SUBJECT Supply of imported steel for export production during April 1972 - March 1973- Issue of Release Orders for steel items for executing anticipated export orders
No. 179 - ITC ( PN ) / 72 -- Attention is invited to the Ministry of Foreign Trade Public Notice No 56 - ITC ( PN ) / 72 , dated the 18th April , 1972 , in terms of which the registered exporters are being supplied imported steel for the execution of export orders , held by then and tor which the requusite quantum of indigenous steel is not available .
2. With a view to enable the manufacturer exporters to accept overseas orders 101 delivery at short term notice , it has been decided to entertain applications from such registered exporters who are having a minimumminimum annual exportnnual export performance of more than Rs 10 lakhs ( fob ) in value during April 1971 - March 1972 or as on 31st October , 1972 during April , 1972 - September , 1972. for the grant of re'ease orders on the Hindustan Steel Limited as exporters ' buffer stocks for the followi g categories of steel items-

The value of relt ase orders to be issued in ternis of this Pubhe Notice will not exceed Re ten jakhs for any individual exporter , eligible under this Public Notice and will be fully adjustedjusted against future expoxports within 18 months of the date of issue of the release order . Applications from the registered exporters under this Public Notice should be addressed to the Chief Controller of Imports and Exports , New Delhi and will be required to be made through the Engineering Export Promo- tion Council , Calcutta and the D.G.T.D. ( Export Promotion Cell ) but will not require the clearance of Iron and Steel Controller , Calcutta . While making such applica- tions the parties should indicate the nature of the products they wish to export , the percentage of contents of the steel items , mentioned in para 2 above , and the likely 1.0.b. value of the exports to enab'e a determination of the export obligation for The purposes of the bank guarantee / legal undertaking referred to in para 6 below .
4. The exporters will be required to file quarterly returns with the Chief Con- troller of Imports and Exports through the Engineering Export Promotion Council and the D.G.T.D. ( Export Promotion Cell ) indicating the actual quantities procured as buffer stock against specific release orders issued in terms of this Public Notice and the specific utilisation of these buffer stocks to facilitate export production , as in the proforma ( Annex . I ) . Adjustment of quantities utilised for exports against the release orders will be permissible only to the extent certified as reasonable by the D.G.T D
5. Exports made in terms of this Public Notice will not qualify for further mport of steel under Public Notice No. 56 - ITC ( PN ) / 72 , dated the 18th April , 1972 , as amended. The supply of steel on the basis of this Public Notice will , however , be at J.P.C. price or the ruline HSI. price ( Where the PC . price is not avail- able) plus 2 per cent thereof .
6. The applicants will be requned to give a bank guarantee to the licensing authority for a value equal to 50 per cent of the value of imported steel for which release order is issued for fulfilment of the required export obligation , referred to in para 3 above . Alternatively , the exporters may also give a legal undertaking (Annex . II to the Public Notice ) regarding their export obligation.

ANNEXURE II
Form of Legal Undertaking
An Agreement made this ..day of . 197 between . a company incorporated under the Companies Act , 1956 and having its registered office at.. (hereinafter referred to as " THE COMPANY " which expression shall include its successors and assignees ) of the one part and the PRESIDENT OF INDIA ( hereinafter referred to as " GOVERNMENT " " , which expression shall include his successors ( in office ) of the other part . WHEREAS the Company has been granted an import licence / release order No .-- for import of raw materials and components of the c.i.f. value of Rs . AND WHEREAS as a condition of the said import licence / release order the Gov- ernment has stipulated that the Company must earn foreign exchange to the extent of Rs . over a period of . months from the date of importation of the first consignment into India or the supply of raw material by the canalising agency against the subject licence / release order by exporting
NOW this agreement witnesseth as follows
1 The Company shall earn foreign exchange for an F.O.B. value of Rs by exporting . within a period of months as aforesaid (in the event of import licence / relcase order No is not fully utilised by the said company , then the export obligation shall be proportionately scaled down ) . Exports to Sikkim and Bhutan will not qualify for redemption of export obligation as also exports to Afghanistan and Nepal , if made otherwise than against payment in free foreign exchange will not qualify for redemption of import obligation .
2. The Company shall furnish a report within one month of the expiry of the said period of export obligation to the concerned Jt./Dy . Chief Controller of Imports and Exports in regard to exports made viz . the particulars of goods exported , their quantity and f.o.b. value and the countries to which exported All this data shall be duly certified by a Chartered Accountant .
