THE GOVERNORS OF THE STATES OF MANIPUR AND TRIPURA (ALLOWANCES AND PRIVILEGES ) ORDER , 1972 .
G.S.R. 189. The following Order made by the President on 15th July , 1972 is published for general information :-
In pursuancepursuance of section 48 of the North - Eastern Areas ( Reorganisation ) Act , 1971 (81 of 1971 ) , the President hereby makes the following Order , namely :---
1. ( 1 ) This Order may be called the Governors of the States of Manipur and Tripura (Allowances and Privileges ) Order , 1972 .
(2) It shall be deemed to have come into force on the 21st day of January, 1972.
2. The General Clauses Act , 1897 ( 10 of 1897 ) , applies for the interpretation of this Order as it applies for the interpretation of a Central Act .
3. In this Order ,
(a) "Governor " means the Governor of the State of Manipur or Tripura .
(b) " acting Governor " means a person appointed by the President to dis- charge the functions of a Governor;

(c) " maintenance " in relation to official residence includes the payment of local rates and taxes and the provision of electricity , gas and water and in relation to motor cars , includes the pay and allowances of chauffeurs and the provision of oil and petrol ;
( d ) " Official railway saloons , river craft and aircraft " , in relation to the Governor, means such railway saloons , river craft and aircraft , if any , as may be provided for use ;
ho ( e ) " official residence " in relation to the Governor means the official resi- dence specified in column ( 2 ) of the First Schedule to this Order and includes such other residence or residences as may be used as official residence or residences of the Governor and also includes the staff quarters and other buildings appurtenant thereto and the gardens thereof;
( f) " State " means the State of Manipur or Tripura .
4. ( 1 ) There shall be paidto the Governor , including an acting Governor , in connection with his appointment , an allowance equal to his actual expenses in travelling , with his famıly if any, and his family's cílects , to take up his dulies as Governor or acting Governor , as the case may be , and a similar allowance on his vacating the office of Governor , or acting Governor , to return to the place where he ordinarily resided at the time of his appointment
( 2 ) There shall also be paid to the Governor but not an acting Governor , in connection with his appointment--
( i ) a sum to be fred from time to ' ime by the President and to be payable subject to such conditions as may be dete " mined by him , to be speni on the purchase of suilable motor cars for the use of the Gove- nor ; and
( ii ) Governor's actual expenses on the freight and insurance in transportin , those motor cars to the State .
5. The Governor , throughout his term of office , shall be entitled , without pay- ment of rent c : Lire , to the use of bic official residence and official railway saloons and river craft and aircraft and of the motor cars provided for his use, and no charge shall fall on him personally in respect of the maintenance thereof .
6. ( 1) There shall be pad from time to time to the Governor an allowance equal to his actual expenses in renewing the furnishings of his official residence , so , however , that the total mount paid shall not exceed the maximum specifled in column ( 3 ) of the First Schedule to this Order :
has Provided that if , when the Governor assumes office , the period which elapsed since his predecessor assumed office ( acting Covernors being disregarded ) falls short of five years , the maximun . so specified shall he decreased by amount as the President may by special order determine . such
(2) Sub -paragraph ( 1 ) does not apply to an acting Governor .
7. In order that the Governor may be enabled to discharge conveniently and with dignity the duties of his office, there shall, in each year , be chcharged on, and paid out of , the Consolidated Fund of the State concerned-
(a) for each of the purposes specified in the Second Schedule to this Order such amount not exceeding the maximum amount specified in the appropriate column of that Schedule , as may be reuired by the Governor;
(b) for the maintenance , improvement , renewal or replacement of the Governor's official residence such amount not exceeding the maxi- mum amount specified in the Third Schedule to this Order , as may be required by the Governor ; and
(c ) such amount for expenditure on official railway saloons as may be de- termined by special order of the President :
Provided as follows :-
(1) that the Governor may , with the approval of the President , reappro- priate , whenever necessary , from one sub - head to another sub-head SEC . 3 ( 1 ) ]

