S.O. 515 ( E) .- Whereas an industrial dispute exists between the employers in relation to the Royal Exchange Assurance , Guardian Assurance Company Ltd. , Union Insurance Society of Canton Ltd. Legal and General Assurance Society Ltd. , South British Insurance Company Ltd. , Yorkshire Insurance Company Ltd. , Eagle Star Insurance Company Limited , and the Home Insurance Company , and their workmen represented by the General Insurance Employees Union , Western Zone , Bombay:
And, whereas the said employers and workmen have under sub - section ( 1 ) of Section 10A of the Industrial Disputes Act , 1947 , ( 14 of 1947 ) , agreed to refer the dispute to arbitration by arbitration agreement and have forwarded to the Central Government under Sub - section ( 3 ) of the said Act a copy of the said arbitration agreement :
Now, therefore , in pursuance of sub - section ( 3 ) of Section 10 ( A) of the said Act . the Central Government hereby publishes the said arbitration agreement which was received by it on the 1st August , 1972 .

Agreement
(Under Section 10A of the Industrial Disputes Act , 1947 )
BETWEEN
Names of Parties :
Representing employers . The General Insurance Companies whose names appear in Schedule A.
Representing workmen . General Insurance Employees' Union , Western Zone , Bombay representing workmen in the employment of Companies enu- merated in Schedule A.
It is hereby agreed between the Parties to refer the following industrial dispute to the arbitration of Mr. N. L. Abhyankar .
(1) Specific matters in dispute . Keeping in view all the circumstances Jead- ing to the dispute whether the various categories of employees of the Companies covered by this Arbitration Agreement are entitled to any ad - hoc increases in their monthly emoluments for the period from 1st May , 1971 to 31st December , 1972 , and if so what should be the quantum of such increases for each of the several categories of the employees .
( 11 ) Details of the parties to the dispute including the name and adddress of the establishment or undertaking involved . The companies in Schedule A and their workmen in the employment of these companies stationed in Bombay .
( iii ) Name of the Union , if any , representing the workmen in question. The General Insurance Employees ' Union . Western Zone , Bombay , 6 , King Lane , Fort , Bombay - 1 .
( iv) Total number of workmen employed in the undertaking affected.- Approximately 367 .
( v) Estimated number of workmen affected by the dispute . Same as above .
The Arbitrator shall make his award within a period of two months from the date on which the Central Government refers the above dispute to him , or within such further time as is extended by mutual agreement between the parties In writing . In case the award is not made within the period aforementioned , the reference to arbitration shall stand automatically cancelled and the parties shall be free to negotiate for fresh arbitration .

का० ग्रा ० 515 ( प्र) यतः रोयल एक्सचेंज एश्योरेन्स , गार्डिअन एश्योरेन्स कम्पनी लि ० , कैलेडोनियम इंश्योरेन्स कम्पनी , ऐटलस एश्योरेंस कम्पनी लि ० , यूनियन इंश्योरेन्स सोसाइटी आफ कैण्टन लि० , लीगल एण्ड जनरल एश्योरेंस सोसाइटी लि ० , साउथ ब्रिटिश इंश्योरेन्स कम्पनी लि ० , यार्कशायर इंश्योरेंस कम्पनी लि ० और दि होम इंश्योरेंस कम्पनी के प्रबन्तंत्र से सम्बद्ध नियोजकों और उनके कर्मकारों के बीच जिनका प्रतिनिधित्व जन ग्ल इंश्योरेस इम्प्लायीज यूनियन , वस्टर्न जोन , बम्बई करती है , एक औद्योगिक विवाद विद्यमान है ;
और यतः उक्त नियोजकों और कर्मकारों ने औद्योगिक विवाद श्रधिनियम , 1947 ( 1947 का 14 ) की धारा 10 -क की उपधारा ( 1 ) के उपबन्धों के अन्तर्गत एक करार द्वारा उक्त विवाद को माध्यस्थम के लिए निर्देशित करने का करार कर लिया है और उक्त माध्यस्थम करार की एक प्रति उक्त अधिनियम की उप - धारा ( 3 ) के अन्तर्गत केन्द्रीय सरकार को भेजी है ;

