NOTIFICATION
New Delhi , the 26th August 1972
G.S.R. 393 ( E ) .-In exercise of the powers conferred by sub - section ( 1 ) of section 3 of the Destructive Insects and Pests Act , 1914 ( 2 of 1914 ) and in super- session of the notification of the Government of India in the late Department of Education , Health and Lands , No. 1581 , Agric . , dated the 1st October , 1931 , and of all other notifications issued in this behalf, the Central Government makes the following regulations for the import of cotton into India , namely:-
1. ( 1 ) These regulations may be called the Import of Cotton into India Regula- tions , 1972 .
( 2 ) They shall come into force on the date of their publication in the Official Gazette.

2. In these regulations , unless the context otherwise requires ,-
(1 ) " Cotton" includes ginned cotton . and droppings , strippings , fly and other waste products of a cotton mill other than yarn waste , but does not include cotton seed or unginned cotton ,
( ii ) "Bale" means any pressed package of cotton whatever size or density ,
(iii) " Square Bale " means a bale of a weight exceeding 270 lbs ..
(iv) " Round Bale" means a bale of a weight not exceeding 270 lbs
3. Cotton shall not be imported into India :-
(1 ) By sea except through the ports of Bombay , Madras , Calcutta , Cochin , Tuticorin or Bhavnagar and unless the following conditions are complied with. namely:-
(a) On or before the departure of a ship carrying a consignment of cotton for Bombay, Madras , Calcutta , Cochin , Tuticorin or Bhavnagar from the port from which the cotton is consigned , the consignee shall ascertain the name of the ship , the probableble date of its arrival in Bombay , Madras , Calcutta , Cochin , Tuticorin and Bhavnagar the number of bales of cotton contained in the consignment , and shall furnish this information to the Collector of Customs , Bombay and to the Quarantine Entomologist , Directorate of Plant Protection , Quarantine and Storage , Bombay or , as the case may be , to the Traffic Manager of the Madras Port Trust and to the Entomologist the Harbour . Madras or the Commissioner of the port of Calcutta and the Entomologist Incharge . Calcutta Port or to the Traffic Manager , Cochin Port and the Quarantine Inspector ( Fumigation ) , Cochin Port . or Port Officer , Tuticorin , or Secretary , Tuticorin Port . and the Entomologist Incharge . Plant Quarantine . Tuticorin Port , or Port Officer . Bhavnagar Port and Plant Quarantine Inspector , Bhavnagar Port as the case mav be not less than 14 days before the arrival of the ship at Bombay , Madras , Calcutta, Cochin , Tuticorin, or Bhavangar provided that where the cotton is loaded for Bombay , Madras , Calcutta , Cochin, Tuticorin , or Bhavangar at Port Sald or at any European Port the Ordi- nary length of voyage from which is less than three weeks . It chall be sufficient at furnish the information not less than ten days before the arrival of the ship at Bombay , Madras , Calcutta, Cochin , Tuticorin or Bhavnagar .
(b) On arrival at Bombay , Madras , Calcutta , Cochin , Tuticorin or Bhavnagar . the cotton shall be disinfected in such manner as may be prescribed in the rules made by the Government of Maharashtra . the Government of Tamil Nadu , the Government of West Bengal or the Government of Kerala or the Government of Gujarat, as the case may be , under section 5 of the Act .
