bank , is appointed to render whole- time service as the Chairman or any other Member of the Commission and such person after such appointment is temporarily incapacitated , by illness or otherwise . from rendering such service , then , he shall be entitled to leave salary at the same rate as when rendering whole- time service , for an aggregate period not exceeding one - eleventh of the period of whole - time service actually rendered by him as such Chairman or other Member , as the case may be . " .

का० ग्रा० 484 ( प्र ) वित्त आयोग (प्रकीर्ण उपबंध ) अधिनियम, 1951 ( 1951 का 33 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , एतद्वारा वित्त आयोग ( वेतन और भत्ते ) नियमावली , 1951 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. इन नियमों को वित्त आयोग ( वेतन और भत्ते) संशोधन नियमावली, 1972 कहा जा सकेगा ।
2 वित्त आयोग ( बेसन और भत्ते ) नियमावली, 1951 में ( i ) नियम 2 के उपनियम ( 1 ) के बाद निम्नलिखित परन्तुक ओड़ा जाएगा , अर्थात्: --
"परन्तु यदि इस प्रकार नियुक्त किसी व्यक्ति को मंत्री मंडलीय का दर्जा दिया जाएगा कोयह इस उपनियम में उपबंधित वेतन, भत्तों और अन्य सूविधाओं के बदले , ऐसे बेतन, भत्तों और अन्य सुविधाओं को पाने का हकदार होगा जो मंत्रियों के वतन और भत्तों से संबंधित अधिनियम , 1952 ( 1952 का 58 ) और उसके *त " बनाए गए नियमों के अंतर्गत एक मंत्री ( जो उपममंत्री न हो) को अनुज्ञेय हो
( ii ) नियम 2 के उपनियम ( 2 ) में " यात्रा भत्ता " शब्दों के स्थान पर " दैनिक भत्ता " शब्द रखें जाएंगे और उस उप - नियम के बाद निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात् :--
कर्तव्य "परन्तु यदि इस प्रकार नियुक्त व्यक्ति संसद सदस्य होगा तो वह डा नियम में उपबंधित भत्तों के बदले, आयोग के अध्यक्ष के रूप में पर बिताए गए प्रत्येक दिन के लिए उसी दर से दैनिक भत्ता लेगा जो कि उमे संसद सदस्यों के वेतन और भत्तों से संबंधित अधिनियम 1954 ( 1954 का 30 ) की धारा 3 के अंतर्गत अनुज्ञेय होगी और इसके अलावा अध्यन के रूप में THE GAZETTE OF INDIA EXTRAORDINARY

उसके द्वारा जो भी यात्रा की जाएगी उसके लिए वह उस दर से यात्रा भता लेने का हकदार होगा जो दर उक्त अधिनियम की धारा 4 और उस अधिनियम के अंतर्गत बनाए गए नियमों के अंतर्गत अनुज्ञेय होगी । "
( ii ) नियम 3 के, --
( क ) उपनियम ( 2 ) के,
(अ) खंड ( ख ) में, अंत में आने वाला शब्द 'और' हटा दिया जाएगा और उस खंड के बाद निम्नलिखित खंड जोड़ दिया जाएगा , अर्थात्:-
(ख ख ) 75 रु ० प्रतिमास की दर से प्रतिकारात्मक भत्ता लेना; और"
( आ) खंड ( ग ) के स्थान पर निम्नलिखित खंड रख दिया जाएगा , अर्थात्ः-- " ( ग) मकान किराए भत्ते के रूप में कोई रकम न लेना" ,
(ख) उप-नियम 3 में
( अ ) खंड ( ख ) के अन्त में आने वाले शब्द " और " को हटा दिया जाएगा और उम खंड के बाद निम्नलिखित खंड जोड़ा जाएगा, अर्थात् :---
(खख ) 75/ - रु ० प्रतिमास की दर से प्रतिकरात्मक भत्ता लेना ; और
( आ ) खंड ( ग) के स्थान पर निम्नलिखित खंड जोड़ा जाएगा, अर्थात्:-- " ( ग) मकान किराया भत्ते के रूप में कोई रकम न लेना" ;
(ग) उप -नियम, 4 में-
(अ ) खंड ( ख ) के अन्त में आने वाले शब्द " और " को हटा दिया जायगा और उम खंड के बाद निम्नलिखित खंड जोड़ा जाएगा , श्रर्थात् :--
" (खख ) 75/- रु० प्रतिमास की दर से प्रतिकारात्मक भत्ता लेना; और;
(भा) खंड ( ग ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा , अर्थात्ः-- (ग ) मकान किराये भत्ते के रूप में कोई रकम न लेना । "
(घ) उप-नियम ( 5) , खंड ( क) में, "दौरा भत्ता " शब्दों के स्थान पर "दैनिक भता " शब्द रखे जायेंगे और उस उप - नियम के बाद निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थात् : --
" परन्तु यदि इस प्रकार नियुक्त किया गया व्यक्ति संसद सदस्य होगा तो वह इस उप - नियम में उपबन्धित भत्तो के बदले आयोग के सदस्य के रूप में उसके द्वारा कर्तव्य पर बिताए गए प्रत्येक दिन के लिए उसी दर से दैनिक भत्ता लेगा , जोकि उसे संमद सदस्यों के वेतन और भत्तों से संबंधित उप- नियम , 1954 ( 1954 का 30 ) की धारा 3 के अन्तर्गत अनुज्ञेय होगी अं.र इसके अलावा आयोग के सदस्य के रूप में उसके द्वारा जो भी यात्रा की जायेगी उसके लिए वह उस दर से यात्रा भत्ता लेने का हकदार होगा , जो दर उक्त अधिनियम की धारा 4 और उसके अन्तर्गत बनाए गए नियमों के अन्तर्गत अनुज्ञेय होगी । " 1359 THE GAZETTE OF INDIA EXTRAORDINARY Séc . 3 ( ü ) ]
( iv) नियम 3 के बाद निम्नलिखित नियम जोड़ा जाएगा , अर्थात्:--
"अध्यक्ष और अन्य सदस्यों को कतिपय परिस्थितियों में अनु-
ज्ञेय छुट्टी- वेतन
4. यदि किसी ऐसे व्यक्ति को , जो सरकारी कर्मचारी अथवा रिजर्व बैंक का कर्मचारी न हो, पूर्ण कालिक सेवा के लिए आयोग का अध्यक्ष अथवा कोई श्रन्य सदस्य नियुक्त किया जाए और इम नियुक्ति के बाद वह व्यक्ति बीमारी के कारण अथवा अन्यथा इस प्रकार की सेवा करने के लिए अस्थायी रूप से असमर्थ हो जाये , तो वह उसके द्वारा यथास्थिति अध्यक्ष अथवा सदस्य के रूप में वस्तुतः की गयी पूर्णकालिक सेवा की कुल अषधि के कुल मिलाकर अधिक से अधिक ग्यारहवें भाग के बराबर की अवधि तक के लिए उसी दर पर छूट्टी- वेतन पाने का हकदार होगा ।
