NOTIFICATION
New Delhi , the 16th February 1973
S.O. 98 ( E ) / IDRA / 29B /73 / 1 ,-In exercise of the powers conferred by sub- section ( 1 ) of section 29B of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) ( hereinafter referred to as the said Act ) , the Central Govern- ment hereby exempts , subject to the conditions , if any , hereinafter specified , the classes of industrial undertakings specified below from the operation of the pro- visions of
section 10 which relates to the registration of industrial undertakings , section 11 which relates to the licensing of new industrial undertakings , section 11A which relates to licence for producing or manufacturing new articles , and
section 13 which relates to further provision for licensing of industrial undertakings , of the said Act and the relevant rules made thereunder .
SMALL - SCALE UNITS
( 1) Undertakings having investments in fixed assets in plant and machinery not exceeding Rs . 7.5 lakhs .

( 2) Undertakings having investments in fixed assets in plant and machinery not exceeding Rs . 10 lakhs . if such undertakings are engaged in the manufacture of parts , components and sub - assemblies , accessories , tooling or intermediates for supply to other units or for replacements .
OTHER UNDERTAKINGS
(3 ) Other undertakings . if the proposed investment in an undertaking in fixed assets in land , buidings , plant and reachinery for establishing a new undertaking or tor cheering sal expansion or for manufacture of now articles does not exed Le: 1 crore , subject to the following conditions , namely :-

( ii) 5 re cent of be exfactor value of the arnual production arising from such investment or Rs 51kbs , whichever is less , for the itapert of raw maeria's ( otter than s'eel and aluminium ) required for such manufacture ; o
( iii ) 10 per cent of the ex - factory value of the fora such investment er Ra. 5 lakhs year after three years of the corome the import of par's and com onents anruel production arising whichever is less , in any ment of production for sach יי facture;
( e ) Articles reserved for small- scale sectr. such undertaking shall be eligible for exemption for the mani acipe of any of the arti- cles specified in Schedule I ( articleseles reserved for the small - scale sector ) :
Provided that no undertakirs referred to in item ( 1 ) , ( 2 ) or ( 3 ) above shall be eligible for evermotion under this notification if it falls under any of the categories of undertakings specified in Schedule II or if the article proñosed to be manufactured relates to any of the industries specified in Schedule III ( being industries as sveci- fied in Schedule A of the Industrial Policy Resolution , 1956 ) or Schedule IV ( being industries requiring special regulation ) .
2. This notification supersedes the notifications of the Government of India srecified below: -
(1) No. S.O. 713 / IDRA / 29B 70/1 . dated the 19th February , 1970 of the Ministry of Industrial Deve'opment . Internal Trade and Company Affairs , ( Department of Industrial Development ) .

3. Provisions for carrying on business . In pursuance of sub - section ( 2 ) of on 29B of the said Act , the Central Government hereby specifies a period of Simonths from the date of publication of is notification as the period after tor expiry of which no owner of any industrial undertaking , which was previously tempted from the operauon of sections 10 , 11 , 119A and 13 of the said Act and wow is not so exempt by virtue of this notification , shall carry on the business ec such undertaking , except under and in accordance with a licence issued in this at by the Cent.al Government and in the case of State Governments except ו r and in acordance with the previcus permission of the Central Government .

का ० आ ० 98 ( अ ) / उ ० वि ० वि ० ग्र ० / 29/73/1 उद्योग (विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 29 ख की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार, नीचे विर्वादिष्ट किए गए वर्गो के औद्योगिक उपक्रमों को, उक्त अधिनियम की
धारा 10 , जो औद्योगिक उपक्रमों के रजिस्ट्रीकरण से संबंधित है,
धारा 11 , जो नए औद्योगिक उपक्रमों के अनुज्ञापन से संबंधित है ,
धारा 11 - क , जो नई वस्तुओं के उत्पादन या विनिर्माण के लिए अनुज्ञप्ति से संबंधित है,
धारा 13, जो औद्योगिक उपक्रमों के अनुज्ञापन के लिए और उपवन्ध करने से सम्वन्धित है,
के और तद्धीन बनाए गए सुसंगत नियमों के उपबन्धों के प्रवर्तन से , उसमें इसके पश्चात् विनिर्दिष्ट शर्तों के अधीन , यदि कोई हो , एतद्वारा छूट देती है ।
लघु एकक
( 1 ) ऐसे उपक्रम, जिनमें संयंत्र और मशीनरी में नियत आस्तियों में विनिधान 7.5 लाख रुपये से अनधिक हो ।
अनुषंगी
( 2) ऐसे उपक्रम, जिनमें संयंत्र और मशीनरी में नियत आस्तियों में विनिधान 10 लाख रुपये से अनधिक हो, यदि ऐसे उपक्रम अन्य एककों को प्रदाय या प्रतिस्थापन के लिए पुर्जों, घटकों और उफ्संयोजनों , उपसाधनों, औजारों या मध्यकों के विनिर्माण में लगे हुए हों ।