specified in the Second Schedule , but so as not to exceed the maxi- mum amount specified in column ( 8 ) thereof;
(2) that the maximum amount specified in column ( 8 ) of the Second Schedule may in any year be increased by the amount not expended in previous years and also by such amount as the Governor may con- sider necessary to defray the leave allowances and pension charges of the Aide-de-Camp;
( 3 ) that if dearness or other allowance admissible at the commencement of this Order be merged in the pay or increased or reduced at any time, the maximum amount specified against any of the appropriate suh -heads of the Second Schedule shall be deemed to have been in- creased or reduced accordingly ;
(4) that no expenditure shall be incurred on the maintenance , improve- ment , renewal or replacement of official residence in excess of the amounts specified in the Third Schedule except with the special order of the President which must be obtained in advance;
( 5) that the Governor may without exceeding the maximum specifled in column ( 8 ) of the Third Schedule , reappropriate , whenever neces- sary , from one sub - head of the said Schedule to another sub -head thereof.
8 No customs duties shall be levied on the following articles if imported or purchased out of bond by the Governor on appointment or during his tenure of office-
( a) articles for the personal use , wear or consumption of the Governor or any member of his family;
(b ) food , drink , and tobacco for consumption by members of the Governor's household or hy his guests , whether official or not ;
( c ) articles for the furnishing of any of the Governor's official residences;
(d) motor cars provided for the Governor's use .
9. Notwithstanding the cesser of operation of the North - Eastern Areas (Re- organisation ) ( Governors ' Allowances and Privileges ) Provisional Order , 1972, anything done or any action taken under the said Order shall be deemed to have been done or taken under the corresponding provision of this Order .

MEMORANDUM
On the reorganisation of North-Eastern areas , the Governor of Assam and Nagaland was appointed also as the Governor of Manipur and Tripura . As the formulation and consideration of proposals relating to the allowances of the Governor in relation to the Raj Bhavans in these States would have taken time , a provisional Order entitled the North - Eastern Areas ( Reorganisation ) ( Gover- nors ' Allowances and Privileges ) Provisional Order , 1972 was issued to cover the period from the 21st January , 1972 to 31st March , 1972. This Order which seeks to replace the provisional Order has , therefore , been given retrospective effect from the 21st January , 1972. No one's interest is prejudicially affected by reason of the retrospective effect as is being given in this Order .

मणिपुर ओर त्रिदुरा 'राज्यों के राज्यपाल ( भते और विशेषाधिकार ) आवेश, 1972
सा० का ० नि ० 15 जुलाई , 1972 को राष्ट्रपति द्वारा किया गया निम्नलिखित आदेश सामान्य सूचना के लिए प्रकाशित किया जाता है :--
पूर्वोत्तर क्षेत्र ( पुर्नगठन ) अधिनियम , 1971 ( 1971 का 81 ) की धारा 48 के अनुमरण में राष्ट्रपति एतद्वारा निम्नलिखित आदेश करते हैं अर्थात्: --
13 ( 1 ) इस आदेश का संक्षिप्त नाम मणिपुर और त्रिपुरा राज्यों के राज्यपाल ( भत्तं और विशेषाधिकार ) आदेश , 1972 है ।
( 2) वह 21 जनवरी , 1972 को प्रवृत हुआ समझा जाएगा ।
2. साधारण खण्ड अधिनियम , 1897 ( 1897 का 10 ) इस आदेश के निर्वाचन को इसी प्रकार लागू होता है जैसे वह किसी केन्द्रीय अधिनियम के निर्व। चन को लागू होता है ।
3. इस आदेश में , --
(क) " राज्ययाल " से मणिपुर या त्रिपुरा राज्य का राज्यपाल अभिप्रत है ;
(ख ) " कार्यकारी राज्यपाल" से राज्यपाल के कृत्यों का निर्वहन करने के लिए राष्ट्र- पति द्वारा नियुक्त किया गया व्यक्ति अभिप्रेत है ;
( ग) शासकीय निवास के संबंध में " अनुदान " के अन्तर्गत स्थानीय रेट और कर देना तथा बिजली , गैस और पानी की व्यवस्था करना भी है और मोटर कारों के संबंध में इसके अन्तर्गत नौकरों के वेतन और भत्ते तथा तेल और पेट्रोल की व्यवस्था भी है ;
( घ ) राज्यपाल के संबंध में " शासकीय रेल सैलून, नदीयान और वायुयान " से ऐसे रेल सैलून , नदीयान और वायुयान ( यदि कोई हों ) श्रभिप्रेस हैं जिनकी व्यवस्था उसके उपयोग के लिए की जाए ;
( ङ ) राज्यपाल के संबंध में " शासकीय निवास " से इस आदेश की प्रथम अनुसूची के स्तंभ ( 2 ) में विनिर्दिष्ट शासकीय निवास अभिप्रेत है और इसके अन्तर्गत अन्य ऐसा निवास या अन्य ऐसे निवास भी हैं जिमका उपयोग राज्यपाल के शासकीय निवास या निवासों के रूप में किया जाए तथा उनसे अनुलग्न कर्मचारिवृन्द के क्वाटर और अन्य निर्माण तथा उनके बाण भी इसके अन्तर्गत हैं ;
(च) "राज्य" से मणिपुर या त्रिपुरा राज्य अभिप्रेत हैं;
4 ( 1 ) राज्यपाल को ( जिसके अन्तर्गत कार्यकारी राज्यपाल भी है ) उसकी नियुक्ति के संबंध में एक भत्ता दिया जाएगा जो उस वास्तविक व्यय के बराबर होगा जो वह , यथास्थिति , राज्यपाल THE GAZETTE OF INDIA EXTRAORDINARY