3. The Company shall also submit to the concerned Jt./Dy . Chlef Controller of Imports and Exports within six months of the expiry of the period of export ohli- gaion as aforesaid, bank certificates in original showing realisation of foreign exchange against exports made ... in fulfilment of the export obliga- tions and as such other documents as may be demanded by the Jt./Dy . Chief Con- troller of Imports and Exports as evidence in support of the foreign exchange earned in fulfilment of the terms and conditions of this agreement .
4. In the event of the Company is not able to fulfil the export obligation under- taken by it as aforesaid , the Company shall , on the instructions of the concerned Jt./Dy . Chief Controller of Imports and Exports or the Chief Controller of Imports and Exports , New Delhi , shall hand over to the State Trading Corporation or such other Agency as the Government including ( C.CI. & E ) may nominate ( hereinafter referred to as the Agency) twice the difference between the stipulated export obligation and actual exports in terms of F.O.B. value of the products to be export- ed, for export by the Agency at such prices as is able to obtain abroad . The Com- pany shall , in addition , pay simultaneously a sum of Rs . (this would be équal to 5 per cent of the export obligation subjectto a maximum of Rs . 5 lakhs ) by way of " liquidated damages " to the Agency . The Agency (after exports and realisation of sale proceeds of the aforesaid products as expeditiously as possible ) shall give to the Company Rupee equivalent of the net foreign exchange earned by the Agency on such exports after takingequivalent of the met foreignancy's normal commission ) as has been incurred by the Agency .
5. The F.O.B. value representing the difference between the stipulated export obligation and the actual exports referred to above and also the amount represent- ing 5 per cent of the export obligation by way of " liquidated Damages " shall be determined by the Jt./Dy . Chief Controller of Imports and Exports or Chief Con- troller of Imports and Exports and the decision of the said authority shall be final and binding on the company. While determining the value , the said authority will , If it is considered necessary , give an opportunity to the Company to produce such an evidence as it can , in support of the determination of the value for this purpose .
6. In the event of the Company failing to fulfil the export obligation undertaken by it as aforesaid , except when the fulfilment of such obligation is prevented or delayed , because of any law , order , proclamation , regulations or Ordinance of the Government , the Government shall be free to take possession of the goods produced A