अन्य उपक्रम
( 3 ) अन्य उपक्रम , यदि नग उपक्रम स्थापित करने के लिए या मारभूत विस्तार करने के लिए या नई वस्तुओं का विनिर्माण कारने के लिए भूमि , भवनों , संयंत्र और मशीनरी में नियत श्रस्तियों में किती उपक्रम में प्रस्थापित विनित्रान , निम्नलिखित शर्तों के अधीन, 1 करोड़ रुपये से अधिक नहीं है, अर्थात्:--
( क ) एक या अधिक क्रियाकलापों में लागू विनिधान -सीमा 1 करोड़ रुपये की सीमा ऊपर विनिर्दिष्ट एक या अधिक क्रियाकलापों को, चाहे एकल रूप में या एक साथ मिलाकर और चाहे एक स्तर पर या एक से अधिक स्तर पर हों , लागू होगी;
(ख ) विद्यभान, उपक्रम, जो अधिनियम के अधीन रजिस्ट्रीकृत, आदि नहीं हैं .-- यदि कोई उपक्रम एक ऐसा विद्यमान उपक्रम है जो पहले ही उक्त अधिनियम के अधीन रजिस्ट्रीकरण , अनुज्ञप्ति या अनुज्ञा के अन्तर्गत नहीं आता है, तो विद्यमान विनिधानों और प्रस्थापित विनिधान मिलाकर 1 करोड़ रुपये के कुल विनिधान से अधिक नहीं हो ;
( ग ) विद्यमान उपक्रम , जो अधिनियम के अधीन रजिस्ट्रीकृत, आदि हैं. यदि कोई उपक्रम एक ऐसा विद्यमान उपक्रम है जो पहिले ही उक्त अधिनियम के अधीन रजिस्ट्रीकरण , अनुज्ञप्ति या अनुज्ञा के अन्तर्गत आता है, तो विद्यमान विनिधानों और प्रस्थापित विनित्रान मिलाकर 5 करोड़ रुनये के कुछ विनिधान से अधिक नहीं हो;
( घ ) विदेशी मुद्रा सीमाएं से अधिक की विदेशी प्रस्थापित विनित्रान के लिए निम्नलिखित सीमाओं मुद्रा की आवश्यकता नहीं है :-
( i ) ऐसे विनिधान का 10 प्रतिशत या 5 लाख रुपये , जो भी अधिक हो, मशीनरी और उपस्कर के आयात के लिए; या
(ii ) ऐसे विनिधान के उद्भूत वार्षिक उत्पादन के कारखानाद्वार पर मूल्य का 5 प्रतिशत या 5 लाख रुपये , जो भी कम हो, ऐसे विनिर्माण के लिए अपेक्षित कच्चे माल के ( इस्पात और एल्यूमीनियम से भिन्न ) आयात के लिए; या
( iii) ऐसे विनिधान से उद्भूत वार्षिक उत्पादन के कारखानाद्वार पर मूल्य का 10 प्रतिशत या 5 लाख रुपये , जो भी कम हो , उत्पादन प्रारम्भ होने के तीन वर्ष के पश्चात् किसी भी वर्ष में , ऐसे विनिर्माण के लिए पुर्जों और घटकों के श्रायात के लिए;
(ङ) लघु क्षेत के लिए आरक्षित वस्तुएं. कोई भी ऐसा उपक्रम , अनुसूची 1 लघु क्षेत्र के लिए रिक्षित वस्तुएं ) में विनिर्दिष्ट वस्तुओं में से किसी भी वस्तु के ििनर्माण के लिए छूट का पात्र नहीं होगा :
परन्तु उपर्युक्त मव ( 1 ) , ( 2 ) या ( 3 ) में निर्दिष्ट कोई भी उपक्रम इस अधिसूचना के अधीन छूट का पात्र नहीं होगा , यदि वह अनुसूची 2 में विनिर्दिष्ट उपक्रमों के किसी भी प्रवर्ग के अन्तर्गत आता हो या यदि विनिर्मित THE GAZETTE OF INDIA EXTRAORDINARY

