SUBJECT . Conversion of Release Orders into licences for import of spare parts .
No. 106 - ITC ( PN ) /72.-Attention is invited to the provisions contained in sub - paragraph 97 ( 9 ) of the Import Trade Control Hand Book of Rules & Procedure , 1972-73 , according to which an actual user holding a release Order in respect of canalised item ( s ) can apply for conversion of the release order , upto 10 per cent of its value , into a licence for the import of spare parts permissible to the unit under the import policy in force .

2. Such applications for conversion can be made to the licensing authorities concerned as stated in the said sub - paragraph 97 ( 9 ) of the Hand Book . On a review of the position , it has been decided that actual users ( other than small scale units ) holding release orders issued to them under the policy for Actual Users should apply for conversion in terms of the aforesaid sub - paragraph 97 ( 9 ) to the licensing authority concerned through the sponsoring authority . The sponsoring authority will forward the application to the licensing authority con- cerned with its recommendation , indicating also the modes of financing for the licence to be issued for import of spare parts ,
3. Actual users ( both large and small scale units ) holding release orders issued to them under the import policy for Registered Exporters and small scale units should apply direct to the licensing authorities concerned as laid down in the aforesaid sub - paragraph 97 ( 9 ) of the Hand Book .

विषय-फालतू पुर्जों के आयात के लिए रिहाई आदेशों का लाइसेंसों में परिवर्तन ।
सं ० 106 - ब्राई ० टी ० सी० (पी एन ) / 72 आयात व्यापार नियंत्रण नियम तथा प्रक्रिया हैंडबुक 1972-73 के उप -पैरा 97 ( 9 ) में निहित व्यवस्थाओं को ओर ध्यान आकृष्ट किया जाता है जिनके अनुसार एक वास्तविक उपयोक्ता जिस के पास सरणीबद्ध मद ( मदों के लिए रिहाई आदेश है तो वह लागू आयात नीति के अधीन यूनिट को अनुमेय फालतू पुर्जों के आयात के लिए रिहाई आदेश को उसके मूल्यके 10 प्रतिशत तक के लिए लाइसस में परिवर्ति करने के लिए आवेदन कर सकता है ।
2. परिवर्तन के लिए ऐसे आवेदन पत्र जैसा कि हैंड बुक के उक्त उप -पैरा 97 ( 9 ) में बताया गया है सम्बद्ध लाइसेंस प्राधिकारियों को भेजे जा सकते हैं । स्थिति की पुनरीक्षा करने पर यह निश्चय किया गया है कि ऐसे वास्तविक उपयोक्ता ( लघु नैमाने उद्योगों से भिन्न ) जिन्हें वास्तविक उपयोक्ताओं के लिए नीति के अन्तर्गत रिहाई श्रादेश जारी किए गए हैं उन्हें चाहिए कि वे उप पूर्वोक्त उप - पैरा 97 ( 9 ) के अनुसार परिवर्तन के लिए प्रायोजक प्राधिकारी के माध्यम से सम्बद्ध लाइसेंस प्राधिकारी को आवेदन करें । प्रायोजक प्राधिकारी फालतू पुर्जों के श्रायात के लिए जारी किए जाने वाले लाइसेंस के लिए वित्त लगाने के तरीके को भी निर्दिष्ट करते हुए आवेदनपत्त्र को अपनी सिफारिश के साथ सम्बद्ध लाइसेंस प्राधिकारी को अग्रसारित करेगा ।

3. ऐसे वास्तविक उपयोक्ता ( बड़े तथा लघु पैमाने उद्योगों, दोनों) जिनके पास पंजीकृत निर्यातकों के लिए तथा लघु पैमाने उद्योगों के लिए आयात नीति के अन्तर्गत जारी किए गए रिहाई आदेश हैं उन्हें चाहिए कि वे हैंड बुक के पूर्वोक्त उप-पैरा 97 ( 9 ) में नया निर्धारित , सम्बद्ध लाइसेंस प्राधिकारी को सीधे आवेदन करें ।
