ORDER
New Delhi , the 27th November 1972
No. 726 ( E ) / 18FB / IDRA / 72 . Whereas in exercise of the powers conferred by section 18AA of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government , by its order No. S.O. 695 ( E ) / 18AA / IDRA / 72 , dated the 3rd November , 1972 authorised the Industrial Reconstruction Corporation of India Limited , CalcuCalculta ( hereinafter referred to as the Authorised Controller )Controller ) to take over the management of Messrs Ganesh Flour Mills Company Limited ( hereinafter referred to as the said undertaking ) ;
And whereas , the Authorised Controller has taken over the management of the said undertaking on the 4th November , 1972 ;
And whereas the Central Government is satisfied that it is necessary , so to do in the interests of the general public with a view to preventing fall in the volume of production of the following scheduled industries , namely vanaspati , solvent- extracted oils , processed foods and electrical fans ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 18FB of the said Act , the Central Government hereby declares that-
( a) the enactments , or portions thereof , as the case may be , specified in the Schedule to this order shall not apply to the said industrial undertaking , and

(b) the operation of all contracts , assurances of property, agreements , settle- ments , awards , standing orders or other instruments in force ( other than those relating to secured liabilities to banks and financial insti- tutions ) , to which the said undertakingis a party or which may be applicable to it immediately before the date of publication of this order in the Official Gazette , and all the rights , privileges , obligations and liabilities accruing or arising thereunder before the said date, shall remain suspended .
2. This order shall remain in force for a period of one year commencing from the date of its publication in the Official Gazette .

आदेश
नई दिल्ली, 27 नवम्बर, 1972
का० श्रा ० 726 ( अ ) / 18 एफ बी०/आई ० डी० आर ० ए ०/ 72.-यतः केन्द्रीय सरकार ने उद्योग ( विकास तथा विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 क के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए अपने आदेश सं ० का ० आ० 695 (६० )/ 18 ए ए/श्राई ० डी० आर ० ए ० / 72 , तारीख 3 नवम्बर , 1972 द्वारा भारत के औद्योगिक पुनर्गठन निगम लिमिटेड, कलकत्ता ( जिसे इसमें इसके पश्चात् प्राधिकृत नियंत्रक कहा गया है ) को मैसर्स गणेश फ्लोर मिल्स कम्पनी लिमिटेड ( जिसे इसमें इसके पश्चात् उक्त उपक्रम कहा गया है ) का प्रबन्ध ले लेने को प्राधिकृत किया था;
है; और यतः प्राधिकृत नियंत्रक ने उक्त उपक्रम का प्रबन्ध 4 नवम्बर , 1972 को संभाल लिया
और यतः केन्द्रीय सरकार का समाधान हो गया है कि निम्नलिखित अनुसूचित उद्योग में , अर्थात् बनस्पति , बिलायक निस्सारण तेल , तैयार खाद्य और बिजली के पंखे , उत्पादन की मात्रा को कम होने से रोकने की दृष्टि से सर्वसाधारण के हित में ऐसा करना आवश्यकता है ;
अतः अब उक्त अधिनियम की धारा 18चख की उपधारा ( 1 ) द्वारा प्रवत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा घोषित करती है कि-
(क ) इस आदेश की अनुसूची में विनिर्दिष्ट, यथास्थिति , अधिनियमितियां या उनका कोई भाग उक्त औद्योगिक उपक्रम को लागू नहीं होगा , और
(ख ) सभी प्रवृत संविदाओं , संपत्ति का हस्तान्तरणपत्रों, करारों , समझौतों, पंचाटों, स्थायी श्रादेशों या अन्य लिखतों ( बैंकों को और वित्तीय संस्थानों को प्रतिभूत दायित्व से संबंधित को छोड़कर ) , जिनमें उक्त श्रऔद्योगिक उपक्रम पक्षकार है या THE GAZETTE OF INDIA EXTRAORDINARY

जो इस आदेश के राजपत्र में प्रकाशन की तारीख से ठीक पूर्व लागू होती हों, का प्रवर्तन और सभी अधिकार, विशेषाधिकार , बाध्यताएं और दायित्व को उक्त तारीख से पहले तधीन प्रोभूत या उद्भूत हुए हों निलम्बित रहेंगे ।
2. यह आदेश राजपत्र में प्रकाशन की तारीख से प्रारम्भ होकर एक वर्ष की अवधि के लिए प्रवृत रहेगा ।

1. औद्योगिक नियोजन ( स्थायी आदेश ) अधिनियम, 1946 ।
2. औद्योगिक विवाद अधिनियम , 1947 के निम्नलिखित अध्याय और धाराएं , अर्थात्- ( 1) अध्याय 5 क ।