by the Company or of the imported raw material as the ease maybe , and take such action as it may consider necessary for the disposal / distribution in a manner and at a price as may be decided by the Government , in addition to recovering liquidat- ed damages in terms of clauses . Any order issued by the Government in this regard shall be final and binding and the Company hereby undertakes to comply uncon- ditionally with such an order. Any stamp duties payable on this document or any documents executed thereunder shall be borne by the Company,

विषय -प्रप्रैल, 1972 - मार्च , 1973 के दौरान निर्यात उत्पादन के लिए आयातित इस्पात का ममरण-प्रत्याशित निर्यात आदेशों को निष्पादिन करने के लिए इस्पात मदों के हेतु रिहाई आदेश जारी करना ।
सख्या 179 - आई ० टी० सी ० (पी ० एन ० )/ 72- विदेश व्यापार मंत्रालय की सार्वजनिक सूचना संख्या 56 -आई ० टी० सी ० पी ० एन ० )/ 72 , दिनांक 18 अप्रैल , 72 की ओर ध्यान आकृष्ट किया जाता है जिसकी श के अनुसार वे पजीकृत नियार्तक जिन के पास निर्यात श्रादेश हैं उनके निष्पादन के लिए उन्हें आयातित इस्पान प्रदान किया जा रहा है प्रौर जिसके लिए देशी इस्पात की आवयश्क मात्रा उपलब्ध नही है ।
अल्प समय में माल छुड़ाने के लिए विदेशो से आदेशों को स्वीकार करने के लिए निर्माता निर्यातकों की समर्थ बनाने के विचार में यह निश्चय किया गया है कि ऐसे पंजीङ्गत निर्यातकों के आवेदन- पत्रा पर विचार किया जाए जिनका दार्षिक निर्यात निप्पादन अप्रैल , 1971 मार्च 1972 के दौरान या 31 अक्तूबर , 1972 को अप्रैल, 1972 सितम्बर , 72 के दौरान निम्नलिखित इस्पात मदों की श्रेणिया के लिए निर्यातको के बफर भंडार के रूप में हिन्तुस्तान स्टील लि ० पर रिहाई आदेशों को प्रशन किए जान के लिए कम से कम 10 लाख रुपए मूल्य ( जहाज पर्यम्त निःशुल्क मूल्य ) का रहा हो
( क ) नर्म इम्पात बिलेट ।
(ख ) नर्म इस्पात तार छड़े ।
(ग) उच्च कार्बन की तार छड़े ।
(घ) मलाखें तथा छड़ें ।
(ङ) तार राल्ड स्ट्रीप/ स्कैल्प ।
( च्) नर्म इस्पात की कोनिया ।
( छ ) अन्य निर्माण सामग्री जैसे बीम, चैनल आदि ।
(ज) नर्म इस्पात की प्लेटे ।
(अ) शट राल्ड/ कोल्ड राज्य शीटे ।
3. इस सार्वजनकि सूचना के अन्तर्गत पात्र किसी एक निर्यातक को इम मार्वजनिक सूचना .की शर्तों के अनुसार 10 लाख रुपये मे अधिक के रिहाई आदेश नही जारी किए जायेगेंगे तथा इन्हें उम रिहाई आदेश के जारी होने की नारीख में 18 माह के भीतर आगामी निर्यातो के मद्दे पूर्णत संमायोजित किया जायगा । इम मार्वजनिक सूचना के अन्तर्गत पंजीकृत नियनित्रा में दिए जाने बाले आवेदन-पत्र मुख्य नियंत्रक , आयात-निर्यात को सम्बोधिन किए जाने चाहिए तथा इन्द ग्रभिमालिक निर्यात संवर्धन परिषद कलकत्ता तथा डी० जी० टी० डी० ( निर्यात संवर्धन श्रममने भेजा जाना आवयश्क है किन्तू लौहा तथा इस्पान नियंत्रक , कलकना से ग्रनुर्मान लेना प्रावयन्नन्ना जब इस प्रकार के आवेदन किए जा रहे हो तो नीचे की कंडिका 6 में उल्लिखित बैंक गारंटी कानूनी वचन-पत्र के प्रयोजनो के लिए निर्यात आभार का निश्चय करने में समर्थ बनाने के लिए पाटिमा को चाहिए कि वे उन उत्पात्र के प्रकार का पर्युक्त कंडिका 2 मे उल्लिखिन हम्पान मदा ही " नया की प्रनिशनला का तथा निर्यातो के सभाविन जहाज पर्यन्त निशन्क मन्थ का सर्वच गरे ।
