ORDER
New Delhi , the 18th October 1972
G.S.R. 445 ( E ) . In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) . the Central Government hereby makes the following Order further to amend the Rajasthan Foodgrains ( Restrictions on Border Movement ) Order , 1959 , namely : -
1. (1 ) This Order may be called the Rajasthan Foodgrains ( Restrictions on Border Movement) Amendment Order . 1972 .
( 2 ) It shall come into force at once .
2. In the Rajasthan Foodgrains ( Restrictions on Border Movement ) Order , 1959- ( a ) for sub - clause ( vii ) , of clause 5. the following sub - clauses shall be substituted , namely : -
" ( vii ) where the transport is of gift rice received under the Indo -US- Agreement on Relief Supplies , 1968 ; or

(vill) by or on behalf of the Food Corporation of India, established under section 3 of the Food Corporations Act , 1964 ( 37 of 1964 ) . " ;
(b) in clause 6 ,
( 1 ) in sub-clause ( 1 ) for the words " any other person " the words " any other officer of the Revenue Department not below the rank of a Nalb Tehsildar or of the Food and Supplies Department not below the rank of an Enforcement Inspector , " shall be substituted ;
( ii ) in item ( i ) of sub - clause ( 1 ) the words " or authorise any person to stop and search " shall be omitted ;
(ifi ) in item ( il ) of sub - clause ( 1 ) the words " or authorise any person to enter and search" shall be omitted;
( iv) in item ( 111 ) of sub -clause ( 1 ) the words " or authorise the seizure of " and the words " or authorise the taking of " shall be omitted .

नई दिल्ली, 18 अक्टूबर , 1972
मा० का ० ति० 445 ( श्र ):-आवश्यक वस्तु अधिनियम , 1955 ( 1955 को 10) की धारा 3 द्वारा प्रदस शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, राजस्थान खाद्यान ( सीमा-संचलन पर निर्बन्धन ) श्रादेश , 1959 में और संशोधन करने के लिए एतद्वारा निम्नलिखित श्रादेश बनाती है , अर्थात्: -
1. ( 1 ) इस आदेश का नाम राजस्थान खाद्यान ( मीमा -संचलन पर निर्बन्धन ) संशोधन प्रादेश , 1972 होगा ।
( 2) यह तुरन्त प्रवृत्त होगा ।
2. राजस्थान खाद्यान्न ( सीमा - संचलन पर निर्बन्धन) आदेश 1959 में--
(क) खण्ड 5 के उपखण्ड ( vii ) के स्थान पर निम्नलिखित उपखण्ड रखे जाएंगे , अर्थात्: --
" ( VII ) जहां परिवहन सहायता प्रदाय , पर भारत - अमेरिका-करार 1968 के अधीन प्राप्त दान स्वरूप चावल का है; या
( VIII ) खाद्य निगम अधिनियम , 1964 ( 1964 का 37 ) की धारा 3 के अधीन स्थापित भारतीय खाद्य निगम द्वारा या की ओर मे है । " ;
(ख) खंड 6 में,
( i) उपखण्ड ( 1 ) में , "कोई अन्य व्यक्ति" शब्दों के स्थान पर " राजस्व विभाग का कोई अन्य अधिकारी, जो नायब तहसीलदार की पंक्ति से निम्न पंक्ति का THE GAZETTE OF INDIA EXTRAORDINARY

न हो या खाद्य और प्रदाय विभाग का कोई अन्य अधिकारी, जो प्रवर्तन निरीक्षक की पंक्तिसे निम्न पंक्ति का न हो, " शब्द रखे जाएंगे ;
( ii) उपखण्ड ( 1 ) की मद ( 1 ) में " या किसी व्यक्ति को रोकने और तलाशी लेने के लिए प्राधिकृत कर सकेगा" शब्द लुप्त किए जाएंगे ;
( iii ) उपखण्ड ( 1 ) की मद ( ii ) में "या किसी व्यक्ति को प्रवेण करने और तलाशी लेने के लिए प्राधिकृत कर सकेगा " शब्द लुप्त किए जाएंगे ;
( iv ) उपखण्ड ( 1 ) की मद ( iii ) में , " या श्रभिग्रहण के लिए प्राधिकृत कर सकेगा " तथा " या करने के लिए प्राधिकृत कर सकेगा " शब्द लुप्त किए जाएंगे ।
