New Delhi , the 2nd November 1972
S.O. 688 ( E ) / 18AA / IDRA/ 72 .-Whereas the Central Government is satisfied from the documentary evidence in its possession in relation to the Refractory Plant near Ramgarh , in Hazaribagh district in the State of Bihar , owned by Messrs Assam Sillimanite Limited , a Company registered under the Companies Act , 1956 ( 1 of 1956 ) having its registered office at Gauhati , and principal office at 25 , Ganesh Chandra Avenue , Calcutta , that-
( i) it has been closed for a period of not less than 3 months ; and
( ti ) that such closure is prejudicial to the refractory industry , and the financial condition of the said company and the condition of the plant and machinery of the said Refractory Plant are such thatit is possible to restart the said Refractory Plant and such restartingis necessary in the interests of the general public ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 18AA of the Industries (Development and Regulation ) Act, 1951 ( 65 of 1931 ) , the Central Government hereby authorises Messrs Hindustan Steel Limited , a Govern- nent Company registered under the Companies Act , 1956 ( 1 of 1956 ) and having its

registered office at Ranchi in the State of Bihar ( hereinafter referred to as ' the authorised person' ) to take over the management of the said Refractory Plant of Messrs Assam Sillimanite Limited situated near . Ramgarh in Hazaribagh District in the State of Bihar , subject to the following terms and conditions , namely : - ( i ) the authorised person shall comply with all directions issued from time to time by the Central Government ;
( ii ) the authorised person shall hold office for a period of three years from the date of publication of this order in the official Gazette , and
( ili ) the Central Government may terminate the appointment of the authorised person earlier , if it considers it necessary to do so .
2. This order shall have effect for a period of three years commencing from the date of its publication in the official gazette .

का० प्रा० 688 ( प्र ) / 18 कक/ आई ० डी० आर ० ५०/72.--यतः गोहाटी में रजिस्ट्रीकृत कार्यालय तथा 25 - गणेशचन्द्रएवेन्यू, कलकत्ता में प्रधान कार्यालय वाली मैसर्स आसाम सिलीमेनाइट लिमिटेड नामक कम्पनी के, जो कम्पनी अधिनियम, 1956 ( 1956 का 1 ) के अधीन रजिस्ट्रीकृत कम्पनी है , स्वामित्व के, बिहार राज्य के हजारी बाग जिले में रामनगर के निकट स्थित तापसह संयंत्र के संबंध में केन्द्रीय सरकार का अपने पास के दस्तावेजी साक्ष्य से समाधान हो गया है कि
( 1) यह संयंत्तं कम से कम तीन महीने से बन्द पड़ा है , तथा
( 2 ) उसके इस प्रकार बन्द होने से तापसह उद्योग भर प्रतिकूल प्रभाव पड़ता है और उक्त कम्पनी की वित्तीय स्थिति तथा उक्त तापसह संयंत्र के प्लांट तथा मशीनरी की हालत ऐसी है कि उक्त तापसह संयंत्र को पुनः चालू करना संभव है और उसे इस प्रकार पुनः चालू करना जनसाधारण के हित में आवश्यक है ;
अप्तः , अब , उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65) की धारा 18 कक की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा मैसर्स हिन्दुस्तान स्टील लिमिटेड नामक सरकारी कम्पनी को, जो कम्पनी अधिनियम , 1956 ( 1956 का 1 ) के अधीन रजिस्ट्रीकृत है और जिसका रजिस्ट्रीकृत कार्यालय बिहार राज्य में रांची में है (जिस कम्पनी को इसमें इसके पश्चात् 'प्राधिकृत व्यक्ति' कहा गया है ) प्राधिकृत करती है कि बिहार राज्य के हजारी बाग जिले में रामगढ़ के निकट स्थित उक्त मैसर्स श्रासम सिलिमेंनाइट लिमिटेड के तापसह संयंत्र क प्रबन्ध अपने अधिकार में निम्नलिखित शर्तों पर ले , अर्थात्:-
( 1 ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए सभी निदेशों का पालन करेगा ;
( 2 ) प्राधिकृत व्यक्ति इस आदेश के राजपत्त्र में प्रकाशन की तारीख से तीन वर्ष की अवधि के लिए पद धारण करेगा; और THE GAZETTE OF INDIA EXTRAORDINARY

( 3 ) यदि केन्द्रीय सरकार ऐसा करना आवश्यक समझे , तो वह प्राधिकृत व्यक्ति की नियुक्ति को उससे पूर्व भी समाप्त कर सकेगी ।
2. यह आदेश राजपत्त्र में प्रकाशन की तारीख से आरम्भ होने वाली तीन वर्ष की अवधि पर्यंत प्रभावी रहेगा ।
