No. 42 - ITC ( PN ) /73.-It has been decided to grant licences for import of various commodities from Iran during January - March , 1973 to the established importers , having past Imports within the prescribed basic years , as shown against each item in Annexurekure I to this Public Notice . The licensing policy for each item has been indicated in column 5 of the aforesaid Annexure .
2. The established importers , eligible in terms of the current policy , may submit their applications to the respective licensing authority viz , Joint Chief Controller of Iimports & Exports , Bombay or Joint Chief Controller of Imports and Exports , (Central Licensing Area) New Delhi on or before the 16th April , 1973 , in the usual form and manner . No past import documents are required to be produced , provided such documents were submitted to the licensing authority concerned in the past and were accepted by them for issue of licences for import of commodities from Iran , indicated in Annexure 1. They should , however , quote details of licences obtained in the preceding two periods . Where , however , the established im- porters are applying for the first time , they are required to produce unimpeachable documents relating to past imports from Iran in respect of the items as in Annexure I for any one year within the prescribed basic years .
3. It has also been decided that the importers , who are eligible in terms of Annexure II to this Public Notice will also be granted licences for import of dry fruits only from Iran on equal value basis . They may submit their applications for import of dry fruits only from Iran for January-March , 1973 licensing period to Joint Chief Controller of Imports and Exports , (Central Licensing Arca) , New Delhi on or before the 16th April , 1973 , in the usual form and manner complete in all respects .

4. The minimum value of licences for dry fruits will be Rs . 1,500/ - . It has also been decided that those established importers who were granted minimum value licences for Rs . 3,000/ - for import of dry fruits from Iran , when the quota percentage was 10 per cent , will continue to get minimum value licences for Rs . 1,500/ - notwithstand/- notwithstanding the fact that the quot has now been reduced to 4 per cent . The minimum value of licences for dat Asafoetida and gums and resins , licensable on quota percentage basis , will be Rs . 250/- three months . It is , however , clarified that in the case of transfer / division of quota by established importers relating to above cases , the succeeding parties will be entitled to get licences in pro- portion to their share in approved quota of the original firm as provided in para 45 ( 2 ) of the I.T.C. Hand Book of Rules and Procedure , 1972-73 . Where the licences are issued on equal basis in terms of this Public Notice , the entitlement of each party is to be divided propor- tionately among the split up concerns of the parent firm , in case of transfer / division of quota rights . value
5. It may be noted that no double benefit will be given in respect of dry fruits , which is permitted for import both under Annexure I and Annexure II . The applicants for dry fruits should submit only one application either in terms of Annexure I or in terms of Annexure II ; and they should clearly mention in their application that they have applied in one capacity only and not under both .
6. Established importers , holding quota certificates for Crude Drugs on General Currency Area , which includes Iran , who are desirous of claiming licences under this policy, have to have past imports of Crude drugs from Iran in a different basic year than the one for which theyhold quota certificates on General Currency Area . Evidence to this effect should be produced to the licensing authority , so that no double benefit accrues in respect of the same past imports .
7. Licensing will be done within the monetary limit fixed for each item . All incomplete applications are liable to be rejected .
8. Imports licences granted in cligible cases will be valid for import from Iran either by Sailing Vessels or Land route . In the case of dry fruits , import will also be allowed by Steam- ships upto the full face value of the licence and such imports will be on c.i.f. basis . In the case of ' Dates' import should be effected by Sailing Vessels or Land route upto 60 per cent of the face value of the licences and the balance 40 per cent by other means , viz . , steamerships , if the li- censees so desire , at any time , during the validity period of the licences .