या कार्यकारी राज्यपाल के अपने कर्तव्य ग्रहण करने के लिए , अपने कुटुम्ब ( यदि कोई हो ) सहित तथा अप ने कुटुम्ब की चीजवस्तु के सहित , यात्रा पर करे और राज्यपाल या कार्यकारी राज्यपाल का पद रिक्त करने पर उसे वैसा ही भत्ता उमकी नियुक्ति होने के ममय के उसके मामुली तौर पर निवास के स्थान तक वापस जाने के लिए दिया जाएगा ।
( 2) राज्यपाल को ( न कि कार्यकारी राज्यपाल को) उसकी नियुक्ति के संबंध में निम्न- लिखित भी दिये जाएंगे:-
( I ) राज्यपाल के उपयोग के लिए उपयुक्त मोटर कारें खरीदने पर व्यय करने के लिए राष्ट्रपति द्वारा समय -समय पर नियन की जाने वाली धनराणि जो ऐसी शर्तों पर दी जाएगी जां राष्ट्रपति द्वारा अवधारित की जाएं , तथा
( II ) उन भोटर कारों को उग राज्य में से जाने के भाई और बीमे पर होने वाला राज्यााल का वास्तविना काय
5 राज्यधान अपनी प्रो पदावधि पर्यन्त इम वान का हकदा होगा कि कोई किराया या भाड़ा दिए बिना अपने शापकीय निवास तथा गीय रेल सैलूनों, नदीयान श्रौत्र वायुयान का तथा उसके उपयोग के लिए व्यवस्थित मोटरकारों का उपयोग करे श्रीर उनके अनुसरण की बाबत होने वाले किसी व्यय का भार स्वयं उस पर न पड़ेगा ।
6 ( 1 ) राज्यपाल को समय - समय पर एक भत्ता दिया जाएगा जो उस वार्तावक व्यय के बराबर होगा जो उसके शासकीय निवास को माजगज्जा के नवीकरण पर हो , किन्तु दी गई कूल २ कम इप श्रध्देग को प्रथध अनुमूवी के स्वंम ( 3 ) में दी गई अधिकतम रकम से अधिक न होगी !
परन्तु यदि ( कार्यकारी राज्यपालों का छोड़कर) उसके पदपूर्ववर्ती के पद ग्रहण करने के समय से उसके पद ग्रहण करने तक व्यतीत हुआ समय पांच वर्ष से कम हो तो इस प्रकार विनिदिष्ट अधिक तम रकम में से उतनी रकम घटा दी जाएगी जिननी राष्ट्रपति विशेष आदेश द्वारा अवधारित करे ।
( 2 ) उन -पैरा ( 1 ) कार्यकारी राज्यपाल को लागू नहीं होता है ।
J राज्यपाल को अपने पद के कर्तव्यों का सुविधापूर्वक एवं गरिमा के साथ निव हुन करने में समर्थ बनाने के लिए निम्नलिखित राशियों प्रति वर्ष संबंधित राज्य की संचित निधि पर भारित की जाएंगी श्रार उसमें से दी जाएंगी:---
( क ) उस आदेश को विद्वतीय अनुसूची में विनिदिष्ट प्रत्येक प्रयोजन के लिए उस अनुसूची के समुचित स्तंभ में विनिर्दिष्ट अधिकतम रकम से अनधिक ऐसी रकम जिसकी राज्यपाल अपेक्षा करे ।
( व्र ) राज्यपाल के शासकीय निवास के अनुरक्षण , सुधार और नवीकर और उसे बदलने के लिए , इस आदेश की तृतीय अनुसूची में विनिर्दिष्ट अधिकतम रकम से अनधिक एसी रकम जिसकी राज्यपाल अपेक्षा करे , तथा THE GAZETTE OF INDIA EXTRAORDINARY

