New Delhi , 19th January 1973
S.O. 30 (E) / 18E/ IDRA / 73 .--Whereas the Central Government has , by ts rot fied Orde in the late Ministry of Industrial Development , Internal Trade No. S.O. 3030 / 18A / IDRA 7Ir dated the 20th August , 1971 , issued under section 18A of the Industries (Developr ent ad Re . gulation) Act , 1951 (65 of 1951 ) , author sed the Gujarat State Textile Corporation Lim ted , Ahmedabad to take over the management of the whole of the industrial undertaking krown as the Jehangir Vakil Mills Limited , Ahmedabad (hereinafter in th & Order referred to as the ' In- dustrial undertaking") for the period specified therein ;
Now, therefore, in exercise of the powers conferred by sub - section (2) of sect on 18E the said Act, the Central Government hereby specifies in the Schedule annexed hereto, the excepe tions , restrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956 ) , shay continue to apply to the industrial undertaking in the same manner as it applied thereto befor the issue of the not'fied order under section 18A .

का ० श्र ० 30 ( अ ) 185 / आई ० डी ० आर ० ए ०/ 78.-यतः उद्योग ( विकास तथा विनिय- मन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 क के अधीन जारी किए गए औद्योगिक विकास , श्रान्तरिक व्यापार मंत्रालय के अपने अधिसूचित श्रादेश सं ० का ० प्रा ० 3030/18-क/ आाई ० डी ० आर ० ए ०/71 दिनांक 20 अगस्त, 1971 द्वारा केन्द्रीय सरकार ने गुजरात राज्य वस्त्र निगम लिमिटेड , अहमदाबाद को सम्पूर्ण जहांगीर वकिल मिल्स लिमिटेड , अहमदाबाद, (जिसे इसमें इसके पश्चात इस आदेश में "श्रौद्योगिक उपक्रम" कहा गया है ) का प्रबन्ध उसमें निर्दिष्ट कालावधि के लिये ग्रहण करने के लिए प्राधिकृत किया ।
अतः अब उक्त अधिनियम की धारा 18 ङ की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एताद्वारा इससे संलग्न अनुसूची में उन अपवादों, निर्बन्धनों और परिसीमाओं को निर्दिष्ट करती है जिसके अध्यधीन रहते हुए कम्पत्ती अधिनियम 1956 ( 1956 का 1 ) श्रौद्योगिक उपक्रम पर उसी रूप में लागू रहेगा जिस रूप में वह धारा 18-क के अधीन अधि- सचित श्रादेश के जारी होने से पहले उस पर होता था ।

वे अपवाद , निर्वस्धन और परिसीमाएं, जिनके अध्यधीन स्तम्भ ( 1 ) में णित उपबन्ध, श्रौद्योगिक उपक्रम पर लागू होंगे ।

धारा 293 ( 1 ) ( घ) यह धारा , उद्योग ( त्रिकास तथा विनियमम) अधिनियम , 1951 की धारा 18-क के अन्तर्गत कम्पनी का प्रबन्ध हाथ में लेने के लिए केन्द्रीय सरकार द्वारा प्राधिकृत किसी व्यक्ति अथवा व्यक्तियों के निकाय के सम्बन्ध में लाग मही होगी ।

S.O.31 ( E) /183/IDRA/73.-Whereas the Central Government has by its notified order in the late Mastry of Industrial Develop nent , Internal Trade No. 3800 / 18A / IDRA / 70 dated the 24th Nove nber , 1970 , issued under section 18A of the Industries (Development and Regulation Act 1951 (65 of 1951 ) , autho ised the Gujarat State Textile Corporation Limited , to take over the manage rent of the whole of the industrial undertaking known as the Keshav Mills Company L'mited, Petlad (hereinafter in this Order referred to as the ' industrial undertaking ) for the period specified therein ;
Now, therefore , in exercise of the powers conferred by sub - section (2 ) of section 188 fthe said Ac', the Central Government hereby specifies in the Schedule annexed hereto the except on , restrict ons , and limitat ons subject to which the Companies Act , 1956 ( 1 of 1956 ) , hall continue to apply to the industrial undertaking in the same manner as it applied thereto before the ssue of the not.fied order under section 18A .

का ० भा ० 31 ( अ ) 18 ई/ आई ० डी ० भार ० ए ०/ 73 - यतः उद्योग ( विकास तथा विनिय- मन ) अधिनियम 1951 ( 1951 का 65 ) की धारा 18 क के अधीन जारी किए गए औद्योगिक विकास, आन्तरिक व्यापार मंत्रालय के भ्रनने अधिसूचित श्रादेश सं ० 3800/ ४क/आई० डी ० भारण ए ०/70 दिनाक 24 नवम्बर , 1970 द्वारा केन्द्रीय सरकार ने गुजरात राज्य वस्त्र निगम लिमिटेষ্ট, अहमदाबाद को सम्पूर्ण केशव मिल्स कम्पनी लिमिटेड, पेटलैंड ( जिसे इसमें इसके पश्चात् आवेश में 'श्रौद्योगिक उपक्रम' कहा गया है ) का प्रबन्ध उसमे विनिविष्ट कालावधि के लिए ग्रहण करने के लिए प्राधिकृत किया ।
अतः अब उक्त अधिनियम की धारा 18 ङ की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एनद्वारा इससे संलग्न अनुसूची में उन अपवादों, निर्बन्धनों और परिसीमाओं को तिर्दिष्ट करती है जिसके अध्यधीन रहते हुए कम्पनी अधिनियम 1956 ( 1956 का 1 ) औद्योगिक उपक्रम पर उत्ती रूप में लागू रहेगा जिस रूप में वह धारा 18 क के अधीन अधिसूषित आदेश के जारी होने से पहले उसे पर होता था ।

S.O. 32 (E) /18E/IDRA/73.-Whereas the Central Government has , by its notified Orde in the Ministry of Industrial Development (Department of Industrial Development) No. S.O 21 (E) / 18A/ IDRA/ 72 , dated the 7th January , 1972, Issued under section 18A of the Industr ca (Development and Regulation) Act , 19751 ( 65 of 1951) , authorised the Gujarat State Textile Corporation Limited , Ahmedabad to take over the management of the whole of the industrial undertaking known as thethe Rainagar Spinning Weaving andAnd Manufacturing Company Limited, Ahmedabad (hereinafter in this Order referred to as the industrial undertaking) for the period specified therein .
Now, therefore , in exercise of the powers conferred by sub - sect on ( 2) of section 18E of the said Act, the Central Government hereby specifies in the Schedule annexed hereto , the exceptions , restrictions and limitations subject to which the Companies Act , 1956 ( 1 of 1956) , shall continue to apply to the industrial undertaking in the same manner as it applied thereto before the issue of the notified order under section 18A .

अतः अब उक्त श्रधिनियम की धारा 18 ङ की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा इससे संलग्न अनुसूची में उन अपवादों, निर्बन्धनो और परिसीमाभों की निविष्ट करती है जिसके अध्यधीन रहते हुए कम्पनी प्रधिनियम , 1956 ( 1956 का 1 ) श्रौद्योगिक उपक्रम पर उसी रूप में लागू रहेगा जिस रूप में वह धारा 18 - क के अधीन अधिसूचित आवेमा के जारी होने से पहले उस पर होता था ।
