New Delhi , the 21st Pebruary , 1973
S.O. 103 (E) /18E/IDRA/73.-Whereas , by the Order of the Government of India in the Ministry of Industrial Development , No. S O. 333 ( E)/ 18A/ IDRA/ 72 , dated the 4th May , 1972 issued unner clause (b ) of sub - section ( i ) of section 18A of the Industriesies ( Development and Re- gulation) Act , 1951 (65 of 1951 ) , the Central Government has authorised the Indian Drugs and Pharmaceuticals Limited , New Delhi , to take over the management of the industrial undertaking known as M/ s . Smith . Satanistreet and Company Limited . Calcutta ( hereafter in this order referred to as the industrial undertaking ) for the period specified therein ;
Now, therefore , in exercise of the powers conferred by sub - section ( 2 ) of Secton 18E of the said Act , the Central Government hereby specifics , the exceptions , restrictions , and liml- tation subject to which the Comp anies Act , 1956 ( 1 of 1956) shall continue to apply to the industrial un lertaking in the same manner as it applied thereto before the issue of the order issued unier section 18A .

नई दिल्ली, 21 फरवरी , 1973
का० श्र० 103 ( अ ) / 18 ई ०/ आई ० डी० आर ० ए ० / 73.--यतः केन्द्रीय सरकार ने उद्योग (विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 क की उपधारा ( i) के खंड ( ख ) के अधीन जारी किए गए , भारत सरकार के औद्योगिक विकास मंत्रालय के आदेश सं ०का ०श्रा ० 333 ( ६० )/ 18 ए/ आई ० डी० आर ० ए ० / 72 , तारीख , 4 मई, 1972 द्वारा इंडियन ड्रग्स एंड फार्मास्यूटिकल्स लिमिटेड , नई दिल्ली को, मैसर्स स्मिथ , स्टैनीस्ट्रीट एंड कम्पनी लिमिटेड , कलकत्ता ( जिसे इस आदेश में इसके पश्चात् श्रौद्योगिक उपक्रम कहा गया है ) नामक औद्योगिक उपक्रम का प्रबंध उसमें विनिर्दिष्ट अवधि तक ग्रहण करने के लिए प्राधिकृत किया है ;
अत:, अब , उक्त अधिनियम की धारा 18 ङ की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा वे अपवाद , निर्बन्धन और परिसीमायें विनिर्दिष्ट करती है , जिनके अधीन रहते हुए कम्पनी अधिनियम , 1956 ( 1956 का 1) औद्योगिक उपक्रम को उसी रीति से लागू रहेगा , जैसे वह धारा 18 क के अधीन जारी किए गए आदेश के जारी होने के पूर्व उसे लागू था ।

कम्पनी अधिनियम 1956 के उपबंध
वे अपवाद , निर्बन्धन और परिसीमायें जिनके अधीन रहते हुए स्तम्भ ( 1 ) में उल्लिखित उपबन्ध उपक्रम को लागू होंगे