(c ) Prior to taking delivery of the cotton , the importer shall pay to the Collector of Customs . Bombay , or the Docks Manager , Madras Port Trust . or the Commissioners for the Port of Calcutta or the Traffic Manager , Cochin Port , or the Port Officer , Tuticorin , or Secretary . Tuticorin Port . or the Port Officer , Bhav- nagar , as the case may be in accordance with such instructions as may be issued by him, a sum at the rate hereinafter provided which shall cover the cost of fumi- sation, including the cost of loading the cotton into the barge , conveyance to the fumigation wharf or bunder , unloading from the barge after fumigation and delivery at the bunder. but not including docks import charges as specifted by the Bombay Port Trust . the Madras Port Trust , the Cochin Port Authorities , the Tuticorin Port Authorities , as the case may be , in the scale of rates charged at the docks:
Provided that samples of the cotton imported by parcel post or as ship's parce . not exceeding 20 lbs .. each in weight shall be fumicated free of cost at the Plant Quarantine and Fumigation Station . at Bombay , Madras , Calcutta , Cochin , Tuti- corin , or Bhavnagar as the case may be ;
Provided further that the Collector of Customs , Bombay or the Deputy Col- lector of Customs , Bombay , or the Dock Manager of the Madras Port Trust. the Commissioners for the port of Calcutta or the Traffic Manager , Cochin Port , or the Port Officer . Tuticorin , or the Secretary . Tuticorin Port or the Port Officer , Bhavnagar , as the case may be . in accordance with any general or special orders of the Central Government for the time being in force may remit or refund , in whole or in part , anv sum which under this notification is payable or has been paid on any consignment of cotton .

(d ) No vessel shall discharge cotton during a period of rain , mist or drizzle .
( ii ) By air except through the airport of Santa Cruz ( Bombay ) or Meenam- bakam ( Madras ) , Dum Dum ( Calcutta ) or Palam / Safdarjungung ( New Delhi ) and unless the following conditions are complied with ; namely :
(a) Such importation shall be only consignments of ginned cotton packed in a manner which will not allow insects to enter into or escape from them .
(b) The consignment shall be inspected and fumigated or otherwise disinfected on arrival at the port of entry by the Plant Protection Adviser to the Government of India or any other person duly authorised by him in this behalf and the importer shall pay a fumigation or disinfection fee of rupees five per consignment if it exceeds six cubic feet does not exceed twelve cubic feet in volume , and equal amount for every additional six cubic feet or part thereof ,
(c) The consignment shall be plainly and clearly marked to show the general nature and the quantity of the contents , the locality and the country of origin of the contents , the name and address of the shipper or the agent forwarding the same and address of the consignee .
(d) The consignments of ginned cotton intended for other countries shall be allowed transit through Indla by air or transhipment at any of the airports in India mentioned in para ( 1 ) of this notification , if such consignments are packed in a container in such a way as not to allow Insects to enter into or escape from it and the container is not to be opened in any part of India , and also that the consignment is accompanied by an official phytosanitary certificate in the form and in the manner prescribed in the International Plant Protection Convention of 1951 .
( e) The fumigation fee is payable to Collector of Customs at Bombay , Madras , Calcutta or New Delhi , as the case may be.
( f) The importer shall make arrangements himself , or through his agents , to take delivery of the consignment from the Collector of Customs , after the payment of dues , if any .
4. The rate referred to in clause ( c ) of sub - paragraph ( 1 ) of paragraph 3 , shall he Rs . 12.25 per square bale and Rs . 5.25 per round bale at Bombay and Rs . 8.00 per square bale and Rs , 5.50 per round bale at Cochin , Rs . 5.00 per square bale and Rs . 3.50 per round bale at Tuticorin and Rs . 7.44 per square bale and Rs . 5,00 per round bale at Calcutta Docks and Rs . 8.00 per square bale and Rs . 5.50 per round bale at Madras Docks and Rs . 7.70 per square bale and Rs . 5.25 per round bale at Bhavnagar Docks .
( i ) An additional charge of Rs . 3.61 per bale shall be recovered on account of landing , river dues and discharge at Calcutta ;
( 11) in cases in which the importer has failed to furnish information in accord- ance with clause ( a ) of sub - paragraph ( i ) of paragraph 3 each of the rates hereafter prescribed shall be increased by Rs . 2.00 per bale ;
( iii ) the minimum fee for the fumigation of any cotton imported at any one time on a single ship shall be rupees two hundred and ten, and when such minimum fee is levlable it shall if there is more than one consignee, be distributed among the consignees in proportion to the amount of their respective consignments .

