ORDER
New Delhi, the 1st October 1972
G.S.R. 425 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of sec- tion 9 of the Former Secretary of State Service Officers ( Conditions of Service) Act, 1972 (59 of 1972 ) , the Central Government hereby makes the following Order , namely:-
1. (1 ) This Order may be called the Former Secretary of State Service Officers (Adaptation of Provident Fund Rules ) Order , 1972 .
(2) It shall come into force on the 1st day of October , 1972 .
2. In the All India Services ( Provident Fund) Rules , 1955 ,-
(a) in rule 2 , after clause ( g ) , the following clauses shall be inserted, namely:--
'(gg) " Indian Civil Service member of the Indian Administrative Service" means a person who was initially appointedap to the Civil Service of the Crown in India known as the Indian Civil Service and who subsequently became a member of the Indian Administrative Service:

(ggg) "Indian Police member of the Indian Police Service " means a person who was initially appointed to the Police Service of the Crown in India known as the Indian Police and who subsequently became a member of the Indian Police Service . ' ;
(b) in rule 3 , after sub - rule ( 4 ) , the following sub - rules shall be inserted namely:-
"( 3 ) In the case of an Indian Civil Service member of the Indian Administrative Service , his credit in the Indian Civil Service Provident Fund and in the Indian Civil Service ( Non - European Members ) Provi- dent Fund shall be transferred to this Fund .
(6) In the case of an Indian Police member of the Indian Police Service, his credit in the Secretary of State's Services General Provi- dent Fund shall be transferred to this Fund . " ;
(c) rule 29 shall be re - numbered as sub- rule ( 1 ) thereof , and after the sub- rule as so re - numbered , the following sub - rule shall be inserted , namely:-
"( 2) The account of each Indian Civil Service member of the Indian Administrative Service shall be credited on his retirement , or previous death , with a sum of Rs . 6,000 . " .
3. The Indian Civil Service (Provident Fund ) Rules , 1943 , the Indian Civil Service ( Non -European Members ) Provident Fund Rules , 1943 and the Secretary of State's Services ( General Provident Fund ) Rules , 1943 are hereby repealed .
4. The provisions of section 6 of the General Clauses Act, 1897 (10 of 1897) shall apply to the repeal effected by rule 3 as if such repeal were a repeal of an enactment by a Central Act .

जी० एस ० श्रार ० 425 (भ) .- भूतपूर्व सैक्रेटरी ग्राफ स्टेट सेवा अधिकारी ( सेषा की शत ) अधिनियम , 1972 ( 1972 का 59) की धारा 9 की उप धारा ( 1 ) द्वारा प्रवत्त शक्तिबों का प्रयोग करते हुए केन्द्रीय सरकार , एतद्वारा निम्नलिखित आदेश बनाती है, अर्थात्:--
1. ( 1 ) यह आदेश भूतपूर्व सैक्रेटरी आफ स्टेट सेवा अधिकारी (भविष्य निधि प्रनुकूलन निषम) श्रादेश, 1972 कहा जा सकेगा ।
(2) यह 1 अक्टूबर , 1972 से लागू होगा ।
2. अखिल भारतीय सेवाएं (भविष्य निधि ) नियमावली , 1955 में, --
(क) नियम 2 में, खण्ड ( ४ ) के बाद निम्नलिखित खण्ड ओड़ दिये जाएंगे , अर्थात्:--
"(छछ) भारतीय प्रशासन सेवा के भारतीय सिविल सेवा सदस्य से अभिप्राय ऐसे व्यक्ति से है, जो आरम्भ में इंडियन सिविल सर्विस के नाम से विख्यात THE GAZETTE OF DIA EXTRAORDINARY

नाज ( आउन) की सिविल सेवा में नियुक्त किया गया हो भौर जो बाद में भारतीय प्रशासन सेत्रा का सदस्य बन गया हो
(छछछ) " भारतीय पुलिस सेवा के भारतीय पुलिस सदस्य से अभिप्राय ऐसे व्यक्ति में है जो आरम्भ में इंडियन पुलिस के नाम से विख्यात भारत में ताज (क्राउन) को पुलिस सेवा में नियुक्त किया गया हो और जो बाद में भारतीय पुलिस मेवा का सदस्य बन गया हो ।
(ख) नियम 3 में , उपनियम ( 4 ) के बाद निम्नलिखित उपनियम जोड़ा जाएगा , श्रर्थात्:-
" ( 5 ) भारतीय प्रशासन सेवा के किसी भारतीय सिविल सेवा सदस्य के मामले में भारतीय सिविल सेवा भविष्य निधि और भारतीय सिविल सेवा ( गैर यूरो- पियन सदस्य) भविष्य निधि में उसकी जमा राशि इस निधि में स्थानान्तरित्त कर दी जाएगी ।।
( 6) भारतीय पुलिस सेवा के किसी भारतीय पुलिस सदस्य के मामले में , संक्रेटरी आफ स्टेट सेवाएं सामान्य भविष्य विधि में उसकी जमा राशि इस निधि में स्थानान्तरित कर दी जाएगी ' ,
(ग) नियम 29 की संख्या को बदलकर उसका उप नियम ( 1 ) कर दिया जाएगा और, इस प्रकार उपनियम के रूप में बदली गई संख्या के बाद निम्नलिखित उपनियम जोड़ा जाएगा , अर्थात्:-
( 2) भारतोय प्रशासन सेवा को भारतीय सिविल सेवा के प्रत्येक सदस्य के लेखे में उसकी सेवा निवृत्ति श्रथवा पहले मृत्यु होने , पर 6000/ - ६० की राशि जमा में डाल दी जाएगी ।
3. भारतीय सिविल सेवा ( भविष्य निधि ) नियमावली, 1943 , भारतीय सिविल सेवा (गैर-यूरोपीय सदस्य ) भविष्य निधि नियमावली , 1943 तथा संक्रेटरी आफ स्टेट सेवाएं ( सामान्य भविष्य निधि) नियमावली, 1943 को एतद्वारा निरस्त किया जाता है ।
4. साधारण खण्ड अधिनियम , 1897 ( 1897 का 10) की धारा 6 के उपबन्ध , नियम 3 द्वारा प्रभावी किये गये निरसन पर इस प्रकार लागू होंगे मानों ऐसा निरसन किसी केन्द्रीय श्रधिनियम द्वारा किये गये किसी अधिनियम का निरसन हो ।