( ग ) शासकीय रेल सैलूनों पर व्यय के लिए ऐसी रकम जो राष्ट्रपति के विशेष आदेश द्वारा अवधारित की जाए :
परन्तु--
( 1 ) राष्ट्रपति के अनुमोदन से राज्यपाल, जब भी आवश्यक हो, द्वितीय अनुसूची में विनिर्दिष्ट एक उपशीर्ष से दूसरे उपशीर्ष में पुर्नविनियोग कर सकेगा, किन्तु इस प्रकार की व्यय उसके स्तंभ ( 8 ) में विनिर्दिष्ट रकम से अधिक न हो ;
( 2 ) द्वितीय अनुसूची के स्तंभ ( 6 ) में बिनिर्दिष्ट अधिकतम रकम में किसी वर्ष में उतनी रकम बढ़ाई जा सकेगी जितनी पूर्व वर्षों में व्यय न की गई हो और उतनी रकम भी बढ़ाई जा सकेगी जितनी राज्यपाल अपने ए ० डी ० सी ० के छुट्टी भत्तों और पेंशन प्रभारों को चुकाने के लिए आवश्यक समझे ;
( 3) यदि ऐसे आदेश के प्रारम्भ के समय श्रनुज्ञेय मंहगाई या अन्य भत्ता किसी समय में मिला दिया जाए अथवा बढा या घटा दिया जाए तो द्वितीय अनुसूची के समुचित उपशीर्षों में से किसी के सामने विनिदिष्ट अधिकतम रकम भी तदन्सार बढ़ाई या घटाई गई समझी जाएगी ;
( 4) शासकीय निवास के अनुरक्षण , सुधार या नवीकरण या उसे बदलने पर कोई व्यय , पूर्व प्राप्त किये गए राष्ट्रपति के विशेष आदेश के बिना. उन रकमों से अधिक न होगा जो तृतीय अनुसूची में विनिर्दिष्ट है ;
( 5 ) तृतीय अनुसूची के स्तंभ ( 8 ) में विनिर्दिष्ट अधिकतम का उल्लंघन किए बिना राज्यपाल , अब भी आवश्यक हो, उक्त अनुसूची के एक उपशीर्ष से दूसरे उपशीर्ष में पुनिविनियोग कर सकेगा ।
8 यदि राज्यपाल अपनी नियुक्ति होने पर या अपनी पदावधि के दौरान निम्नलिखित कोई वस्तुएं अवैधपत्रित रूप से आयातीत करे या खरीदे तो उस पर किसी उत्पाद शल्क का उद्ग्रहण नहीं किया जायेगा:-
(क ) राज्यपाल या उसके कुटुम्ब के किसी सदस्य के निजी उपयोग , पहनने या उपभोग कीकोई वस्तुएं ;
( ख ) राज्यपाल के गृह के सदस्यों द्वारा या उसके अतिथियों द्वारा ( चाहे वे शासकीय हों या न हों ) उपभोग के लिए खाद्य, पेय और तंबाकू ;
( ग ) राज्यपाल के किसी शासकीय निवास की साजसज्जा के लिए बस्तुएं ;
( घ ) राज्यपाल के उपयोग के लिए व्यवस्थित मोटर कारें ।
9 पूर्वोत्तर क्षेत्र ( पुनर्गठन ) ( राज्यपालों के भत्ते और विशेषाधिकार ) अन्तिम आदेश, 1972 का प्रवर्तन समाप्त हो जाने पर भी यह है कि उक्त आदेश के अधीन की गई कोई बात या कार्यवाई इस आदेश के तत्स्थानी उपबन्ध के अधीन की गई समझी जाएगी ।

पूर्वोत्तर क्षेत्रों का पुनर्गठन होने पर आसाम और नागालैंड के राज्यपाल को मणिपुर और त्रिपुरा के राज्यपाल के रूप में भी नियुक्त किया गया । इन राज्यों के राजभवनों से सम्बन्धित राज्यपाल के भत्तों विषयक प्रस्थापनाओं को तैयार करने और उन पर विचार करने में समय लगना स्वभाविक था । अतः एक अंन्तिम आदेश 21 जनवरी , 72 से 31 मार्च , 1972 तक के लिए जारी किया गया । इसका नाम था पूर्वोत्तर क्षेत्र ( पुनर्गठन ) ( राज्यपालों के भत्ते और विशेषाधिकार ) अन्तिम श्रदेश , 1972। प्रस्तुत आदेश उस अन्तिम आदेश का स्थान ग्रहण करने के लिए है । अतः उससे 21 जनवरी , 1972 से प्रभावी किया गया है । इस आदेश को यह भूतलक्षी प्रभाव देने से किसी पर कोई प्रतिकूल प्रभाव नहीं पड़ता ।
