ORDER
New Delhi , the 9th October 1972
S.O. 649 ( E ) /18A/IDRA/72.-Whereas the Central Government is of the opinion that Luxminarayan Cotton Mills Limited , Rishra ( District Hooghly ) , an industrial undertaking in respect of which an investigation has been made under section 15 of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) , is being managed in a manner highly detrimental to public interest;
Now, therefore , in exercise of the powers conferred by section 18A of the said Act , the Central Government hereby authorises the following body of persons:-
Chairman
1. Shri A. Bose , Special Officer and ex - officio Secretary to the Government of West Bengal , Department of Closed and Sick Industries , Calcutta-
2. Shri D. K. Banerjee , W.B.C.S. ( Executive )-Member and Chief Executive Officer.
Member
3. Shri M. M. Sanyal , Commercial Accountant , Directorate of Labour , West Bengal-Member .

(hereinafter referred to as the authorised body of persons ) to take over management of the whole of the said undertaking , namely , Luxminarayan Cottc Mills Limited Rishra , subject to the following terms and conditions , namely:-
( i) the authorised body of persons shall comply with all directions issue from time to time by the Central Government;
(ii ) the authorised body of persons shall hold office for five years from the date of publication of this order in the Official Gazette;
(iii ) the Central Government may terminate the appointment of the authorised body of persons earlier , if it considersit necessary to do so .
2. This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette .

का०ग्रा ० 649 ( प्र ) / 18 ए/ आई डी भ्रार ए / 72.--यतः केन्द्रीय सरकार की राय है कि लक्ष्मी- नारायण काटन मिल्स लिमिटेड, रिश्रा ( जिला हुगली ) , श्रौद्योगिक उपक्रम का , जिसकी बाबत उद्योग (विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 15 के अधीन श्रन्वेषण किया जा चुका है , प्रबन्ध इस रीति से किया जा रहा है कि लोकहित में अति अहितकर है :
अतः अब , उक्त अधिनियम की धारा 18 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , निम्नलिखित व्यक्तियों,

1. श्री ए ० बोस, विशेष अधिकारी और पदेन सचिव पश्चिम बंगाल सरकार , बंद और अव्यवस्थित उद्योग विभाग , कलकत्ता--
2. श्री डी० के ० बनर्जी,

के निकाय को ( जिसे इसमें उसके पश्चात प्राधिकृत व्यक्तियों का निकाय कहा गया है ) उक्त उपक्रम अर्थात् लक्ष्मीनारायण काटन मिल्म लिमिटेड , रिश्रा का पूर्ण प्रबन्ध निम्नलिखित निबन्धनों और शतों के अधीन रहते हुए ग्रहण करने के लिये एतद्वारा प्राधिकृत करती है , अर्थात्:--
( 1 ) प्राधिकृत व्यक्तियों का निकाय केन्द्रीय सरकार द्वारा समय समय पर निकाले गये सभी निदेशों का पालन करेगा ;
( 2) प्राधिकृत व्यक्तियों का निकाय राजपत्र में इस आदेश के प्रकाशन की तारीख से 5 वर्ष के लिये पदासीन रहेगा ;
( 3 ) केन्द्रीय सरकार, प्राधिकृत व्यक्तियों के निकाय की नियुक्ति यदि, वह ऐसा करना श्रावश्यक समझे तो , पहले ही समाप्त कर सकेगी ।
2. यह आदेश राजपत्र में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिये प्रभावी होगा ।
