New Delhi , the 15th July 1972
S.O. 487 ( E ) . Whereas the Central Government is of opinion that an industrial dispute exists between the employers in relation to the management of Hindustan Copper Limited , Khetri Copper Project , Post Office Khetri Nagar , District Jhun- jhunu ( Rajasthan ) and their workmen in respect of the matter specified in the Schedule hereto annexed;
And , whereas the Central Government considers it desirable to refer the said dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by section 7A , and clause (d) of sub - section ( 1 ) of section 10 , of the Industrial Disputes Act , 1947 ( 14 of 1947 ) , the Central Government hereby constitutes an Industrial Tribunal of which Shri Mohd . Yaqoob Khan shall be the Presiding Officer , with headquarters at Jaipur and refers the said dispute for adjudication to the said Tribunal .
SCHEDULE
" Whether the action of the management of Hindustan Copper Limited , Khetri Copper Project , Post Office Khetri Nagar , District Jhunjhunu (Rajasthan) in terminating the services of Shri Y. K. Gaur , Mining Mate , with effect from 23rd December , 1971 is justified ? If not , to what relief is he entitled ? "

का० प्रा० 487 ( श्र) .यत: केन्द्रीय सरकार की राय है कि इसमें उपाबद्ध अनुसूची में विनिर्दिष्ट विषय के बारे में हिन्दुस्तान कापर लिमिटेड, खेतरी कोपर प्रोजेक्ट, डाकघर खेतरोनगर, जिला झुनझुनू ( राजस्थान ) के प्रबंध से सम्बद्ध नियोजकों और उनके कर्मकारों के बीच एक ओद्यागिक विवाद विद्यमान है ;
और यतः केन्द्रीय सरकार उक्त विषाद को न्या रनिर्गयन के नि निर्देशित करना वांछनीय समझती है ;
अतः, अब , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) को धारा 10 की उप- धारा ( 1 ) के खंड ( घ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एनद्वारा एक औद्योगिक अधिकरण गठित करती है जिसके पीठासीन अधिकारी श्री मोहम्मद याकूत्र खां होंगे, जिनका मुख्यालय जयपुर होगा और उक्त विवाद को उक्त ओद्योगिक अधिकरण को न्यायनिर्णयन के लिए निर्देशित करती है ।

"क्या हिन्दुस्तान कौपर लिमिटेड , खेतरी कोपर प्राजेक्ट, डाकघर खेतरीनगर , जिला झुनशुनू ( राजस्थान) के प्रबंधकों की श्री वाई ० के ० गौड़ , माईनिंग मेट की सेवाओं को 23 दिसम्बर , 1971 से , समाप्त करने को कार्रवाई न्यायोचित है ? यदि नहीं , तो वह किम अनुतोष का हकदार है ? "
[संख्या एल-29012 ( 19 ) / 72-एल ० आर०-4 ( 1 ) ] S.O. 487 - A ( E ) .-- Whereas by an order of the Government of India in the Minis- try of Labour and Rehabilitation ( Department of Labour and Employment ) No. L-29012 /19 / 72- LRIV ( I ) dated the 15th July , 1972 , an industrial dispute between the employers in relation to the management of Hindustan Copper Limited , Khetri Copper Project, Post Office Khetri Nagar , District Jhunjhunu ( Rajasthan ) , and their workmen has been referred to the Presiding Officer , Industrial Tribunal , Jaipur , for adjudication ;
Now , therefore , in exercise of the powers conferred by section ( 3 ) of section 10 of the Industrial Disputes Act , 1947 ( 14 of 1947 ) , the Central Government hercby prohibits the continuance of the strike in existence in the said establishment in connection with the said dispute .

अतः श्रब , औद्योगिक विवाद श्रधिनियम, 1947 ( 1947 का 14 ) की धारा 10 की धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एनद्वारा उक्त प्रतिष्ठान में उक्त विवाद से सम्बन्धित विद्यमान हड़ताल को निषिद्ध करती है ।