* निर्यातको को निर्यात उत्पादन को सुविधाजनक बनाने के लिए यथा मनग्न प्रपत्र म ( अनुबंध 1 ) इन सार्वजनिक सूचना की शर्तों के अन्मार जारी किए गए विशेष रिहाई देगा तथ इन बफर भंडारों के विशेष उपयोग के मट्टे बफर भडार के रूप में उत्पन्न की गई वास्तविक मात्रा का संकेत करते हुए अभियांत्रिक निर्यात सत्रधन परिषद नथा डी०जी०टी ० डी० ( निर्मान नवर्धन कक्ष) के माध्यम से मुख्य नियंत्रक, आयात-निर्यात के यहा आवधिक विवरणी भी जमा करना अपे- क्षित है । रिहाई श्रादेशों के मद्दे निर्यातो के लिए उपयोग की गई मावाओ का ममायोजन नेवल उसी मीमा तक अनुमेय होगा जिम सीमा तक डी ० जी ०टी ० डी द्वारा उचित प्रमाणिन किया जागरण ।
5. हम सार्वजनिक सूचना की शर्तों के अनुमार किए गए निर्यात यथा मणाधिन गार्वजनिव सूचना संख्या. 56-आईटीसी (पीएन)/ 72 , दिनांक 18 अप्रैल , 72 के अन्तर्गत इम्पान ने आगामी आयात के लिए पाल नहीं होंगे । लेकिन हम सार्वजनिक सूचना के आधार पर टम्पान का मभरणा ज ० पी० सी० कीमत पर या हिन्दुस्तान स्टील लि ० कीमत पर ( जहा पर जपी मी० कोमन उप लब्ध नहीं है ) किया जाएगा तथा उम पर 2 प्रतिशत और जोडा जाण्या ।
6 आवेदनों को उपर्युक्त कडिका मे उल्लिखित अपेक्षित नियात अाभा की पनि नि जो रिहाई आदेश जारी किया गया है उसके लिए आयातित इम्पाल के मूल्य के 50 पर नगद मूल्य के लिए लाइसेंस प्राधिकारी को एक बैंक गांरदी देने की जरुरन होगी । निकल्याण निर्वानक अपने निर्वात आधार के सम्बन्ध में एक कानूनी वचन-पत्र ( इम मार्वजनिन ममता का अनुबंत्र II भी दे सकते हैं ।

ग्राज तिथि.. .. माम . 197 में है ( इसके को कम्पनी अधिनियम, 1956 के अधीन संस्थापित . एक कम्पनी जिसका पंजीकृत कार्यालय .. बाद में जिसे ' कंम्पनी' कहा गया है , इम अभिव्यक्ति मे कम्पनी के उत्तराधिकारी और श्रधिन्यासी शामिल होंगे ) एक पक्ष , और भारत के राष्ट्रपति ( इसके बाद जिसे ' सरकार' कहा गया है , इम अभिव्यक्ति में कार्यालय में राष्ट्रपति का उत्तराधिकारी शामिल होगा ) दूसरे पक्ष के बीच एक समझौता हुआ । चूंकि कम्पनी को ... रुपये लागत -श्रीमा - भाड़ा मूल्य के कच्चे माल और संघटकों के श्रायात के लिए एक श्रायात लाइसेंस/रिहाई आदेश संख्या ... प्रदान किया गया है और चूंकि सरकार ने उक्त आयात लाइसेंस/ रिहाई आदेश की एक शर्त यह निर्धा- रित की है कि कम्पनी को. ... के निर्यात द्वारा भारत में माल की प्रथम किश्त के आयात की तिथि से या अधीन लाइसेंस/रिहाई आदेश के आधार पर मारणीबद्ध एजेंसी द्वारा कच्चे माल के संभरण की तिथि से .. मासों की रुपये की सीमा तक विदेशी मुद्रा अवश्य कमानी वधि के भीतर . चाहिए,
अब इस समझौते का साक्ष्य हम प्रकार है :--
के भीतर . 1. जैसा कि पहले कहा गया है कम्पनी ..... महीनों की अवधि के निर्यात द्वारा .. रुपये जहाज पर्यन्त निःशुल्क मूल्य की विदेशी मुद्रा कमाएगी । (यदि श्रायात लाइसेंम/रिहाई आदेश का उक्त कम्पनी द्वाग पूर्णारूपेण उपयोग नहीं किया जाप्ता है तो निर्यात दायित्व उसी अनुपात में कम कर दिया जाएगा ) । मिक्किम और भूटान को निर्यात करने से निर्यात दायित्व से छुटकारा नहीं मिल जाएगा जैसाकि अफगानिस्तान और नेपाय को भी मुक्त विदेशी मुद्रा में भुगतान के महें नियति करने से भिन्न तरीके से निर्यात करने पर आयात दायित्व से छुटकारा नहीं मिल जाएगा । संख्या.
2. निर्यात दायित्व की उक्त अवधी की समाप्ति के एक महीने के भीतर कम्पनी किए गए निर्यातों के सम्बन्ध में अर्थात् निर्यात किए गए माल के ब्यौरे , उसकी माला और जहाज पर्यम्त निःशुल्क मूल्य भौर जिन देशों को निर्यात किया गया है , उनके सम्बन्ध में एक रिपोर्ट सम्बद्ध संयुक्त/उप-मुख्य नियंत्रक, आयात- निर्यात को प्रस्तुत करेगी । ये सब आंकड़े एक सनदी लेखापाल द्वारा विधिवत् प्रमाणित किए जाएंगे ।
