S.O. 674 ( E ) .- Whereas the Central Government is of opinion that an industrial dispute exists between the employers in relation to the management of Pyrites Phosphates and Chemicals Limited , Amjhore Mining Project , District Shahabad (Bihar) and their workmen in respect of the matters specified in the Schedule hereto annexed ;
And whereas the Central Government considers it desirable to refer the said dispute for adjudication
Now, therefore , in exercise of the powers conferred by clause ( d ) of sub- section ( 1 ) of section 10 of the Industrial Disputes Act , 1947 ( 14 of 1947 ) , the Central Government hereby refers the said dispute for adjudication to the Central Government Industrial Tribunal ( No. 2) , Dhanbad constituted under section 7A of the said Act .

Whether the demand of the Pyrites Phosphates and Chemicals Staff Associa- tion , Post Office Amjhore , District Shahabad , that the Salary of the technical staff of the Pyrites Phosphates and Chemicals Limited , Amjhore Mining Project, District Shahabad in the pay scales as per the Arbitration Award of Shri Sarjoo

Prasad Singh should be fixed on the basis of one increment for each completed year of service or as per the principles of fixation of pay as recommended by the Second Pay Commission for the Central Government employees , is justified? If not , what should be the principle of pay fixation of the aforesaid category of workmen?

का०प्रा० 674( प्र) . यतः केन्द्रीय सरकार की राय है कि इससे उपाबद्ध अनुसूची में विनिर्दिट विषयों के बारे में पाइराइट्स फौसफेट्स एण्ड केमिकल्स लिमिडेड , अमझोर मानिंग प्रोजेक्ट , जिला शाहबाद ( बिहार ) के प्रबंध से संबंध नियोजकों और उनके कर्मकारों के बीच एक श्रौद्योगिक विवाद विद्यमान है ;
और यतः , केन्द्रीय सरकार उक्त विवाद को न्यायनिर्णयन के लिए निर्देशित करना बांछनीय समझती है ;
अतः अब , प्रौद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14) की धारा 10 की उपधारा ( 1 ) के खण्ड ( घ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्तः विवाद को उक्त अधिनियम की धारा 7 क के अधीन गठित केन्द्रीय सरकार प्रौद्योगिक श्रधिकरणः ( संख्या 2 ) , धनवाद को न्यायनिणयन के लिए निर्देशित करती है ।

"क्या पाइराइट्स फौसफेट्स और केमिकल्स स्टाफ एसोसिएशन , डाकघर अमझोर , जिला शाहबाद की यह मांग कि श्री सुरजू प्रसाद सिंह के विवाचन पंचाट के अनुसार वेतन - क्रमों में पाइराइट्स फोसफेट्स एण्ड केमिकल्स लिमिटेड , अमझोर माइनिंग प्रोजेक्ट, जिला शाहबाद के तकनीकी कर्मचारियों का वेतन सेवा के प्रत्येक पूर्ण वर्ग के लिए एक वेतन वद्धि के आधार पर अथवा केन्द्रीय सरकार के कर्मचारियों संबंधी दूसरे वेतन आयोग द्वारा सिफारिश किये गए वेतन निर्धारण सिद्धान्तों के अनुसार निश्चित किया जाना चाहिए , न्यायोचित है ? यदि नहीं, तो श्रमिकों के उपर्युक्त वग के लिए वेतन निर्धारण का कौनसा सिद्धान्त होना चाहिए ?

Whereas by an order of the Government of India in' the Ministry of Labour and Rehabilitation ( Department of Labour and Employment ) No. L 29011 / 62 / 72 - LR.IV ( i ) dated the 20th October , 1972 , an industrial dispute bet- ween the employers in relation to the management of Pyrites Phosphates and Chemicals Limited , Amjhore Mining Project , District Shahabad ( Bihar ) and their workmen has been referred to the Presiding Officer , Central Government Industrial Tribunal ( No. 2 ) , Dhanbad , for adjudication ;
Now, therefore , in exercise of the powers conferred by sub - section ( 3 ) of section 10 of the Industrial Disputes Act, 1947 ( 14 of 1947 ) , the Central Govern- ment hereby prohibits the contſtnuance of the strike in existence in the said establishment in connection with the said dispute .

का० ग्रा० 675 ( प्र) यतः पाइराइट्स फौसफेट्स एण्ड केमिकल्स लि० अमनौर मानिंग प्रोजेक्ट, जिला शाहबाद ( बिहार ) के प्रबंधतन्त्र से संबंध नियोजकों और उनके कर्मकारों के बीच विद्यमान औद्योगिक विवाद को भारत सरकार के श्रम और पुनर्वास मंत्रालय ( श्रम और रोजगार विभाग ) के आदेश संख्या एल 29011/ 62/ 72-एल ० श्रार०-4 ( j ) दिनांक 20 अक्तूबर , 1972 द्वारा पीठासीन अधिकारी , औद्योगिक श्रधिकरण ( संख्या 2 ) धनबाद को न्यायनिर्णयन के लिए निर्देशित किया गया है ;
अतः अत्र , औद्योगिक विवाद अधिनियम , 1947 ( 1947 का 14 ) की धारा 10 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा उक्त प्रतिष्ठान में उक्त विवाद से संबंधित विद्यमान हड़ताल को जारी रखना , निषिद्ध करती है ।
