SUBJECT , Import of Cars by disabled Indian Nationals .
No. 131 - ITC / PIN ) / 72 .- Attention is invited to para 1 ( iii ) of Public Notice No. 39 - ITC ( PN ) , 72 , dated 4th March , 1972 and para 3 ( 3 ) of Appendix 27 of Hand Book of Rules and Procedure ( 1972-73 ) , on the above subject .
2. The above provision has been revicwed further and it has now been decided disability devices and or controls and are thus suitably converted for use by disabled hat under this provision import of such cars only,only , as are fitted with necessary persons , will be , allowed , since the intention in allowing such imports is that the disabled applicant can use and drive the car himself without having to depend on a driver . In this connection it is clarified that import of cars with automatic transmission only which are not fitted with any disability devices controls etc. will not be allowed to be imported .
3. It has also been decided to scale down the existing monetary limit of Rs . 30,000 c.i.f. to Rs . 22,000 c.l.f. Applications for import of above types of cars from disabled persons within the revised monetary limit of Rs . 22,000 c.i.f. will be considered by the Chief Controller of Imports & Exports , New Delhi , in the enclosed application form duly supposed by documents mentioned in column 13 of this form .

Application form for an Import Trade Control Licence for a build - up Invalid car by disabled indian National permanently settled in India
1. Name of the applicant .
2. Nationality .
3. Designation/ Nature of business .
4. Full address abroad .
5. Make and model of the vehicle and full description of the specially suggested devices/ gadgets with c.i.f. value .
6. Manner in which foreign exchange will be found for purchase of vehicle .
7. If it is a gift , relationship of the donor .
8. Purpose for which the car is needed in India ( full justification to be given ) .
9. Whether applicant , his wife / husband or dependent has already imported a car , or any other vehicle into India previously. If so , give particulars of the same , mentioning import licence number and date .
10. Whether an application for import of car etc. , was made previously and if so , with what result ? CCI & E's reference should be quoted .
11. Whether a treasury receipt for the requisite amount as application fee is enclosed ? Indicate amount .
12. Proposed date of shipment of car and the port of disembarkation .
13. Documents to be enclosed to the appli- cation.
(1 ) T.R. for Rs . 50 .
( ii ) Medical certificate from the Civil Surgeon of the concerned State in India/ competent Army Medical Authority ( in case disabled officer of Indian Army ) certifying the type of physical disability of the applicant and whether the applicant would be in position to drive the car personally with the specially suggested gadgets for the car . a
( iii ) Certificate showing essentiality of the car by you from the employer / or concerned appropriate authority.
(iv) Documentary evidence of earnings i.e. employers certificate /to establish that the applicantis in a financial position to purchase / maintain the Please state whether you are still in service and if not source of income should be furnished . car .
(v) Affidavit duly sworn before a 1st Class Magistrate etc. that the applicant is permanently settled in India .
(vi) Descriptive literature of car and special devices proposed to be imported with invoice (c.i.f. value not to exceed Rs . 22,000 ) .

विषय. विकलांग भारतीय गष्ट्रिकों द्वारा कारों का आयात
संख्या 131 - आई ० टी० सी ० ( पीएन ) / 72.-- उपर्युक्त विषय पर सार्वजनिक सूचना संख्या 39- आईटीसी ( पीएन ) / 72, दिनांक 4 मार्च , 1972 के पैरा 1 ( 3 ) और नियम तथा क्रियाविधि हैंडबुक ( 1972-73 ) के परिशिष्ट 27 के पैरा 3 ( 3 ) की ओर ध्यान आकृष्ट किया जाता है ।
2. उपर्युक्त व्यवस्था की ओर पुनरीक्षा की गई है और अब यह निश्चय किया गया है कि इस व्यवस्था के अधीन केवल ऐसी कारों के श्रायात की अनुमति दी जायेगी जिन में विकलांगता के आवश्यक यंत्र औरया नियंत्रण लगे हों और जो त्रिकलांग व्यक्तियों के उपयोग के लिए अच्छी तरह परिवर्तित की गई हों , क्योंकि ऐसे आयातों की अनुमति देने का उद्देश्य यह है कि विकलांग श्रावेदक चालक पर निर्भर किए बिना स्वयं कार का उपयोग कर सकता है और चला सकता है । इस सम्बन्ध में यह स्पष्ट किया जाता है कि केवल स्वचालित संचरण वाली ऐसी कारों के आयात करने की अनुमति नही दी जाएगी जिन में कोई विकलांगता का यंत्र या नियंत्रण आदि नहीं लगा हुआ है ।
3. वर्तमान आर्थिक सीमा के मानदंड को भी 30,000/- रुपए लागत-बीमा- भाड़ा से कम करके 22,000 / -रुपए लागन-बीमाभाड़ा करने का निश्चय किया गया है । 22,000/- रुपए लागत - बीमा - भाड़ा की परिशोधित आर्थिक सीमा के भीतर विकलांग व्यक्तियों के उपर्युक्त किस्मों की कारों के आयात के लिए आवेदनपत्तों पर मुख्य नियंत्रक श्रायात- निर्यात , नई दिल्ली द्वारा विचार THE GAZETTE OF INDIA EXTRAORDINARY

