New Delhi , the 19th July 1972
S.O. 493 ( E ) .- In exercise of the powers conferred by clause ( a ) of sub - section ( 3 ) of section 17 of the Employees ' Provident Funds and Family Pension Fund Act . 1952 ( 19 of 1952 ) , and in supersession of the notif ation of the Government of India in the Ministry of Labour and Rehabilitation ( Department of labour and Employment ) No. S.O. 395 ( E ) , dated the 31st May , 1972 , the Central Govern- ment hereby directs that every employer in relation to an establishment exempted under clause ( a ) or clause ( b ) of sub - .. ection ( 1 ) of stion 17 of the said Act or in relation to an employee or a class of employees e empted under paragraph 27. or as the case may be , paragraph 27A of the Em loyees ' Provident Funds Scheme . 1952. shall transfer the monthly provident fund contributions within fifteen days of the close of the month to the Board of Trustees , duly constituted in respect of that establishment . and that the said Board of Trustees shall invest every month, within a period of two weeks from the date of receipt of the said

amounts from the employer , the provident fund accumulations , that is to say , the contributions , interest and sundry receipts as reduced by any obligatory out- goings , in accordance with the following pattern , namely :-

Provided that any shortfall in investment in the securities referred at ( ii ) , during the period from 1st April . 1972to 30th June , 1972 , shall be made up loring the period from 1st July , 1972 to 31st March , 1973 , so that the overall investment in these securities during 1972-73 should be 25 per cent

All re - investment of provident fund accumulations ( whether invested securities created and issued by the Central Government or in savings certificates Issued by the Central Government or in securities created and issuel by a State Government ) shall also be made accordingto the pattern mentioned in paragraph 1 above .
3 The Board of Trustees shall formulate proper procedure for prompt invest- ment or reinvestment of accumulations in accordance with the aforesaid diver- tions and shall have it approved by the Regional Provident Fund Commissioner concerned .
4. This notification shall be deemed to have come into force with effect from the 1st July , 1972 .

का० श्रा०-493 ( श्र) कर्मचारी भविष्य निधि और कुट्म्ब पेंशन निधि अधिनियम , 1952 ( 1952 का 19) की धारा 17 की उपधारा ( 3 ) के खण्ड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के श्रम और पुनर्वास मंत्रालय ( श्रम और रोजगार विभाग ) की अधिसूचना संख्या का०आ०395 ङ 31 मई, 1972 को अधिक्रमण करते हुए केन्द्रीय सरकार एतद्वारा निदेश देती है कि उक्त अधिनियम की धारा 17 की उपधारा ( 1 ) के खण्ड (क ) या ( ख ) के अधीन छूट प्राप्त स्थापन से सम्बद्ध या कर्मचारी भविष्य निधि स्कीम, 1952 के पैरा २८ या यथास्थिति, पैरा 27 -क के अधीन छूट प्राप्त कि.मी कर्मचारी या कर्मचारियों के वर्ग में मात्र प्रत्येक नियोजक भतिनिधि के मासिक श्रभिदाय उस स्थापन की बावत सम्यक रूप से गठित न्यामी-बोर्ड का मामान्त के पन्द्रह दिन के भीतर अन्तरित कर देगा और उक्त न्यामी -बोर्ड भविष्यनिधि संचयनों को, अर्थात अभिदायों, SFC . 3 ( 1 ) 1

व्याज और विविध प्राप्तियों को , बाध्यकर निर्गमों से कम करके , निम्नलिखित नमूने के अनुसार हर मास , नियोजक से उक्त रकमों की प्राप्ति की तारीख से दो सप्ताह की अवधि के भीतर विनिहित करेगा , अर्थात :-
पहली अक्तूबर , 1972 से 31 मार्च , 1973 तक
पहली जुलाई , 1972 में 30 सितम्बर 1972 तक
( 1) केन्द्रीय सरकार प्रतिभूतियों में और लघु बचतें ( डाकघरों में आवधिक जमायों के अतिरिक्त)

( ii ) राज्य सरकार प्रतिभूतियों केन्द्रीय सरकार या राज्य सरकारों द्वारा गारण्टीकृत प्रतिभूतियों में

(iii ) डाकघरों में आवधिक जमाओं मे

बशर्तें कि ( ii ) में निर्दिष्ट प्रतिभूतियों में निवेप में पहली अप्रैल , 1972 से 30 जून, 1972 के दौरान हुई कमी पहली जुलाई , 1972 से 31 मार्च , 1973 के दौरान पूरी कर लो जायेगी ताकि 1972-73 में इन प्रतिभूतियों से माग निवेष 25 प्रतिशत हो जाय ।
2. भविष्य निधि मचयनों के सभा पुनर्वािनधान ( चाहे केन्द्रीय सरकार द्वारा सृष्ट और जारी की गई प्रतिभूतियों में विनिहित किए जाए या केन्द्रीय सरकार द्वारा जारी किए गए बचत प्रमाणपत्तो में या किसी राज्य सरकार द्वारा सृष्ट और जारी को गई प्रनिभूतियों में ) भो ऊपर पैरा 1 में उपणित नमूने के अनुमार किए जाएंगे ।
3. न्यासी-बोर्ड संचयनों के पूर्वोक्त निर्देशों के अनुसार तत्काल विनिधान या पुर्नावनिधान के लिए उचित प्रक्रिया बनाएगा और उसे संबंधित प्रादेणिक भविष्य निधि श्रयुक्त से अनुमोदित कराएगा ।
4. यह अधिसूचना पहली जुलाई , 1972 से लागू हुई समझी जाएगी ।