सा० का ० नि ० 393 (अ) -विनाशक कीट और नाशक जीव श्रधिनियम , 1914 ( 1914 का 2 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के भूतपूर्व शिक्षा , स्वास्थय और भूमि विभाग की अधिसूचना सं ० 1581 , कृषि, तारीख 1 अक्तूबर , 1931 तथा इपेनिमिन जारी की गई अन्य सभी अधिसूचनाओं को अधिक्रात करते हुए , केन्द्रीय सरकार भारत में कनाभ के आयात के लिए निम्नलिखित विनियम एतद्वारा बनाती है , अर्थात्: --
1 ( 1) इन विनियमों का नाम भारत में कपास का श्रायात विनियम , 1972 में ।
( 2 ) ये राजरत्न में प्रकाशन की तारीख को प्रवत्त होंग ।
2. इन विनियमों में , जब तक की सन्दर्भ से अन्यथा अपेक्षित नहीं--
( i) " कास" में ओटन कपास और सूत रद्दी को छोडकर कपड़ा मिल के ड्रापिग्ज, स्ट्रिपिन्ज, फुलाई तथा अन्य रद्दी उत्पाद सम्मिलित है, लेकिन बिनोला या बगैर ओटी कपास सम्मिलित नहीं हैं ; 1
( ii ) " गोठ " से किसी भी साइज या आयतन का कपास का दबाया गया कोई पैकेज अभिप्राप्त है ;
( iii) " सामानान्तर गांठ " से 270 पोंण्ड से अधिक भार वाली गाठ अभिप्रत है ;
( iv ) " गोल गोठ " से 270 पोंड से अनधिक भार वाली गांठ अभिप्रेत है !
3. भारत में कपास का आयात नहीं किया जाएगा : --
(i ) समुद्र के सिवाय मुम्बई, मद्रास , कलकत्ता, कोचिन , टूटिकोरिन या भावनगर पत्तनों और जब तक कि निम्नलिखित शर्ती का पालन न किया गया , अर्थात्: --
( क ) मुम्बई , मद्रास , कलकत्ता, कोचिन, टूटीकोरिन या भावनगर के लिए से श्रा रहेकपास के परेक्षण वाले पोत को, जिस पतन से कपास परेषित की जानी है उसके रवाना होने पर या या उससे पहले परेषिति, पोत का नाई, उसके मुम्बई , मद्रास कलकत्ता , कोचिन , दूटिकोरिन और भावनगर में पहुंचने की सम्भावित तारीख , परेषण में सम्मिलिखित कपास की गांठों की संख्या का पता लगाएगा और एसी सूचना को सीमा शुल्क कलक्टर मुम्बई को और संगरोध कीट विज्ञानी वनस्पति रक्षा संगरोत्र भण्डार निदेशालय मुम्बई को या यथास्थिति यातायात प्रबन्धक मद्रास पत्तावन न्यास और बन्दरगाह कपट विज्ञानी , मद्रास या कलकत्ता के पत्तन के आयुक्त और भार साधक कीट विज्ञानी, कलकत्ता पतन या यातायात प्रबन्धक, कौचिन पत्तन तथा सांगरोध निरीक्षक ( प्रधूमन ) कौचिन पत्तन. या पत्तन अधिकारी, THE GAZETTE OF INDIA EXTRAORDINARY

टूटिकोरिन या सचिव , दूटिकोरिन पत्तन, और भारसाधक कीट विज्ञार्न। बनस्पति संगरोध टूटीकोरिन पत्तन , था पतन अधिकारी भावनगर पत्तन और वनस्पति संगरोध निरिक्षक भावनगर पत्तन को, यथास्थिति पोत के मुम्बई, मद्रास , कलकत्ता , कोचिन, टटिकोरिन या भावनगर पहुंचने से 14 दिन अन्यून से पूर्व सूचित करेगा । परन्तु जब कपास पोर्ट सईद पर को या किसी योरिपियन पत्तन पर मुम्बई, मद्रास कलकत्ता कोचिन, टूटिकोरिन या भावनगर के लिए कपास लादी गई हो जहाँ से सामान्यतः श्राने का मार्ग -समय तीन सप्ताह से कम है जहाँ पोप्त के मुम्बई , मद्रास, फलकत्ता, कोचिन, टूटिकोरिन या भावनगर पहुंचने के 10 दिन से श्रन्यून से पूर्वसूचना देना पर्याप्त होगा ।
