ORDER
New Delhi , the 5th October , 1972
S.O.639 ( Ε) .-Whereas the Central Government has , by its notified order in the Ministry of Industrial Development and Internal Trade , No. S.O. 1482 , dated 31st March , 1971 , issued under clause (b ) of sub - section ( 1 ) of section 18 A of the Industries ( Development and Regula- tion) Act , 1951 (65 of 1951 ) , authorised the Board of Management consisting of Sarva Shri R.V. Susrahmanian and S.K. Mostra to take over the management of the Industrial undertaking known as Messrs Gresham and Craven of India ( Private ) Limited , Calcutta ( hereafter in this order referred to as the industrial undertaking) for the period specified therein ;
Now, therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18 - E of the said Act , the Central Government hereby specifies in the Schedule annexed here to the exccp- tions , " estrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956 ) , shall continue to apply to the industrial undertaking in the same manner as it applied there to before the 13 of the sul notied order under section 18 -A .

THE SCHEDULI
Provisions of the companies Act , 1956 Exceptions , restrictions and limitations subject to which the provisions ment'ond in column ( 1 ) shall apply to the undertaking

The provisions of this sub- section shall not apply to the industrial undertaking .

नई दिल्ली, 5 अक्टूबर , 1972
का० श्र ०639 ( प्र) . यतः केन्द्रीय सरकार ने औद्योगिक विकास और आन्तरिक व्यापार मत्रालय में अपने अधिसूचित आदेश सं ० का ० आ ० 1482, तारीख 31 मार्च, 1971 द्वारा जिये उद्योग (विकाम तथा विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 -क की उपधारा ( 1 ) दो खण्ड ( ख ) के अधीन जारी किया गया है मैसर्स ग्रेशम एण्ड क्रेवेन श्रफ इण्डिया (प्राइवेट ) लिमिटेड , कलकत्ता ( जिसे इस आदेश में इसके पश्वात् औद्योगिक उपक्रम कहा गया है ) नामक श्रौद्योगिक उपक्रम का प्रवन्ध , प्रबन्धक -बोर्ड को, जिसमें सर्वश्री आर ० बी० सुब्रह्मण्यम और एस ० के० मैत्रा हैं उनमें विनिर्दिष्ट की गई कालावधि तक के लिए ग्रहण करने के लिए प्राधिकृत किया है ;
श्रतः, अब, उक्त अधिनियम की धारा 18-ङ की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए. केन्द्रीय सरकार एतद्वारा इपसे उपाबद्ध अनुसूची में उन अपवादों, निर्वन्धनां और परिसीमाओं को विनिर्दिष्ट करती है जिनके अधीन कंपनी अधिनियम , 1956 ( 1956- का 1 ) औद्योगिक उपक्रम को उसी प्रकार लागू बना रहेगा जिस प्रकार वह धारा 18- के अधीन उक्त अधिसूचित आदेश के जारी होने से पहले उसे लागू होता था ।

इस धारा के उप बन्ध औद्योगिक उपक्रम में लागू नहीं होंगे ।
इस उपधारा के उपबन्ध श्रौद्योगिक उपक्रम में लागू वारा 210 ( 1)
नहीं होंगे ।
