ORDER
New Delhi, the 1st April , 1973
G. S. R. 189 (E ) .- In exercise of the powers conferred by section 3 of the Essential Commodities Act , 1955 ( 10 of 1955 ) the Central Government hereby makes the following Order namely :
1. Short title extent and commencement . ( 1 ) This Order may be called the light Diesel Oil (Fixation of Ceiling Prices ) Order , 1973-
( 2) It extends to the States of Punjab , Rajasthan , Gujarat and Haryana .
(3) It shall come into force on the 1st day of April , 1973 .
2. Definition . In this Order , unless the context otherwise requires-
(a) " dealer" means a person carrying on the business of selling Light Diesel Oil , whether wholesale or retail and whether in conjunction with any other business or not , and includes-
(i ) his representative or agent ; and
(ii) an oil company making wholesale supply from its storage or selling point ;
(b) " declared price" , in relation to Light Diesel Oil sold in any area in the State, means the maximum selling price declared in accordance with the provisions of clause 3- ( 1) by the State Government or District Collector in the case of an area in the State , or

(2) by such officer as the State Government may empower in this behalf, as the price at which the Light Diesel Oil is to be sold by a dealer in that area from the date of commencement of this Order or from the date of the declaration of price by any of the aforesaid authorities ;
(c) the expression " Light Diesel Oil " shall have the meaning assigned to it in Item No. 9 of the First Schedule to the Central Excises and Salt Act , 1944 , ( I of 1944) ;
(d) " schedule price " , in relation to Light Diesel Oil sold in any arca in the State means the price of Light Diesel Oil at the nearest main port or the refinery , as the case may be, as indicated in the Schedule appended to this Order . 3. Fixation of maximum selling price of Light Diesel Oll . On and from the date of commencement of this Order , no dealer shall sell Light Diesel Oil to any person at a price which is in excess of the declared price which shall include the following , namely:
(a) the schedule price ;
(b) the increase or decrease , if any , in Central duties after the date of commencement of this Order as the Central Government may , by notification in the Official Gazette specify in this behalf;
(c) the rate of dealers ' commission at six rupees and sixty paise per kilo litre subject to the State Government or with the previous approval of the State Government , the District Collector or the Deputy Commissioner of the area , as the case may be , allpw- ing, by notification in the Official Gazette , reimbursement of any extraordinary. expenditure which the dealers may have to incur under local conditions ;
(d) (i ) the railway freight actually payable on the date of commencement of this Order for transporting the quantity of Light Diesel Oil from the nearest port of installation or the refinery , as the case may be , to the place of sale and the increase or decrease , if any , in such freight after that date;
(ii ) the road transportation charges actually payable on the date of commencement of this Order for the transportation of supplies of Light Diesel Oil by road by the dealer from the nearest storage or selling point of any oil company to the place of sale, as the State Government or with the previous approval of the State Government, the District Collector or the Deputy Commissioner of an area in the State may, having regard to the transportation charges payable for the transportation of goods by the shortest route , allow and the increase or decrease therein , if any , after that date ;
(c) the sales tax and any other local tax payable on the date of commencement of this Order on the quantity of Light Diesel Oil , and the increase or decrease, if any, there in after that date ;
(f) the surcharge , if any, over the prices mentioned in the Schedule appended to this Order which may be imposed by the Central Government from time to time .
4. Light Diesel Oil stock to be displayed:---Every dealer shall cause to be prominently displayed on a special board to be maintained for this purpose at or near the entrance of the place of sale-
(a) the stocks of Light Diesel Oil held by him from time to time and ready for delivery ;
b) the declared price of Light Diesel Oil ; and
( (c) the price at which he proposes to sell Light Diesel Oil .
5. Prohibition against withholding Light Diesel Oil from sale. No dealer having stock of Light Diesel Oil shall withhold it from sale .
6. Inspection an maintenance of books of account , documents and records.- Any officer authorised in this behalf by the State Government in relation to an area in a State may, with a view to securing compliance with this Order-
(a) require the dealer to maintain and produce for inspection such books of account or other documents and records relating to his business and to furnish such information relating thereto , as he may specify ; and
(b) prescribe the manner in which accounts of sale or purchase of or other transactions in Light Diesel Oil shall be kept .
7. Power of entry, search and seizure.-( 1 ) Any officer authorised in this behalf by the State Government in relation to an area in a State may , with a view to securing compliance with this Order or to satisfying himself that this Order has been complied with and with such assistance if any , as he thinks fit-
(a) enter , inspect or break open and search any place or premises , vehicle or vessel which he has reason to believe has been or is being used for the contravention of this Order and THE GAZETTE OF INDIA EXTRAORDINARY

