ORDER
New Delhi , the 31st March 1973
G.S.R. 187 ( E )-Whereas the Central Government is of opinion that it is necessary and expedient so to to for securing the equitable distribution of wheat and wheat products in the diffee States of Ind ! 1;
Now , therefore , in exercise of the powers conferred by section 3 of the Essential Commo- dities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following order , namely : --
1. Shor Title Extent and Commencement .-( 1 ) This Order may be called the Inter - Zonal W'heat and Wheat Products ( Movement Control ) Order , 1973 .
( 2) It extends to the whole of India .
(3 ) It shall come into force on the 1st day of April , 1973 .
2. Definitions . In this Order , unless the context otherwise requires ,-
( a) " export " means to take or cause to be taken , by any means whatsoever , from any place within a Zone to a place outside it ;
(b) " external border area " means the area within a ten - mile belt all along the border lying within those States and Umon territories whose borders are contiguous to the territories of foreign countries ;
( c) " import" means to take or cause to be taken , by any means whatsoever , into any place within a Zone from a place outside it ;

(d) " State Government " means the Government of any State included in a Zone and in- cludes the administrator of a Union territory ;
(c) " wheat includes split wheat and any mixture of wheat and-
(i) gram or barley in which the proportion of wheat exceeds four percent ; of ( ii) other foodgrains in which the proportion of wheat exceeds two percent .
(f) " wheat product " means wholemeal atta , resultant atta , maida . sooji or rawa ;
(g) " Zone " means any of the Zones as specified in the Schedule annexed to this Order ;
(h) " zonal border area " means the area within a five mile belt inside a Zone all along its border whether adjoining-
( i) another Zone , or
(ii) the territories of Nepal , Bhutan and Sikkim .
3. Prohibition of Export and Import of Wheat and Wheat Products.- (1) No person shall export or attempt to export or abet the export of wheat or any wheat product except with the permission in writing of the Central Government or of an offi- cer authorised in that behalf by the Central Government .
(2) No person shall import or attempt to import or a bet the import of wheat or any wheat product except with the permission in writing of the Central Government or of an Officer autho- rised in that behalf by the Central Government:
Provided that nothing contained in sub - clause ( 1 ) or sub - clause ( 2) shall apply to the export or import of wheat or any wheat product-
( 1) on Central Government account ;
( ii) under and in accordance with Military Credit Notes ;
(iii) by or on behalf of the Food Corporation of India established under section 3 of the Food Corporations Act , 1964 ( 37 of 1964 ) ;
(iv) by or on behalf of such public agencies as may be approved by the Central Gove: ment with such conditions as it may impose ;
(v) received by way of gift under the Indo - U.S . Agreement on Relief Supplies , I and despatched to a nominee of the American Voluntary Relief Agency concerned relief purposes ; (vi) by or under the authority of the Dandakaranya Development Authority ;
(vii) not exceeding five kilograms in weight in the aggregate by a bona fide traveller as part of his luggage :
Provided further that it shall be lawful for a person to export or import under and in accor- dance with a permit granted by the State Government having jurisdiction in this behalf subject to such directions as the Central Government may issue from time to time-
( a) seed wheat for bona fide agricultural purposes ; or
(b) wheat produced on land owned or cultivated by the person seeking such export or import for personal domestic consumption at his place of residence ;
4. Restriction on the Movement of Wheat or Wheat Products to or Within the Zonal Border Arca. No person shall move , attempt to move or abet the movement of wheat or any wheat product-
(a) to any place in the zonal border area from any place outside that area ; or (b) from any place in the zonal border area to any other place in that area ,
except under and in accordance with a permit issued by the State Government having jurisdiction in this behalf or by an officer authorised in that behalf by that Government ;
Provided that nothing in this clause shall apply to the movement of wheat or any wheat pro- duct from one part of Nepal to another through the interlying territory of Uttar Pradesh .
5. Restriction on the Movement of Wheat or Wheat Products to or Within the External Border Area . No person shall move , attempt to move or abet the movement of wheat or any wheat product-
(a) to any place in the external border area from any place outside that arca ; or (b) from any place in the external border area to any other place in that area , except under and in accordance with a permit issued by the State Government having jurisdiction in this behalf or by an officer authorised in that behalf by that Government .

