S.O. 731 ( E ) .- Whereas the Central Government has , by its notified order in the late Ministry of Industrial Development and Internal Trade , No. S.O. 1027 dated the 6th March , 1971 issued under clause (b ) sub - section ( 1 ) of section 18 - A of the Industries (Development and Regu- lation ) Act , 1951 ( 65 of 1951 ) authorised the Board of Management consisting of Sarva Shri R. V. Subramanian , M. Dhar and M. N. Datta 10 take over the management of the industrialundertaking known as M / s . Braithwaite and Company ( India ) Limited , Calcutta ( hereafter in this order ref- erred to as the industrial undertaking ) for the period specified therem ;
Now , therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18 - E of the said Act , and in continuation ofthe order of the Government of India in the Ministry of Industrial Development No. S.O. 108 ( E ) dated the 5th February , 1972 , the Central Government hereby specifies in the Schedule annexed hereto the exceptions , restrictions and lim tations subject to which the Companies Act , 1956 ( 1 of 1956 ) , shall continue to apply to the industrial undertaking inthe same manner as it applied thereto before the issue of the said notified order under section 18 -A .

Provisions of the Companies Act , 1956
Exceptions , restrictions and limitations subject to which the provisions mentioned in column ( I ) shall apply to the undertaking .

The provisions of this section shall not apply to the industrial undertaking .
Section 225 :
The provisions of this section shall not apply tothe industrial undertaking .

का ० आ ० 731 ( श्र ) -यतः केन्द्रीय सरकार ने भूनपूर्व औद्योगिक विकास तथा आन्तरिक, व्यापार मन्त्रालय में , उद्योग ( विकास तथा विनियमन ) अधिनियम , 1951 ( 1951 का 65) की धारा 18- क की उपधारा ( 1 ) के खण्ड ( ख ) के अन्र्तगत जारी किए गए अपने अधि- मुचित आदेश सं ० का ० आ ० 1027 तारीख 6 मार्च 1971 द्वारा सर्व श्री आर ० धो ० सुग्रामनियंन एस ०धर नवा एम ० एन ० दन्त से मिलकर बने प्रबन्धक बोर्ड मैपर्स ब्रेथवेट एड कम्पनी (इंडिया ) लिमिटेड , कनकत्ता, ( जिसे इम आदेश में इसके पश्चात् औद्योगिक उपक्रम कहा गया है नामक औद्योगिक उपक्रम का प्रबन्ध उसमें विनिर्दिष्ट अवधि तक ग्रहण करने के लिए प्राधिकृत किया था:
श्रतः अब उक्त अधिनियम की धारा 18- ई की उप-धारा ( 2 ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए और भारत सरकार के ओद्योगिक विकास मन्त्रालय के आदेश सं ० का ० श्रा 108 ( ई ) नारीख 5 फरवरी 1972 के क्रम में केंद्रीय सरकार एतद्वारा इससे उपाबद्ध अनुसूची में के उन अनवादों, निर्बन्धनों ओर सीमाओं को विदिष्ट करती है जिनके अधीन रहते हुए कम्पनी अधिनियम 1956 (1956 का 1 ) औद्योगिक उपक्रम को उसी रीति में लागू रखेंगा जिस प्रकार वे धारा 18 - क के आधीन उक्त अधिसूचित आदेश के जारी होने से पहले उसे लागू होता था:-- THE GAZETTE OF INDIA EXTRAORDINARY

कम्पनी अधिनियम 1956 के उपबन्ध
अपवाद, निर्बन्धन तथा सीमाएं जिनके अधीन रहने हुए स्तम्भ ( 1 ) में उल्लिखित उपवध उपक्रम को लागू होंगे

इम धारा के उपबन्ध श्रौद्योगिक उपक्रम को लागू नहीं होंगे

इस धारा के उपबन्ध्र औद्योगिक उपक्रम को लागू नहीं