3 कम्पनी यथापूर्वोक्न निर्यात दायित्व की अवधि की समाप्ति के 6 महीने के भीतर निर्यात वायित्व को पूरा करने में . ..को दिए गए निर्यातों के बदने विदेशी " मुद्रा की वसूली प्रदर्शित करते हुए मूल बैंक प्रमाणपत्रों को भी सम्बद्ध संयुक्त /उप- मुख्य नियंत्रक, प्रायान- निर्यात को प्रस्तुत करेगी और हम समझौते की शर्तों को पूरा करने में कमाई गर्न विदेशी मुद्रा की पुष्टि में ऐसे अन्य साक्ष्य भी संयुक्त/उप- मुख्य नियंत्रक , श्रापान-निर्यात को प्रस्तुत करेगो जो उनक हाल भांगे जाएं ।

4. उपर्युक्त दिए गए वचन -पत्त्र के अनुसार कम्पनी द्वारा निर्यात दायित्व को न पूरा करने की स्थिति में , कम्पनी को, संत्रद्ध संमुक्त/उप-मुख्य नियंत्रक, श्रायात- निर्यात या मुख्य नियंत्रक, आयात- निर्यात , नई दिल्ली के अनुदेशानुसार राज्य व्यापार निगम या अन्य ऐसे ही अभिकरण जैसाकि सरकार ( इसमें मुख्य नियंत्रक , आयात-निर्यात भी शामिल है ) नामित करे ( इसके बाद इसे अभिकरण की संज्ञा दी जाए ) अभिकरण को उसके द्वारा उस कीमत पर निर्यात करने के लिए जिस कीमत को वह विदेश में प्राप्त करने के योग्य है , निर्धारित निर्यात श्रभार और निर्यात किए जाने वाले उत्पाद के जहाज पर निःशुल्क मूल्य के अनुसार वास्तविक निर्यात में जो अन्तर है उससे दुगुना सौंपना पड़ेगा । इसके अतिरिक्त , कम्पनी साथ ही साथ .. रुपये ( यह निर्यात दायित्व के 5 प्रतिशत तक के बराबर और अधिक से अधिक 5 लाख रुपये होगा) "निर्धारित क्षति" के रूप में एजेंसी को अदा करेगी । अभिकरण ( उपर्युक्त निर्यात तथा उत्पाद की बिक्री की वसूली के यथा शीघ्र बाद ही ) कम्पनी को अपने द्वारा किए गए निर्यात से ऐसे खर्चे जो उसके द्वारा इस सम्बन्ध में किए गए हैं , उन्हें शामिल करने के बाद , एजेंसी द्वारा कमाई गई वास्तविक विदेशी मुद्रा के बराबर रुपये ( अभिकरण के मामान्य कमीशन को शामिल करते हुए ) अदा करेगा ।
5. उपर्युक्त उल्लिखित निर्धारित निर्यात दायित्व तथा वास्तविक निर्यात को दशानें वाले जहाज पर निःशुल्क मूत्र्य का तथा " निर्धारित क्षति " के रूप में निर्यात आभार के 5 प्रतिशत को वर्शाने वाली धनराणि का निर्धारण संयुक्त/ उप-मुख्य नियंत्रक, आयात-निर्यात अथवा मुख्य नियंत्रक, आयात -निर्यात द्वारा किया जाएगा और उपर्युक्त प्राधिकारी द्वारा दिया गया निर्णय कम्पनी के लिए अन्तिम तथा अनिवार्य होगा । मूत्र का निर्धारण करने ममय उपर्युक्त प्राधिकारी, यदि यह आवश्यक समझा जाता है तो कम्पनी को इस कार्य के निए मूल्य के निर्धारण के समर्थन में एक ऐसा साक्ष्य प्रस्तुत करने के लिए मुअवसर प्रदान करेगा जिसे वह दे सकती है ।
6. उपर्युक्त दिए गए वचन-पत्त्र के अनुसार कम्पनी द्वारा निर्यात दायित्व न पूरा करने की स्थिति में, किन्तु उस स्थिति को छोड़ कर जब कि ऐसे दायित्व सरकार के किसी कानून , आदेश, घोषणा, अधिनियम अथवा अध्यादेश के कारण रोके गए हैं या विलम्बित किए गए हैं सरकार को कम्पनी द्वारा उत्पादित माल या आयातित कच्चे माल को , जैसा भी मामला हो , अपने अधिकार में लेने की स्वतंत्रता होगी और उसे उस कीमत पर जो उसके द्वारा निश्चित की जाए माल के निपटान करने/ वितरण करने के लिए ऐसी कार्रवाई करने की भी जो आवश्यक समझी जाए , स्वतंत्रता होगी । इस सम्बन्ध में सरकार द्वारा जारी किया गया आदेश अन्तिम तथा अनिवार्य होगा और कम्पनो एतद्वारा वचन देती है कि एसे आदेश का बिना शर्त पालन करेगी । इस दस्तावेज के लिए अथवा इसके अन्तर्गत निष्पादित अन्य किसी भी दस्तावेज के लिए अदा किए जाने वाले स्टाम्प पर कम्पनी द्वारा दिया जाएगा ।