6. EXEMPTION FOR BORDER AREAS . Nothing contained in clause 4 or clause 5 shall apply to the movement of wheat or any wheat product , as the case may be ,-
( i ) on Central Government account ;
(ii ) under and in accordance with Military Credit Notes ;
(iii) within the same town or village in the zonal border area or in the external border area ;
(iv) not exceeding ten kilograms in weight in the aggregate at a time by a bon aſule resident of the zonal border area or of the external border area for domestic consumption ;
(v) by or on behalf of the Food Corporation of India established under section 3 of the Food Corporations Act , 1964 ( 37 of 1964 ) ;
(vi) by or on behalf of such public agencies as may be approved by the Central Govern- ment in this behalf , with such conditions as it may impose ;
(vii) received by way of gift under the Indo - U.S . Agreement on Relief Supplies , 1968 , and despatched to a nominee of the American Voluntary Relief Agency concerned for relief purposes ; (viii) from a village in the zonal border area or in the external border arca to the nearest grain market ( mandi ) for the purpose of sale , whether such market is within or outside any such area;
( ix) by or under the authority of the Dandakaranya Development Authority ;
(x) not exceeding five kilograms in weight in the aggregate by a bonafide traveller as part of his luggage .
7. POWERS OF ENTRY , EXAMINATION , SEARCH AND SEIZURE .-( 1 ) An police officer not below the rank of Assistant Sub - Inspector or any other officer authorised in this behalf by the Central Government or the State Government having jurisdiction may , with a view to securing compliance with this Order or to satisfying himself that this Order has been complied with :-
(a) stop and search any person or any boat , motor or other vehicle or any receptacle used or intended to be used for the export or import or movement of wheat or any whea product ;
(b) enter , search or examine any place ;
(c) scize-
(i) any stock of wheat or wheat product in respect of which he has reason to believe that a contravention of any of the provisions of this Order has been , is being , or is about to be committed ; and
(ii) any packages , coverings or receptacles in which such stock of wheat or wheat product is found ; and
(iii) the animals , vehicles , vessels , or other conveyances used in carrying such stoct ofwheat or wheat product if he has reason to believe that such animals , vehicles vessels or other conveyances are liable to be forfeited under the provisions of the Essential Commodities Act , 1955 '10 of 1955) ,
and there after take or authorise the taking of all measures necessary for securing the production of the packages , coverings , receptacles , animals , vehicles , vessels or other conveyances so seized in a court and for their safe custody pending such production ;
(d) examine or seize any books of accounts or documents which in his opinion wouldbe useful for , or relevant to , any proceedings in repect of any contravention of this Order and return such books of accounts and documents to the person from whom they were seized after copies thereof or extracts therefrom as certified by that person have been taken .
(2) The provisions of sections 102 and 103 of the Code of Criminal Procedure , 1898 ( 5 of 1898 ) , relating to search and seizure shall , so far as may be apply to searches and seizures under this clause .
8. EFFECT OF ORDER . The provisions of this Order shall have effect notwithstanding anything inconsistent there with contained in any other law for the time being in force .
9. Repeal an Saving .. The Gujarat Wheat ( Export Control ) Order , 1973 issued by the State Government of Gujarat and the Uttar Pradesh Wheat and Wheat Products ( Movement Control ) Order , 1973 issued by the State Government of Uttar Pradesh are hereby repealed , except as respects things done or omitted to be done before such repcal .