(ख ) मुम्बई , मद्रास , कलकत्ता, कोचिन , टूटिकोरिन या भावनगर पहुंचने पर यथास्थिति , महाराष्ट्र सरकार , तामिलनाडु सरकार , पश्चिम बंगाल या केरल सरकार , या गुजरात सरकार द्वारा अधिनियम की धारा 5 के अधीन बनाये गये नियमों में विहित रीति से कपास रोगाणुनाशित की जायेगी ।
( ग ) कपास की प्राप्ति से पूर्व श्रयातकर्त्ता , यथास्थिति, सीमा-शुल्क -कलक्टर , मुम्बई याडकिप्रबन्धक , मद्रास पत्तन न्यास या कलकत्ता पत्तन के आयुक्त या यातायात प्रबन्धक , कोचीन पत्तन या पत्तन अधिकारी , टुटीकोरिन , या सचिव टूटीकोरिन पत्तन या पत्तन अधिकारी , भावनगर , को उसके द्वारा दिये गये अनुषशों के अनुसार इसमें इसके पश्चात् उपबन्धित दर पर रकम की अदायगी करेगा जिसमें प्रधूमन का खर्चा आएगा जिसमें बजरें में कपास की लदाई का खर्चा, प्रधूमन पाट या बन्दर तक ले जान का खर्चा , प्रधूमन के पश्चात् बजरे से उतारने तथा बन्दर पर देने का खर्चा सम्मिलित है , लेकिन. , यथास्थिति , मुम्बई पत्तन न्यास मद्रास पत्तन न्यास कोचीन पत्तन प्राधिकारी, टूटीकोरिन पत्तन प्राधिकारी द्वारा यथाविनिर्दिष्ट डाक आयात प्रभार डाकों , पर दी जाने वाली दर के मापमान में सम्मि- लित नहीं है ;
परन्तु पार्सल पोस्ट या पोत - पार्सल के रुप में श्रायातित भार में 20 पौण्ड से अनधिक के प्रत्येक कपास के नमूने का प्रधूमन वनस्पति संगरोध और प्रधुमन केन्द्र , यथास्थिति मुम्बई , मद्रास, कलकत्ता , कोचीन , टूटीकोचीन या भावनगर पर निःशुल्क किया जायेगा ;
परन्तु यह और कि यथास्थिति , सीमाशुल्क-कलक्टर , मुम्बई या उप-सीमाशुल्क कलक्टर, मुम्बई या मद्रास पत्तन न्यास के डाक प्रबन्धक , कलकत्ता-पत्तन- श्रायुक्त या यातायात प्रबन्धक कोचीन पत्तन , या पत्तन अधिकारी , टूटीकोरिन या सचिव , टूीकोरिन पत्तन या पत्तन अधिकारी, भावनगर, केन्द्रीय सरकार के तत्समय प्रवृत साधारण या विशेष आदशों के अनुसार कपास के किसी परेषण पर इस अधिसूचना के अधीन जो कोई राशि सम्पूर्णतः भागतः देय है या वे दी गई है , भेज या लौटा सकेगा ।

( घ ) वर्षा, कोहरे , या हल्की वारिश की अवधि के दौरान कोई जलयान कपास नहीं उतार सकेगा ।
( ii ) वायुसे सिवाय सान्नाक्रुज ( मुम्बई ) या मीनाम्बकम ( मद्रास ) , दमदम ( कलकत्ता ) या पालम । सफदरजंग , ( नईदिल्ली ) एयर पोर्ट और जब तक कि निम्न- लिखित शत का पालन न किया गया, अर्थात: --
(क ) एसा भ्रायात, ओटन -कपास को एसी रीति से पैक किए परेषण का, जिससे उनके अन्दर या उनमें से कीट आ-जा न सकें , ही होगा ।
