ORDER

New Delhi, the 9th October 1972

G.S.R. 431 (E),—In exercise of the powers conferred by article 263 of the Con- stitution, the President hereby makes the following modifications in the Order of the Government of India in the Ministry of Finance (Department of Revenue and Insurance) No. G.S.R. 238. dated the 1st February, 1968: —

1. In the preamble to the said Order,—

(i) after the words "sales tax", in both the places where they occur, the words "and State excise duties" shall be inserted;

(it) for the words "that subject", the words "those subjects" shall be sub- stituted.

2. In paragraph 1 of the said Order,—

(1) in sub-paragraph (1), for clauses (a), (b) and (c), the following clauses shall be substituted, namely:—

"(a) the Northern Zone, comprising the Stales of Haryana, Himachal Pradesh, Jammu and Kashmir, Punjab, Rajasthan and Uttar Pradesh and the Union Territories of Chandigarh and Delhi;

(b) the Eastern Zone, comprising the States of Assam, Bihar, ManipiSr, Meghalaya, Nagaland, Orissa, Tripura and West Bengal and the Union Territories of Arunachal Pradesh and Mizoram;

(c) the Western Zone, comprising the States of Gujarat, Maharasht" "' tind Madhya Pradesh and the Union Territories of Dadra and Nagv- Huveli and Goa, Daman and Diu;";

(2) for sub-parayraph (2), the following sub-paragraph shall be substituted-

namely:—

"(2) Ca) The Regional Council for each Zone shall consist of,—

(1) the Secretary for the time being in charge of sales tax and StaJ excise duties, or where different Secretaries are in charge c sales-tax and State excise duties, each of those Secretaries in each of the States or Union territories concerned;

(ii) the Commissioner or Commissioners of sales-tax and State excise duties, or where theer are diilerent Commissioners for sales-tax and State excise duties, each of those Commissioners, or where there is no such Commissioner or Commissioners, the head or heads of the sales-tax and excise department or departments, in each of the States or Union territories concerned;

(iil) the Director or Directors and the Deputy Secretary or Deputy Secretaries to the Government of India, in the Ministry of Finance, who are foe the time being in charge of both or either of the subjects of sales-tax and Medicinal and Toiet Prepara- tions (Excise Duties) Act, 1955;

(h) the Deputy Secretary to the Governmant of India in the Ministry of Home Affairs who is for the time being in charge of the Union territory of Delhi shall, in additional to the members referred to in clause (a), be a member of the Regional Council for the Northern Zone.";

(3) in suh-paragraph (7), after the word "sales-tax"j the words "or State

excise duties or both" shall be inserted;

(4) in sub-paragraph (10), after the word "sales-tax", wherever it occurs, the words "or State excise duties or both" shall be Inserted; (5) In sub-paragraph (11), for the words and brackets "the Deputy Secre- tary to the Government of India, in the Ministry of Finance (who is, tor the time being, in charge of sales-tax)", the words "the officer, or as Ihe case may be, the senior most officer of the Ministry of Finance who is for the time being a member of the Regional Councils" shai be substituted.

3. In paragraph 2 ct the said Order, after the brackets and words "(including Central Sales-tax)", the words "and State excise duties" shall be inserted.

4. In paragraph 4 of the said Order,—

(1) for sub-paragraph (1), the following sub-paragraph shall be substituted,

namely:—

"(1) Where two or more Regional Councils, agree to have point meeting oi surn Councils, or where the officer, or as the case may be, the senior most officer oi the Ministry of Finance who ia for the time being a member of the Regional Councils, considers that it Is neces- sary to hold such a meeting, a joint meeting of such Councils shall be convened by such officer.";

(2) in sub-paragraphs (2) and (3), for the words "Deputy Secretary afo' said", the words "the Officer, or as the case may be, the senior mi... officer aforesaid" shall be substituted.
