S.O. 630 ( E ) . Whereas the Central Government is of opinion that an industria ' dispute exists between the employers in relation to the management of North . South and West Jhagrakhand Colleries . Post Office Jhagrakhand Collieries . District Surguja ( Madhya Pradesh ) and their workmen in respect of the matters specified in the Schedule hereto annexed ;
And whereas the Central Government considers it desirable to refer the said dispute for adjudication ;
Now, therefore , in exercise of the powers conferred by clause ( d ) of sub - section (1) of section 10 of the Industrial Disputes Act . 1947 (14 of 1947 ) the Central Government hereby refers the said dispute for adjudication to the Central Govern- ment Industrial Tribunal , Jabalpur , constituted under section 7A of the said Act .
SCHEDULE
1. " Whether the demand of the workmen of North , Sout hand West Jhagra- khand Collieries of Jhagrakhand Group of Collieries . Post Office Manendragarh , District Surguia (Madhya Pradesh ) that the manage- ment should not allocate the work of drawing of cables , helping of the dealers and other ancillary duties to mimers on payment of four paise per tub is justified ? It so . to what relief are the min entitied to and with effect from what date ?

का ० ग्रा ० 630 ( अ ) -यतः केन्द्रीय सरकार की राय है कि इससे उपावद्ध अनुसूची में विनिर्दिष्ट विषयों के बारे में उत्तर , दक्षिण और पश्चिम अगड़ाखण्ड कोलियरियों , डाक घर झगराखण्ड कोलियरी , जिला सुर्गुजा ( मध्य प्रदेश ) के प्रवन्ध से सम्बद्ध नियोजकों और उनके कर्मकारों के बीच एक औद्योगिक विवाद विद्यमान है ।
और यतः केन्द्रीय सरकार उक्त विवाद को न्यायनिर्णयन के लिये निर्देशित करना र्बाछनीय समझती है ।
अतः , अव , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14 ) की धारा10 की उपधारा ( 1 ) के खण्ड ( घ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये , केन्द्रीय सरकार एसद्वारा उक्त विवाद को उक्त अधिनियम की धारा 7- क के अधीन गठित केन्द्रीय सरकार औद्योगिक अधि- करण जबलपुर को न्यायनिर्णयन के लिये निर्देशित करती है ।

"क्या कोलिर्यारयों ने झगराखण्ड समूह की उत्तर, दक्षिण और पश्चिम झगराखण्ड कोलियरियों, डाकघर मनेन्द्रगढ़ , जिला सुर्गुजा ( मध्य प्रदेश ) के श्रमिकों की ये मांग की प्रबन्धकों द्वारा खनिकों को केवल ग्त्रींचने, डीलरों की सहायता करने और चार पैसे प्रति टन की दर गे अन्य अनुषंगी प्रकार के कार्य नही दिये जाने चाहिये , न्यायोचित है ? यदि हां , तो खनिक किस अनुतोष के और किरा तारीख से हकदार है ?
2. कोलियरियों के झगराखण्ड ममूह की उत्तर , दक्षिण और पश्चिम कोलिरियो डाकघर मनेन्द्रगढ़ , जिला सुर्गुजा ( मध्य प्रदेश ) के श्रमिकों की श्री नन्द लाल प्रसाद गातम लाइन मजदूर , दक्षिण झगराखण्ड कोलियरी, को कोयला मजदूरी बोर्ड की सिफारिशों के वर्ग 4 में रखने की माग न्यायोचित है ? यदि हां , तो किस तारीख से ? "

No. SO 631 ( E ) -Whereas by an order of the Government of India in the Ministı v of Labour and Rehabilitation ( Department of Labour and Employment ) 23011.37 / 72- LFII , dated the 28th September , 1972. an industrial dispute betueen the emplovers in relation to the management of North . South and Wet Thagra khand Colieries , Post Office Thagrakhan ! Colliery, District Sunghia (Madhya Pradesh ) , and their workmen has been referred to the Industrial Tribunal Jabalpur , for adjudication:

hereby prohibits the continuance of the strike in existence in the said collieries im connection with the said dispute .

का ० प्रा ० 631 ( श्र ) यतः उत्तर , दक्षिण और पश्चिम झगराखण्ड कोलियरियों , डाकघर झगराखण्ड कोलियरी, जिला मुर्गुजा ( मध्य प्रदेश ) के प्रवन्ध के सम्बद्ध नियोजकों और उनके कर्मकारों के बीच विद्यमान औद्योगिक विवाद को भारत के श्रम और पुनर्वास मंत्रालय ( श्रम और रोजगार विभाग ) के आदेश संख्या एल / 22011 / 27 / 72- एल ० आर०-2, दिनांक 28 सितम्बर, 1972 द्वारा औद्योगिक अधिकरण , जबलपुर को न्यायनिर्णयन के लिये निर्देशित किया गया है ।
अतः , अब , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) की धारा 10 की उप-धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये केन्द्रीय सरकार एतद्वारा उक्त कोलि- यरियों में उक्त विवाद से सम्बन्धित हड़ताल को जारी रखना निषिद्ध करती है ।