9. Import licences issued in pursuance of this Public Notice will be valid for six months and will not be extended.

विषयः जनवरी-मार्च, 1973 में फलों, मेवे , नमकीन अथवा हर प्रकार के परिरक्षित खजूरों को छोड़कर अन्यथा जो उल्लिखित नहीं हैं [क्र ० सं ० 21 ( ए ) ( 2 ) ( 4) ( 2) ] खजूर क्र ० सं ० 21 ( बी ) / 4 , ( 3 ) औषधीय बूटियां ( अपरिष्कृत श्रौषधियां ) क्र ० सं ० 87-109-4 ( 4) हींग [क्र ० सं ० 31 ( बी ) / 5 ] तथा अन्य विविध मदों का ईराम से आयात
संख्या 42 - आई ० डी ० सी० ( पो एन ) / 72 -प्रस्तुत सार्वजनिक सूचना के अनुबन्ध 1 के लिये दिखाई गई मदों में से हर एक अलग मद के लिये जनवरी- मार्च, 1973 की अवधि के लिये संस्थापित आयातकों को, जिन्होंने विहित आधारभूत वर्ष में आयात किया था , ईरान से विभिन्न पदार्थों के भ्रायात के लिये लाइसेंस देने का निश्चय किया गया है । हर एक मद के लिये लाइसेंस देने की नीति वर्णित अनुबन्ध के कालम 5 में बताई गई है ।
2. वर्तमान आयात नीति के अन्तर्गत योग्य संस्थापित आयातकों को चाहिये कि ये अपना आवेदन पत्र सम्बन्धित लाइसेंस जारी करने वाले प्राधिकारी अथवा संयुक्त मुख्य नियंत्रक, आयात- निर्यात , बम्बई या संयुक्त मुख्य नियंत्रक (के ० ला ० क्षे ० ) , नई दिल्ली को विहित प्रपत्त्र में और विधिरूप से 16 एप्रैल , 1973 तक अथवा उससे पहले भेज दें । पिछले किये गये आयात के सम्बन्ध में निहित दस्तावेजों को प्रस्युत करने की आवश्यकता नहीं है, बशर्ते कि उन लिखित दस्तावेजों को सम्बद्ध लाइसेंस प्राधिकारी को ईरान से पदार्थों के आयात लाइसेसों के लिये , जिन पदार्थों का उल्लेख अनुबन्ध 1 में किया गया, पहले भेजा गया था और वे मंजूर कर लिये गये थे । परन्तु, उनके लिये यह आवश्यक होगा कि उन्होंने पूर्वंगत दो अवधियों में जो लाइसेंस लिये थे, उनका ब्यौरा दें । परन्तु जहां संस्थापित प्रायातक पहली बार पत्र भेज रहे हैं, उन्हें चाहिये कि विहित आधार भूत वर्ष में से किसी भी एक वर्ष में ईरान से आयात की गई मदों का, जिनका ब्यौरा अनुवन्ध 1 में दिया गया है , उससे सम्बन्धित संशयातीत दस्तावेजों को प्रस्तुत करें ।
3. यह भी निश्चय किया गया है कि ऐसे आयातक , जो प्रस्तुत सार्वजनिक सूचना के अनुषन्ध 2 के अन्तर्गत योग्य हैं , उन्हें केवल ईरान से समान मूल्य के आधार पर सूखे फलों के आयात के लिये लाइसेंस भी दिये जायेंगे । उन्हें चाहिये कि वे जनवरी-मार्च, 1973 की लाइसेंस अवधि के लिये ईरान से केवल सूखे फलों के आयात के लिये आवेदन पत्नों को हर प्रकार से पूरा करके विहित प्रपत्र में और विधिरूप से संयुक्त मुख्य नियंत्रक , आयात- निर्यात ( के ० ला ० क्षे ० ) नई दिल्ली को 16 अप्रैल , 1973 तक अथवा उससे पहले भेज दें ।
4. सूखे फलों के लिये लाइसेंसों का न्यूनतम मूल्य 1500 रुपये होगा । इस बात का भी निश्चय किया गया है कि जिस समय कोटा प्रतिशतता 10 प्रतिशत थी, उन संस्थापित आयातकों को जिन्हें ईरान से सूखे फलों के आयात के लिये न्यूनतम मूल्य 3,000 रुपये के लिये लाइसेंस स्वीकृत किये गये थे , इस के बावजूद कि अब कोटा प्रतिशतता घटा कर 4 प्रतिशत कर दी गई है , वे न्यूनतम मूल्य 1,500 रुपये के लिये लाइसेंस प्राप्त करते रहगे । खजूर, हींग और गोंद तथा रेजिस जो कोटा प्रतिशतता के श्राधार पर लाइसेंस के योग्य हैं, उनके लिये 3 भास के लिये लाइसेंस THE GAZETTE OF INDIA EXTRAORDINARY