किया जाएगा । उक्त आवेदनपट्न संलग्न प्रपन्न में और इस प्रपत्त्र के कालम 13 में उल्लिखित दस्तावेजों द्वारा समर्थित होने चाहिए ।
स्थायी रूप से भारत में रहने वाले विकलांग भारतीय राष्ट्रिक द्वारा तैयार अवैध कारों के आयात के लिए आयात व्यापार नियंत्रण लाइसेंस के लिये श्रावेदन प्रपत्न ।
1. आवेदक का नाम
2. राष्ट्रिकता
3. ओहदा/व्यवसाय किस प्रकार का है
4. विदेश का पूरा पता
5. वाहन का मेक और माडल तथा लागत बीमा भाड़ा के साथ विशेष रूप से सुझाये गये यत्नों मशीनों का पूरा औरा
6. वाहन खरोदने के लिये विधि जिससे विदेशो मुद्रा प्राप्त की जाएगी ।
7. यदि यह उपहार है तो उपहार देने वाले के साथ सम्बन्ध ।
8. किस प्रयोजन के लिये कार की आवश्यकता भारत में है ( पूर्ण औचित्य दिया जाना है) ।
9. क्या श्रावदक उसकी पत्नी/ पति या आश्रित ने पहले से ही अन्य कोई वाहन का आयात भारत में कर रखा है ? यदि हां तो आयात लाइसेंस की संख्या और दिनांक का उल्लेख करते हुये उसका ब्यौरा दीजिये ।
10. क्या पहले कार आदि के आयात के लिये कोई श्रवदन दिया गया था यदि हां तो उसका क्या परिणाम निकला ? मुख्य नियंत्रक आयात- निर्यात के सन्दर्भ का उल्लेख किया जाना चाहिये ।
11. क्या आवेदक- शुल्क के रूप में आवश्यक धनराशि के लिये कोई राजकोष चालान संलग्न किया गया था ? उसकी धनराशि का संकेत कीजिये
12. कार के पौतलदान करने की प्रस्तावित तारीख श्रार अवतरण-पत्तन ।
आवेदन -पत्र के साथ संलग्न किये जाने वाले प्रलेख । 13.
14. 50 रुपये के लिये राजकोष चालान
( 2) भारत में सम्बन्ध राज्य के सिविल सर्जन/ ममर्थन मेना चिकित्सक प्राधिकारी ( भारतीय सेना के विकलांग अधिकारी के मामले में ) द्वारा आवेदक की शारीरिक विकलांगत की किस्म तथा यह कि कार के लिये विशेषतय सुझायी गई मशीनों के साथ आवेदक कार को स्वयं चलाने की स्थिति में होगा इसे प्रमाणित करते हुये चिकित्सा प्रमाण-पत्र ।
( 3 ) नियोक्ता/अथवा सम्बद्ध उपयुक्त प्राधिकारी द्वारा एक प्रमाणपत्र जिसमें आपके द्वारा कार की आवश्यकता के बारे में बताया गया हो ।

( 4 ) अर्जन के दस्तावजी साक्ष्य अर्थात् नियोक्ता का प्रमाणपत्र जो यह सिद्ध करे कि आवेदक में कार को खरीदने/ रख -रखाव करने की आर्थिक क्षमता है। कृपया बतायें कि क्या आप अभी भी नोकरी कर रहें हैं और यदि नही तो आय के स्त्रोत दिये जाने चाहियें ।
(5 ) प्रथम श्रेणी मजिस्ट्रेट आदि के सम्मुख विधिवत शपथ लेते हुये एक शपथपत्त्र कि आवेदक भारत में सदा के लिये बस गया है ।
( 6 ) बोजक ( लागत - बीमा-भाड़ा मूल्य जो 22,000 रुपये से अधिक नहीं हो ) के साथ आयात की जाने वाला प्रस्तावित कार तथा विशेष यंत्रों का विवरणात्मक साहित्य ।
मै/हम एनद्वारा घोषणा करते है कि उपर्युक्त विवरण सही हैं । मुझे/हमें भलीभांति ज्ञात है कि मुझे/हमें उपर्युक्त विवरण के आधार पर कोई भी लाइसेंस स्वीकृति किया जाता है और यदि उपर्युक्त विवरण पर उसका कोई भी भाग गलत पाया जाता है तो कानून के अन्तर्गत किसी की गई अन्य कार्यवाही का पक्षपात किये बिना रद्द किया जाएगा ।