आदेश

सा० का ० नि० 187 (अ ) -यतः केन्द्रीय सरकार की गय है कि भारत के विभिन्न राज्यों में गेहूं और गेहूं - उत्पाद का समान वितरण कराने के लिये ऐसा करना आवश्यक और समीचीन है :
अतः अब श्रावश्यक वस्तु अधिनियम 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार निम्नलिखित श्रादेश देनी है , अर्थात्: --
1. संक्षिप्त नाम , विस्तार और प्रारम्भ ( 1 ) इस आदेश का नाम अंतः क्षेत्रीय गेहूं और गेहूं - उत्पाद ( संचलन नियंत्रण ) आदेश , 1973 है ।

( 2 ) इसका विस्तार सम्पूर्ण भाग्त पर है ।
( 3 ) यह पहली अप्रैल , 1973 से प्रभावी होगा ।
2. परिभाषाएं:-जब तक संदर्भ में अन्यथा अपेक्षित न हो , इस श्रादेश में
( क) " निर्यात " से क्षेत्र में किसी स्थान से उमके बाह्र किमी स्थान को किन्हीं भी साधनों द्वारा ले जाना या लिवाया जाना अभिप्रेत है ;
(ख ) "बाह्य सीमा क्षेत्र " से उन राज्यों और संघ राज्य क्षेत्रों में , जिनकी सीमाएँ विदेशी राज्य क्षेत्तों में लगी हुई हैं , सारी सीमा के साथ साथ दस मील के अन्तर्गत आने वाले इलाके का क्षेत्र अभिप्रेत है ;
(ग) " आयात" मे क्षेत्र के बाह्र किमी स्थान मे क्षेत्र के भीतर किमी स्थान को किन्हीं भी माधनों द्वारा ले जाना या लिवाया जाना श्रभिप्रेत है ;
(घ) "राज्य सरकार " से किसी क्षेत्र में सम्मिलित किसी राज्य की सरकार जिसमें संघ राज्य क्षेत्र का प्रशासक भी मम्मिलिन है , अभिप्रेत है ;
( ङ) "गेहूं " में दला हुआ गेहूं और गेहूं का और
( i ) चना या जौ जिम में गेहूं का अनुपात चार प्रतिशत से अधिक हो; या ( ii ) श्रन्य खाद्यान्न जिनमें गेहूं का अनुपान दो प्रतिशत में अधिक हो का कोई मिश्रण सम्मिलित है ।
(च) " गेहूं- उत्पाद " से अनछना आटा, परिणामित श्राटा, मैदा , मूजी या रवा अभि- प्रेत है ;
( छ) "क्षेत्र " से इस आदेश से उपाबद्ध अनुसूची में यथा विनिर्दिष्ट क्षेत्रों में से कोई क्षेत्त श्रभिप्रेत है ;
(ज) " क्षेत्रीय सीमा क्षेत्र " से किमी क्षेत्र में उसकी मारी सीमा के माथ साथ पांच मील के अन्तर्गत आने वाले इलाके का क्षेत्र अभिप्रेत है , चाहे वह
( i ) किसी अन्य क्षेत्र, या
( ii ) नेपाल, भूटान और सिक्किम के राज्य क्षेत्रों से मिला हो ।
3. गहू और गेहूं - उत्पाद के निर्यात और प्रायात का निषेध :--
(1) कोई व्यक्ति, सिवाए केन्द्रीय सरकार या केन्द्रीय सरकार द्वारा इस निमित प्राधि- कृत अधिकारी की लिखित अनुमति के, गेहूं या किसी गेहूं- उत्पाद का निर्यात या निर्यात करने का यत्न या निर्यात के लिए दुष्प्रेरणा नहीं करेगा ।
( 2 ) कोई व्यक्ति, सिवाए केन्द्रीय सरकार या केन्द्रीय सरकार द्वारा इम निमित प्राधिकृत अधिकारी की त्रिखित अनुमति के, आयात या आयात करने का यत्न या आयान के गेहूं या किसी गेहूं- उत्पाद का लिए दुप्रेरण नहीं करेगा ।

परन्तु उपखण्ड ( 1 ) या उपखण्ड ( 2 ) में की कोई बात गेहूं या किसी गेहूं-उत्पाद के निम्नलिखित की बाबत , निर्यात या श्रयात पर लागू नहीं होगी
(i) केन्द्रीय सरकार के खाते पर ;
( ii ) सेना जमा-पत्त्रों के अधीन और के अनुमार ;
( iii ) खाद्य निगम अधिनियम , 1964 ( 1964 का 37 ) की धारा 3 के अधीन स्थापित भारतीय खाद्य निगम के द्वारा या की ओर में ;
( iv) केन्द्रीय सरकार द्वारा, ऐसी शर्तों के माथ , जो वह अधिरोपित करे , अनुमोदित लोक -अभिकरणों द्वारा या की ओर से ;