की जाने के लिए प्रस्थापित वस्तु अनुसूची 3 में विनिर्दिष्ट किसी उद्योग से (जो श्रौद्योगिक नीति संकल्प , 1956 की अनुसूची क में यथा विनिर्दिष्ट उद्योग हों ) , या अनुसूची 4 में विनिर्दिष्ट किसी उद्योग से ( जो विशेष विनियम की अपेक्षा करने वाले उद्योग हों ) , सम्बन्धित है ।
2. यह अधिसूचना भारत की निम्नलिखित विनिदिष्ट अधिसूचनाओं को अधिक्रान्त करती है:
(1 ) औद्योगिक विकास , आंतरिक व्यापार और कम्पनी कार्ये मंत्रालय ( औद्योगिक विकास विभाग ) की अधिसूचना स ० का ०आ ० 713. उ ० वि ० वि० श्र०/29ख/ 70.1, तारीख 19 फरवरी , 19701
( 2 ) श्रौद्योगिक विकास , आंतरिक व्यापार और कम्पनी कार्य मंत्रालय ( औद्योगिक विकास विभाग ) की अधिसूचना सं ० का ० श्रा ० 912. उ ० वि ० वि ० श्र ०/ 29 / 70/3, तारीख 28 फरवरी , 1970 ।
( 3 ) औद्योगिक विकास और आंतरिक व्यापार मंत्रालय ( श्रौद्योगिक विकास विभाग ) की अधिसूचना सं ० का ० आ ० 2443 /उ ० वि ० वि ० अ०/ 29 / 70 / 5 , तारीख 18 जुलाई, 1970 1
3. कारबार चलाने के लिए उपबन्ध उक्त अधिनियम की धारा 29 ख की उपधारा ( 2 ) के अनुसरण में, केन्द्रीय सरकार , इस अधिसूचना के प्रकाशन की तारीख से छह मास की अवधि को उस अवधि के रूप में एतद्वारा विनिर्दिष्ट करती है जिसकी समाप्ति के पश्चात् किभी ऐसे औद्योगिक उपक्रम का, जिसे उक्त अधिनियम की धारा 10 , 11 , 11 क और 13 के प्रवर्तन से पहले छूट प्राप्त थी और जिसे इस अधिसूचना के आधार पर छूट नहीं दी गई है, कोई स्वामी , केन्द्रीय सरकार द्वारा इस निमित्त जारी की गई किसी अनुज्ञप्ति के अधीन और उस के अनुसार के सिवाय, और राज्य सरकार की दशा में , केन्द्रीय सरकार की पूर्व अनुज्ञा के अधीन ओर उसके अनुसार के सिवाय ऐसे उपक्रम का कारबार नहीं चलाएगा ।

(लघु क्षत्र के लिए आरक्षित व स्तुएं )
1. अवशोषक रुई ।
2. मोटरगाड़ी रेडियेटर ( गुणों के आधार पर प्रसार के लिए के मिवाय ) ।
3. कटीला तार ।
4. दंड तुला ।
5. बाइक्रोमेट ( निर्यात के लिए के सिवाय ) ।
6. बोल्ट और नट ( उच्च तनन और अन्य विशेष प्रकार के सिवाय ) ।
7. कंड्इट पाइप-धात्विक ।
8. निर्वात क्लीनर , श्रौद्योगिक धुलाई और ड्राई क्लीनिंग मशीनों आदि से भिन्न घरेलू विद्युत साधित्न और उपसाधन जैसे कि विद्युत इस्तरी, रोस्टर , हीटर, धुलाई मशीन आदि ।
9. रंजका ( 1 ) एजो रंजक ( डायरेक्ट्स और अम्ल ) तथा ( 2 ) आधारिक रंजक ।
10. ( क ) विद्युत वारिंग उपसाधन ।
