No. DRAW BACK/ PN - 1 / 73.- Under rule 4 of the Customs and Central Excise Duties Draw- back Rules , 1971 ( Notification No. 52 / F . No. 602 / 2 / 70 - DBK published in the Gazette of India Extraordinary , dated the 25th August , 1971 ) , the Central Government hereby makes the following amendments in the Table published in the Public Notice No. DRAWBACK / PN - 1 dated the 15th October , 1971 : --
For Sub - Serial No. 5004 and the entries relating thereto , the following shall be substituted :-

सं ० प्रतिमवायगी/पी ० एन०-1/ 73.-सीमा शुल्क तथा केन्द्रीय उत्पादन गुल्क प्रतिश्रदायगी नियमावली , 1971 ( भारत के राजपत्र, असाधारण, दिनांक 25 अगस्त, 1971 में प्रकाशित अधिसूचना सं ० 52/ फा० सं ० 602/ 2/ 70-प्र ० अ ० ) के नियम 4 के अधीन, केन्द्रीय सरकार सार्वजनिक सूचना सं ० प्रतिश्रदायगी/पी ० एन ० 1 , दिनांक 15 अक्तूबर , 1971 में प्रकाशित सारणी में एतद्वारा निम्नलिखित संशोधन करती है:-
किया उप-क्रम सं ० 5004 तथा उससे सम्बन्धित प्रविष्टियों के लिए निम्नलिखित प्रतिस्थापित जायगा:-

13 प्रतिशत ( केवल तेरह प्रतिशत) पोतपर्यन्त निःशुल्क मूल्य ।
( ii ) बाइसाइकिल के स्पोक , निप्पल, वाशर , चेन, रिम लाइनर (चमड़े के निर्मित ) काठी के कवर , पैडल के रबर का हिस्सा, पुजें रखने के बक्से, साइकिल पम्प, टायर, तथा ट्यूब से भिन्न साइकिलों के निर्माणक हिस्से, फालतू पुर्जे तथा उपांग ।
टिप्पणी. उपरोक्त दर में , पैक की जाने वाली सामग्री पर प्रति श्रदायगी शामिल है ।

सं ० प्रतिश्रदायगी/पी० एन०-2/ 73-सीमाशुल्क तथा केन्द्रीय उत्पादन शुल्क निर्यात प्रतिश्रदायगी नियमावली, 1971 ( भारत के राजपत्र, असाधारण , दिनांक 25 अगस्त, 1971 में प्रकाशित अधिसूचना सं ० 52/फा ० सं ० 602/2/70/२० अ ० ) के नियम 4 के अधीन , केन्द्रीय सरकार सार्वजनिक सूचना सं ० प्रतिअदायगी/ पी० एन ० 1 , दिनांक 15 अक्तूबर , 1971 में . प्रकाशित सारणी में एनद्वारा निम्नलिखित संशोधन करती है :-

After Sub - clause ( b ) of Sub - Serial No. 3821 and the entries relating thereto , the following shall be added :-

( c) Paper covered copper strips ( i) Rs . 415 ( Rupees four and fifteen paise only) per kg . plus ( ii ) Rs . 0-875 ( Eighty seven point five only ) per kg . of copper strip content .
Provided that the drawback specified at ( ii ) above will be applicable where the exporter produces
0875 Eighty - seven point five paise only ) per kg . leviable on copper strips produced from copper in crude form has been paid and that no rebate under the Central Excise Rules , 1944 has been or evidence to the satisfaction of the Assistant Collector of Customs that the Central Excise duty of Rs . will be obtained by the exporter from the Central Excise authorities .

सार्वजनिक सूचना सं ० प्रतिश्रदायगी/ पी ० एन ०1, दिनांक 15 अक्तूबर , 1971 में प्रकाशित सारणी में एतद्वारा निम्नलिखित संशोधन करती है :-
उप- क्रम सं ० 3821 के उप -खण्ड ( ख ) तथा उसमे सम्बन्धित प्रविष्टियों के पश्चात् निम्नलिखित जोड़ा जायगा :--

(1) 4.15 रुपये ( केवल चार रुपये तथा पंद्रह पैसे) प्रपि कि ० ग्रा ० , तथा
(11 ) 0.875 रुपये ( केवल मत्तासी दशमलव पांच पैसे) ताभ्र पट्टी अन्तर्वस्तु का प्रति कि ० ग्रा ० ।
ऊपर ( ।। ) पर विनिर्दिष्ट प्रति अदायगी तब लागू होगी जब कि निर्यातकर्ता सीमाशुल्क के महायक ममार्ता के समाधानप्रद रूप में इस बात का साक्ष्य प्रस्तुत करे कि अपरिष्कृत ताम्र मे निर्मित ताँत्र पट्टियों पर 0.875 रुपये ( केवल सत्तासी दशमलव पांच पैसे ) प्रति कि ० ग्रा ० की दर से लगने योग्य केन्द्रीय उत्पादन शुल्क अदा कर दिया गया है ; और निर्यातकर्ता द्वारा केन्द्रीय उत्पादन शुल्क प्राधिकारियों से केन्द्रीय उत्पादन शुल्क नियमावली 1944 के अन्तर्गत कोई छूट नहीं ली गई है अथवा ली जायगी ।

उप क्रमांक 3906 तथा तत्सम्बन्त्री प्रविष्टियों के लिए निम्नलिखित प्रतिस्थापित किया जायगा :-

पोत पर्यन्त निःशुल्क निर्यात्- मूल्य का 16.5 प्रतिशत (सोलह दशमलव पांच प्रतिशत)

No. 602/ 2/ 70 - DBK published in the Gazette ol India , Extra - ordinary dated the 25th August , 1971 ) the Central Government hereby makes the following amendments in the Table published in the Public Notice No. DRAWBACK / PN - 1 dated the 15th October , 1971 :-
The following proviso under Sub - Serial No. 3703 may be inserted , namely:-
" Provided that no rebate under rule 12 or rule 13 of the Central Excise Rules , 1944 has been availed of by the manufacturer / exporter . "

सं ० प्रतिश्रवशयगी/ पी ० एन०- 5/ 73.-सीमाशुल्क तथा केन्द्रीय उत्पादन शुल्क प्रति- अदायगी नियमावली, 1971 ( भारत के राजपत्र, श्रमाधारण , दिनांक 25 अगस्त, 1971 मे प्रकाशित ( अधिसूचना सं ० 52/ फा ० सं ० 602/2/70-प्र० अ ० ) के नियम 4 के अधीन , केन्द्रीय सरकार मार्वजनिक सूचना सं ० प्रतिश्रदायगी/पी० एन ० 1 , दिनांक 15 अक्तूबर , 1971 , में प्रकाशित सारणी में एतद्वारा निम्नलिखित संशोधन करती है ---
अर्थात उप-क्रम सं ० 3703 के अन्तर्गत निम्नलिखित उपबन्ध अन्तःस्थापित किया जायगा ;
" परन्तु यह तब जब कि निर्माता/ निर्यातकर्ता द्वारा केन्द्रीय उत्पादन शुल्क नियमावली, 1944 के नियम 12 अथवा नियम 13 के अन्तर्गत छूट का लाभ नहीं उठाया है । " गया