( V) सहायता प्रदाय के लिए भारत -अमरीकी करार , 1968 के अन्तर्गत दान के रूप में प्राप्त और सहायता प्रयोजनों के लिए सम्बद्ध श्रमरीकी स्वैच्छिक सहायता अभिकरण के नामित को प्रेषित ;
( V1 ) दण्डकारण्य विकास प्राधिकरण के प्राधिकार द्वारा या के अधीन ;
( vii ) वास्तविक यात्री द्वारा अपने सामान के भाग के रूप में वज़न में कुल पांच किलोग्राम से अधिक 1
परन्तु यह ओर कि ऐसे निदेशों के अधीन , जिन्हें केन्द्रीय सरकार समय -समय पर जारी करे , इस निमित अधिकारिता रखने वाली राज्य सरकार द्वारा दिए गए परमिट के अधीन और के अनुसार किसी व्यक्ति द्वारा निर्यान या आयात करना विधिपूर्ण होगा--
( क) वास्तविक कृषि प्रयोजनों के लिए बीज -गेहूं ; या
(ख ) अपने निवास स्थान पर वैयक्तिक घरेलू उपभोग के लिए ऐमे निर्यात या आयात के इच्छुक व्यक्ति द्वारा अपनी या कृष्ट भूमि पर उत्पादित गेहूं ।
4. क्षेत्रीय सीमा क्षेत्र को या के भीतर गेहूं या गेहूं- उत्पाद के संत्रालत पर प्रतिबंधः-- कोई व्यक्ति निम्नलिखित स्थानों को--
( क) क्षेत्रीय सीमा क्षेत्र के बाहर के किसी स्थान से क्षेत्रीय सीमा क्षेत्र के अन्दर किसी स्थान को; या
( ख ) क्षेत्रीय सीमा क्षेत्र में किसी स्थान से उस क्षेत्र में के किसी अन्य स्थान को ,
निमित उस मरकार और उसके अनुसार मिवाए इस निमित श्रधिकारिता रखने वाली राज्य सरकार द्वारा या इस द्वारा प्राधिकृत किमी अधिकारी द्वारा जारी किए गए परमिट के अधीन गेहूं या ने उत्पाद का संचलन , संक्लन का यत्न या संचलन का दुष्प्रेरण नहीं करेगा ।
परन्तु इस खण्ड की कोई बात उत्तर प्रदेश के बीच में पड़ने वाले इलाके से होकर नेपाल के एक भाग में दूसरे भाग को गेहूं या किसी गेहूं- उत्पाद के संचलन पर लागू नही होगी ।

5. बाह्य सीमा क्षेत्र को या में गेहूं या गेहूं- उत्पाद के संवलन पर प्रतिबंध.- कोई व्यक्ति निम्नलिखित स्थानों को
(क ) बाह्य सीमा क्षेत्र के बाहर के किसी स्थान से बाह्य सीमा क्षेत्र के अन्दर किसी स्थान को ; या
(ख ) बाह्य सीमा क्षेत्र में किसी स्थान में उम क्षेत्र में के किसी अन्य स्थान को, सिवाए इस निमित्त अधिकारिता रखने वाली राज्य सरकार द्वारा या इस निमित उम सरकार द्वारा प्राधिकृत किसी अधिकारी द्वारा जारी किए गए परमिट के अधीन और उस के अनुसार , गेहूं या गेहूं - उत्पाद का संचलन का प्रयत्न या संचलन का दुष्प्रेरण नहीं करेगा ।
6. सीमा क्षेत्रों के लिए छूट-खण्ड 4 और खण्ड किसी गेहूं उत्पाद के संचलन को निम्नलिखित की बाबन , 5 की कोई बात यथास्थिति गेहूं या लागू नहीं होगी: --
( i) केन्द्रीय सरकार के खाने पर;
( ii ) सेना जमापन्नों के अधीन और के अनुमार ;
( iii ) क्षेत्रीय सीमा क्षेत्र का वाह्य मीमा क्षेत्र में उसी नगर या गांव के भीतर ;
( iv) घरेलू उपभोग के लिए क्षेत्रीय सीमा क्षेत्र या बाह्य सीमा क्षेत्र के वास्तविक निवासी द्वारा किसी एक समय में वजन में कुल दस किलोग्राम से अनधिक ;
( V) ब्राद्य निगम अधिनियम , 1964 ( 1964का 37 ) की धारा 3 के अधीन स्थापित भारतीय खाद्य निगम के द्वारा या की ओर से ;
( Vi ) केन्द्रीय सरकार द्वारा , ऐसी गर्तों के साथ जो वह श्रधिरोपित करे, अनुमोदित लोक अभिकरणों द्वारा या की ओर से ;
( Vii ) सहायता प्रदाय के लिए भारत अमरीकी करार , 1958 के अन्तर्गत दान के रूप में प्राप्त महायता प्रयोजनों के लिए सम्बद्ध अमरीकी स्वैच्छिक सहायता अभिकरण के निमित को प्रेषित ;