अतः , अब, औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14 ) की धारा 10 - फ की उप -धारा ( 3 ) के उप न्धों के अनुसरण में, केन्द्रीय सरकार उक्त माध्यस्थम करार को, जो उमे पहली अगस्त, 1972 को मिला था , एतद्वारा प्रकाशित करती है ।
करार
(औद्योगिक विवाद अधिनियम, 1948 की धारा 10 - क के अधीन )
पक्षकारों के नाम:
जनरल इंश्योरेंस कम्पनियां , जिनके नाम अनुसूची क में दिये गये हैं ।
नियोजकों का प्रतिनिधित्व करने वाले:
कर्मकारों का प्रतिनिधित्व करने वाले
जनरल इंश्योरेंस ऐम्प्लायीज यूनियन , वेस्टन जोत , बम्बई जो अनुसूची क में निदिष्ट कम्पनियों की नौकरी में लगे कर्मकारों का प्रतिनिधित्व करते हैं ।
संबंधित पक्षकारों के बीच निम्नलिखित श्रौद्योगिक वित्राद को श्री एन ० एल ० अभयंकर के माध्यस्थम् के लिए निर्देशित करने का करार किया गया है :-
( i ) विनिर्दिष्ट विवादग्रत विषय-इस विवाद को उठाने वाली सभी परिस्थितियों के दृष्टि में रखते हुए कि कम्पनियों के विभिन्न के कर्म त्रारी वर्गों जो इस करार के अन्तर्गत आते हैं, अपनी मासिक परिलब्धियों में 1-5-1971 से 31-12-1972 की समयावधि के लिए तदर्थं वृद्धि पाने का हकदार है और यदि हां , तो कर्मचारियों के अनेक वर्गों में से प्रत्येक वर्ग के लिए ऐसी वृद्धियों की राशि क्या होगी ?
( ii ) विवाद के पक्षकारों का विवरण जिसमें अंतर्यालत स्थापन या उपक्रम का नाम और पता भी सम्मिलित है ।
अनुसूची क में निर्दिष्ट कम्पनियों और बम्बई में स्थित इन कम्पनियों की नौकरी में लगे उनके कर्मचारी ।
( iii ) यदि कोई संघ प्रश्तगत कर्तकारो का प्रतिनिधित्व करता हो तो उसका नाम: जनरल इंश्योरेश इंप्लायीज यूनियन , वेस्टर्न जोन , बम्बई, 6 किंग लेन , फोर्ट बम्बई-1 ।
( IV ) प्रावित उप- क्रम में नियोजित कर्तकारों की फूल संप्या । लगभग 3671
(V ) विवाद द्वारा प्रभावित या संभाव्यतः प्रभावित होने वाले कर्मकारो की प्राक्कलित संध्या:
वही जो ऊपर दी गई है ।
मध्यस्थ अपना पंचाट उस तारीख से जब कि केन्द्रीय सरकार उपर्युक्त विवाद उनको भेजेगी, दो मास की कालावधि या इतने समय के भीतर जो संबंधित पक्षों के बीच पारस्परिक करार द्वारा बढ़ाया जाय , देंगे । यदि पूर्व वर्णित कालावधि के भीतर पंचाट नहीं दिया जाता तो माध्यस्थम् के लिए निर्देश स्वतः रद्द हो जायगा भौर संबंधित पक्ष नए माध्यस्थम के लिए बातचीत करने को स्वतंत्र होंगे ।

And , whereas , the said Companies and the said Union have, by a written agree- ment in pursuance of the provisions of sub - section ( 1 ) of Section 10A of the Indust- rial Disputes Act , 1947 ( 14 of 1947 ) , agreed to refer the said dispute to arbitration of the person mentioned therein , and a copy of the said arbitration agreement has been forwarded to the Central Government and the same has been published, under the provision of sub - section ( 3 ) of the said Scction , with the order of the Government of India in the Ministry of Labour and Rehabiliation ( Department of Labour and Employment ) No. S.O. 515 ( E ), dated the 3rd August , 1972 published in Part II , Sec- tion 3 , Sub - section ( 11 ) of the Gazette of India . Ordinary , dated the 3rd August, 1972 .
And, where as , the Central Government is satisfied that the persons making the said reference represent the majority of the party;
Now, therefore , in pupursuance of the provisions of Sub - section ( 3A) of the said Section, read with Rule 8A of the Industrial Disputes ( Central Rules ) , 1957 , the Central Government hereby notifies for the information of the employers and work- men who are not parties to the said arbitration agreement but who are concerned with the said dispute , that the person making said reference represented the majori- ty of each party .

और यतः उक्त कम्पनियों और उक्त यूनियन ने औद्योगिक विवाव श्रधिनियम , 1947 (1947 का 14 ) की धारा 10 -क की उपधारा ( 1 ) के उपबन्धों के अनुसरण में एक लिखित करार द्वारा उक्त विवाद को उसमें वर्णित व्यक्ति के माध्यस्थ के लिए दिष्ट करने का करार कर लिया है और उक्त माध्यस्थम करार की एक प्रति केन्द्रीय सरकार को भेजी गई है और वह क्त धारा की उपधारा ( 3 ) उपबन्ध के अधीन श्रम और पूनर्वास मंत्रालय ( श्रम और रोजगार विभाग ) के आदेश संख्या 51 (श्र ( अ ) तारीख 3 श्रगन 1972 द्वारा भारत के असाधारण राजपत्र दिनांक 3 अगस्त, 1972 के भाग 2 , खण्ड 3 , उपखण्ड 3 ( ii ) में प्रकाशित हुआ है ;
और यतः केन्द्रीय सरकार का समाधान हो गया है कि उक्त निर्देश करने वाले व्यक्ति पक्ष के बहुमत का प्रतिनिधित्व करते हैं ;
अत; अब , औद्योगिक विवाद ( केन्द्रीय नियमावली ) , 1957 के नियम 8 -क के साथ पढ़े जाने वाली उक्त धारा की उपधारा ( 3) के उपबन्धों के अनुसरण में , केन्द्रीय सरकार एतदद्वारा उन योंजकों और कर्मकारों की सूचना के लिए , जो उक्त माध्यस्थम करार में पक्षकार नहीं हैं परन्तु जो उक्त विवाद से संम्बन्धित हैं , अधिसूचित करती है कि उक्त निर्देश करने वाले व्यक्ति प्रत्येक पक्ष के बहुमत का प्रतिनिधित्व करते हैं ;