का न्यूनतम मूल्य 250 रुपये होगा । लेकिन, इस बात का स्पष्टीकरण किया जाता है कि उपर्युक्त मामलों से सम्बन्धित संस्थापित आयातकों द्वारा कोटा के स्थानान्तरण/ विभाजन की स्थिति में आयात ब्यापार नियंत्रण नियम और कार्यविधि , हैण्डबुक, 1972-73 की कंडिका -145 ( 2 ) में दी गई व्यवस्थाओं के अनुसार अनुवर्ती पार्टियां मूल फर्म के स्वीकृत कोटे में से अपने हिस्से के अनुपात में लाइसेंस प्राप्त करने के अधिकारी होंगी । प्रस्तुत सार्वजनिक सूचना के अनुसार जहां सामान्य मूल्य के आधार पर लाइसेंस दिये जाते हैं, कोटा अधिकारों के स्थानान्तरण /विभाजन होने की स्थिति में मूल फर्म से सम्बन्धित विशिष्टि के भीतर हर एक पार्टी के हक का अनुपातिक रूप से आवंटन किया जाता है ।
5. यह ध्यान रहे कि सूखे फल जो अनुबन्ध 1 तथा 2 दोनों के अन्तर्गत आयात के लिये अनुज्ञप्त हैं , इनके सम्बन्ध में दोनों प्रकार के लाभ नहीं दिये जायेंगे । सूखे फलों के आयात करने षाले आवेदकों को चाहिये कि वे या तो अनुबन्ध 1 की शर्तों के अनुसार अथवा अनुबन्ध 2 की शर्तों के अनुसार केवल एक ही आवेदन पत्र भेजें और उन्हें चाहिये कि वे अपने आवेदनपत्नों में स्पष्ट रूप से लिख दें कि उन्होंने केवल एक के लिये आवेदन पत्र भेजा है न कि दोनों के लिये ।
6. सामान्य मुद्रा क्षेत्र , जिसमें ईरान सम्मिलित है, से अपरिष्कृत भेषजों के लिये कोटा- धारी संस्थापित आयातक जो इस नीति के अन्तर्गत लाइसेंस प्राप्त करने के इच्छुक हैं , उनके लिये यह अनिवार्य है कि जिस वर्ष के लिए उनके पास सामान्य मुद्रा क्षेत्र के लिये कोटा प्रमाण पत्न है, उससे भिन्न किसी एक मूल वर्ष में , भूतकाल में उन्होंने ईरान से अपरिष्कृत भेषजों का आयात किया हो । इस सम्बन्ध में, लाइसेंस प्राधिकारी को साक्ष्य प्रस्तुत करना चाहिये जिससे कि भूतकाल में किये गये एक ही प्रकार के आयातों के लिये दो तरफा लाभ उपार्जित न किया जाये ।
7. हर एक मद की निश्चित मैट्रिक सीमा के भीतर ही लाइसेंस दिया जायेगा । सभी अधूरे आवेदन पत्नों को अस्वीकृत कर दिया जायेगा ।
8. वैध मामलों में दिये जाने वाले आयात लाइसेंसों को ईरान से नौ प्रस्थान पोतों अथवा स्थल मार्गों से श्रायात के लिये वैध माना जायेगा । सूखे फलों के मामले में लाइससों के पूरे अंकित मूल्य तक पोतनाव द्वारा आयात करने की भी इजाजत होगी और ऐसे आयातों का आधार लागत- बीमा भाड़ा होगा । खजूरों के आयात के मामले में , 60 प्रतिशत तक के लाइसेंस के अंकित मूल्य तक आयात नौप्रस्थान पोतों अथवा स्थल मार्गों द्वारा होना चाहिये और यदि लाइसेंसधारी लाइसेंस की वैध अवधि के दौरान किसी भी समय आयात करने के इच्छुक हैं तो शेष 40 प्रतिशत दूसरे साधनों जैसे पोत नाव द्वारा कर सकते हैं ।
9. प्रस्तुत सार्वजनिक सूचना के विषय में जारी किये गये लाइसेंस छः मास के लिये वैध होंगे तथा भविष्य में उनकी अवधि नहीं बढ़ायी जायेगी ।