( Viii ) विक्रय के प्रयोजमनों के लिए क्षेत्रीय सीमा क्षेत्र या बाह्य सीमा क्षेत्र में किसी गांव से निकटतम अनाज मंडी को , चाहे वह मंडी किसी ऐसे क्षेत्र के भीतर या बाहर हो ;
( ix ) दण्डकारण्य विकास प्राधिकरण के प्राधिकार द्वारा या के अधीन
( X) वास्तविक यात्री द्वारा अपने सामान के भाग के रूप में वजन में शुत्र पांत्र किलोग्राम में अनधिक ।
7. प्रवेश, परीक्षा , तलाश और अभिग्रहण को शक्तियां ( 1 ) कोई पुलिस अधिकारी जो महायक उपनिरीक्षक की पंक्ति मे नीचे का न हो या केन्द्रीय सरकार या अधिकारिता रखने वाली राज्य सरकार द्वारा इस निमित प्राधिकृत कोई अन्य THE GAZETTE OF INDIA EXTRAORDINARY

अधिकारी , इस आदेश का पालन कराने की दृष्टि से या अपने समाधान के लिए कि इस आदेश का पालन हो गया है:-
(क) गेहूं या किसी गेहूं-उत्पाद के निर्यात या श्रायात या संचलन के लिए प्रयुक्त या प्रयोग के लिए आशयित किसी व्यक्ति या किसी नाव , मोटर या अन्य यान या किसी पात्र को रोक सकेंगा और उम की तलाशी ले सकेगा ।
(ख ) किसी स्थान में प्रवेश , तलाशी या परीक्षण कर सकेगा 1
(ग) निम्नलिखित का अभिग्रहण कर सकेगा
( i ) गेहूं या गेहूं- उत्पाद के किसी स्टाक का जिसकी बाबत उसे यह विश्वास करने का कारण है कि इस आदेश के उपबंधों में से किसी का उल्लंघन किया गया है, किया जा रहा है या किया जाने वाला है ; और
( ii ) गेहूं या गेहूं- उत्पाद का ऐसा स्टाक जिन किन्हीं पैकेजों, आवरणों और पात्रों में पाया गया है , का ; और
( iii) यदि यह विश्वास करने का कारण है कि आवश्यक वस्तु अधिनियम 1955 (1955 का 10 ) के उपबंधों के अधीन ऐसे पशु , यान , जलपान या अन्य वाहन ममपहरण के दायित्वधीन है तो गेहूं या गेहूं -उत्पाद के ऐसे स्टाक के ढोने में प्रयुक्त पशुओं , यानों जलयानों या अन्य वाहनों का, और उसके पश्चात्इस प्रकार का श्रभिग्रहीत पैकेजों, आवरणों पात्रों, पशुओं, यानों, जलयानों या अन्य वाहनों को न्यायालय में पेश करने के लिए ऐसी पेशगी के लंबित रहने तक उन के सुरक्षित अभिरक्षण के लिए आवश्यक सभी उपाय कर सकेगा या करने के लिए प्राधिकृत कर सकेगा ।
(घ) किन्हीं लेखा पुस्तकों या दस्तावेजों , जो उसके विचार में इस आदेश के किसी उल्लंघन की बाबत किन्हीं कार्यवाहियों के लिए उपयोगी या सुसंगत हों, का परीक्षण या श्रधिग्रहण और उस व्यक्त्ति द्वारा यथा प्रमाणित उन लेखा पुस्तकों और या दस्तावेजों की नक्लें या उन से उद्धरण लेने के पश्चात् ऐसीलेखा पुस्तकों और दस्तावेजों को उस व्यक्ति को लौटा सकेगा जिस से कि वे अभिग्रहण किए गए थे ।
( 2) तलाणी और अभिग्रहण से सम्बधित दंड प्रक्रिया संहिता 1898 ( 1898 का 5) की धारा 102 और 103 के उपबंध , यथासंभव इम खण्ड के अधीन तलाशियों और अभिग्रहणों को लागू होंगे ।
8. श्रादेश का प्रभाव. इस आदेश के उपबंध , इम समय प्रवृत्त किसी अन्य विधि में, उन से श्रसंगत किसी बात के होते हुए भी, प्रभावी होंगे ।
9. निरसन अ के , गुजरात राज्य सरकार 1973 और उत्तर प्रदेश यावृति-सिवाए ऐमे निरसन से पहले किए गए या न किए गए कार्यों द्वारा जारी किया गया गुजरात गेहूं ( निर्यात नियंत्रण ) आदेश , राज्य सरकार द्वारा जारी किया गया गेहूं और गेहूं - उत्पाद ( संचलन नियंत्रण ) आदेश , 1973 , एतद्वारा निरसित किया जाता है ।