(ख ) पोर्ट में पहुंचने पर परेषण का निरीक्षण और प्रघूमन या अन्यथा रोगाणुनाशन , भारत सरकार के बनास्पति रक्षा सलाहकार या इस निमित उसके द्वारा सम्यक् रूप से प्राधिकृत व्यक्तिद्वारा किया जाएगा और आयातकर्ता परेषण , यदि वह आयतन में 6 क्यूषिक फीट से अधिक लेकिन 12 क्यूबिक फीट से अनधिक है, प्रत्येक प्रेषण पर पांच रुपये की प्रधूमन या रोगाणुनाशन फीस देगा तथा प्रत्येक अतिरिक्त 6क्यूबिक फीट या उसके अंश के लिए बराबर राशि की प्रघूमत या रोगाणुनाशन फीस देगा ।
( ग ) परेषण पर स्पष्ट और साफ तौर पर उसकी साधारण प्रकार तथा अर्न्त वस्तु कीम ।त्रा अर्न्त वस्त के भूलदेश और स्थान भेजने वाले या उसको भेजने वाले अभिकर्ता का नाम और पता तथा परेषिती का पता लिखा होगा ।
( घ ) इस अधिसूचना के गैरा ( 1 ) में उल्लिखित भारत के किसी भी एयरपोर्ट पर अन्य देशों के लिए आशियित ओटन- कपास के परेषण को हवाई जहाज द्वारा भारत से होकर अभिवहन या यातान्तरण की अनुज्ञा मिल जाएगी , यदि ऐसे परेषण ऐसे प्रधानों में इस प्रकार पैक किए गए हों कि उसमें कीट आ - जा न सकें और श्राधान को भारत के किसी भाग में खोला जाना न हो तथा यह भी कि परेषण के साथ अन्तर्राष्ट्रीय बनस्पति रक्षा अभिसमय , 1951 में विहित प्ररूप और रीति में शासकीय पादप स्वेच्छा प्रमाण-पत्र साथ में हो ।
( ङ) प्रघूमन फीस, यथास्थिति , सीमा- शुल्क- कलक्टर , मुम्बई , मद्रास कलकत्ता या नई दिल्ली को देय होगी ।
( च ) आयातकर्ता स्वयं या अपने श्रभिकर्ता के माध्यम से सीमा- शुल्क कलक्टर से परेषण , देय रकम की , यदि कोई हो, अदायगी के पश्चात्, लेने की व्यवस्था करेगा ।
4 परा 3 के अ -परा ( 1 ) के खण्ड (ग ) में निर्दिष्ट दर मुबई में 12.25 रु ० प्रति समानान्तर गांठ और 5.25 रु ० प्रति गोल गांठ और कोचीन में 8.00 रु ० प्रति समानान्तर गांठ और 5.50 रु ० प्रति गोल गांड , टूटीकोरिन में 5.00 प्रति समानान्तर गांठ और 3.50 रु ० प्रति गोल गांठ तथा कलकत्ता डोक पर 7.44 रु ० प्रति समानान्तर गांठ और 5.00 रु ० प्रति गोल गांठ और मद्रास डौक पर 8.00६० प्रति समान। न्तर गांठ और 5.50 रु ० प्रति गोल गांठ तथा भावनगर डोक पप 7.70 रु ० प्रति समानान्तर गांठ और 5.25 रु ० प्रति गोल गांठ होगी ।
(i ) कलकत्ता में उत्तारने का नदी देय तथा निकालने के कारण 3.61६० प्रति गांठ के हिसाब से अतिरिक्त प्रभार लिया जायेगा ।

( ii) उन दशाओं में, जब कि आयातकर्तापैरा 3 के उप- पैरा I के खण्ड ( क ) के अनुसार सूचना देने में विफल रहा हो तो इसके पश्चात् , विहित प्रत्येक दर दो रुपये प्रति गांठ बढ़ा दी जायेगी ।
( iii ) किसी एक पोत पर किसी एक समय श्रायात की गई किसी कपास के प्रघूमन कीन्यूनतम फीस दो सौ दस रु ० होगी और ऐसी न्यूनतम फीस के उग्रर्णीय होने पर यदि एक से अधिक परिषती हों तो वह परेषितियों में उनके अपने अपने परेषण की मात्रा के अनुपात में वितरित की जाएगी ।
