CENTRAL EXCISES
New Delhi , the 15th December 1972
G.S.R.- 490 (E ) ,-In exercise of the powers conferred by sub - rule ( 1 ) of rule 8 of the Cen- tral Excise Rules . 1944. and in supersession of the notification of the Government of India in the Ministry of Finance (Department of Revenue and Insurance ) . No. 121 / 72 - Central Excises dated the 1st April . 1972 , the Central Government hereby exempts those vegetable products , falling under item No. 13 of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944) , in the manufacture of which indigenous cotton seed oil is used and cleared from a factory in any quarter of a financial vear , ( the first quarter for the applicability of this exemption being the quarter rter commencing on the 1st December , 1972 ) , from so much of the duty of exciseex leviable thereon , as is equivalent to the amountamount calculated , at the rate specified in column ( 3 ) of the Table hereto annexed , on the quantity of indigenous cotton seed oil used in the manufacture of such ve- getable product to the extent specified in column ( 2 ) of the said Table :--

I On such quantity of indigenous cotton seed oil used in the manu- facture of the said vegetable product as is in excess of 15 % , but not in excess of 25 % , of the total weight of the said vege- table product .

2. On such quantity of indigenous cotton seed oil used in the ma- nufacture of the said vegetable product as is in excess of 25 % , but not in excess of 35 %, of the total weight of the sald vege- table product .

3. On such balance quantity of in ligenous cotton seed oil used in Rupees two hundred . the manufacture of the said vegetable product as is in excess of 35 % ofthe total weight of the said vegetable product .
Provided that-
( i) no such exemption from duty shall be admissible in respect of the said vegetable pro luct where the indigenous cotton seed oil used in the manufacture thereof does not exceed 15 percent of the total weight of the said vegetable product ;
(ii ) the quantum of the concession available under each Serial No. representing the slab rates aforesaid shall be computed separately and totalled up :
Provided further that the aforesaid example shall be calculated on quarterly basis and the amount so calculated shall be credited in the assessee's account current maintained under rule 173G of the Central Excise Rules , 1944 .

सा० का ० नि० 490 ( अ ) -केन्द्रीय उत्पाद-ल्क नियम , 1944 के निम 8 के उपनियम ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के वित्त मंत्रालय ( राजस्व और बीमा विभाग ) की अधिसूचना मं ० 121 / 72--केन्द्रीय उत्पाद शुल्क , तारीख 1 अप्रैल , 1972 को अति- ष्ठिन करते हुए , केन्द्रीय सरकार केन्द्रीय उत्पाद शुल्क और नमक अधिनियम , 1944 ( 1944 का 1. ) की प्रथम अनुसूची की मद मंत्र 13 के अन्तर्गत आने वाले उन वनस्पति उत्पादों को , जिनके विनिर्माण में देशी विनौले के तेल का प्रयोग किया गया हो और जिनकी निकासी किसी कारखाने से किसी वित्तीय वर्ष की किमी निम। हो में की गईड़ो, ( इस छूट की उपयोज्यता के लिए प्रथम तिमाही वह तिमाही हैं जो 1 दिसम्बर, 1972 से प्रारम्भ होती है ) , उन पर उग्रहणीय उतने उत्पाद शुल्क से एतद्वारा छूट देती हैं, जितना इसमे उपाबद्ध सारणी के स्तम्भ ( 2 ) में विनिदिष्ट परिमाणतक ऐसे वनस्पति- उत्पाद के विनिर्माण में प्रयुक्त देशी बिनौले के तेल की मात्रा पर, उक्त सारणी के स्तम्भ ( 3 ) में विनिर्दिष्ट दर से संगणित' की गई रकम के समतुल्य है: --

दो सौ रुपए 1 उक्त वनस्पति - उत्पाद के विनिर्माण में प्रयुक्त देशी विनौल के तेल की उतनी मात्रा पर जितनी उक्त अनस्पति- उत्पाद के कुल भार के पन्द्रह प्रतिशत से अधिक किन्तु पच्चीम प्रतिशत से श्रनधिक हो ।

दो सौ पचास रुपए 2 उक्त वनस्पति - उत्पाद के विनिर्माण में प्रयुक्त देशी बिनौले के तेल की उतनी मात्रा पर जितनी उक्त वनस्पति- उत्पाद के कुल भार के पच्चीस प्रतिशत से अधिक किन्तु पैंतीस प्रतिशत से श्रनधिक हो ।
दो सौ रुपए 3 उक्त वनस्पति - उत्पाद के विनिर्माण में प्रयुक्त देशी विनौले के तेल की उतनी बाकी मात्ना पर जितनी उक्त वनस्पति- उत्पाद के कुल भार के पैंतीस प्रतिशत से अधिक हो ।
परन्तु:--
( i) उक्त वनस्पति- उत्पाद की बाबत शुल्क से कोई भी ऐसी छूट उस दशा में अनुज्ञेय नहीं होगी जिम में उसके विनिर्माण में प्रयुक्त देशी विनौले का तेल वनस्पति- उत्पाद के कुल भार के पन्द्रह प्रतिशत से अधिक न हो ;
( ii ) पूर्वोक्त स्लैब दरों को प्रतिदर्शित करने वाली हर एक क्रम संख्या के अन्तर्गत उपलब्ध रियायत की मात्रा की संगणना अलग - अलग की जाएगी और उम्का जोड़ लगाया जाएगा:
परन्तु यह और कि पूर्वोक्त छूट की संगणना त्रैमासिक आधार पर की जाएगी और इस प्रकार संगणित रकम , केन्द्रीय उत्साद शुल्कनियम , 1974 के नियम 173 - छ के अधीन निर्धारती द्वारा रखे गए चालू खाते में जमा कर दो जाएगी ।