(b) search , seize and remove stocks of Light Diesel Oil and the animals , vehicles , vessels or other conveyance used in carrying Light Diesel Oil in contravention of the pro- visions of this Order , and thereafter take or authorise the taking of all measures neces- sary for securing the production of the said stocks and the animals , vehicles , vessels or other conveyance so seized , in a court and for their safe custody pending such production .
(2) The provisions of sections 102 and 103 of the Code of Criminal Procedure , 1898 ( 5 of 1898 ) , relating to search and seizure shall , so far as may be , apply to searches and seizures under this Order .
8. Provisions of the order to prevail over previous Orders of State Govern- ments . The provisions of this Order shall have effect notwithstanding anything to the contrary contained in any Order made by the State Government or by any Officer of the State Government before the date of commencement of this Order , except as respects anything done or omitted to be done thereunder before such commencement .

सा ० का ० नि ० 189 ( अ) श्रावश्यक वस्तु अधिनियम, 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय सरकार निम्नलिखित आदेश करती है , अर्थातः-
1. संक्षिप्त नाम , विस्तार और प्रारम्भ ( 1 ) इस आवेश का नाम हल्का डीजल -तेल (अधिकतम की मतों का नियतन ) आदेश , 1973 है ।
( 2) इसका विस्तार पंजाब , राजस्थान , गुजरात और हरियाणा राज्यों पर है ।
( 3) यह 1973 के अप्रैल के प्रथम दिन को प्रवृत्त होगा ।
2. परिभाषाएं. इस आदेश मे , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो- ( क ) " व्यवहारी " से ऐसा व्यक्ति अभिप्रेत है जो हलके डीजल - तेल के विक्रय का कारबार कर रहा हो , चाहे थोक हो या फुटकर हो और चाहे किसी अन्य कारबार के साथ साथ हो या न हो, और इसमें--
( i ) उसका प्रतिनिधि या श्रभिकर्ता; और
( ii ) कोई तेल कम्पनी , जो अपने भंडार या विक्रय केन्द्र से थोक प्रदाय कर रही है , सम्मिलित है ;
(ख ) राज्य के किसी क्षेत्र में विक्रय किए गए हल्के डीजल -तेल के संबंध में, " घोषित कीमत " से-
( i ) राज्य के किसी क्षेत्र की दशा में राज्य सरकार या जिला कलक्टर द्वारा , या
( ii ) ऐसे अधिकारी द्वारा , जैसा राज्य सरकार इस निमित सशक्त करे , खण्ड 3 के उपबंधों के अनुसार ऐसी कीमत के रुप मे घोषित अधिकतम विक्रय कीमत अभिप्रेत है , जिस पर किसी व्यवहारी द्वारा उस क्षेत्र में इस आदेश के प्रारंम्भ से या पूर्वोक्त में से किसी प्राधिकारी द्वारा कीमत की घोषणा की तारीख से हल्का डीजल-तेल बेचा जाता है ;

(ग ) " हल्का डीजल -तेल " पद का अर्थ वही होगा , जो उसे केन्द्रीय उत्पाद शुल्कऔर नमक अधिनियम , 1944 ( 1944 का 1 ) की प्रथम अनुसूची की मद सं ० 9 में दिया गया है ;
(घ) राज्य के किसी क्षेत्र में विक्रय किये गये हल्के डीजल तेल के संबंध में ' अनुसूक्ति कीमत'- से इस श्रादेश से संलग्न अनुसूची में यथाउपदर्शित , यथास्थिति, निकटतम मुख्य पत्तन या परिष्करणी पर हल्के डीजल -तेल की कीमत अभिप्रेत है ।
3. हल्के डीजल तेल की अधिकतम विक्रय कीमत का नियतल. इस आदेश के प्रारंम्भ की तारीख को और से , कोई भी व्यवहारी किसी व्यक्ति को उस कीमत पर हल्के डीजल -तेल का विक्रय नही करेंगा, जो घोषित कीमत मे, जिसमें निम्नलिलिखत सम्मिलित होगा, अधिक हो, अन्पतिः-
(क) अनुसूचित कीमत;
(ख ) इस आदेश के प्रारंम्भ की तारीख के पश्चात् केन्द्रीय शुल्को में वृद्धि या कमी , यदि कोई हो, जैसा कि केन्द्रीय सरकार राजपत्र में अधिसूचना द्वारा इस निमित विनिर्दिष्ट करें;
( ग ) ब्यौहारी का, राज्य सरकार या राज्य सरकार , जिलों समाहती प्रथमा क्षेत्रीय उपायुक्त की पुर्वं अनुमति से जैसी भी स्थिति हो शासकीय राज पत्न में अधिसूचना द्वारा किसी असाधारण खाचें की जिसे स्थानीय परिस्थितियो के अन्तर्गत व्यौहारी को उपगत करना पड़े , प्रतिपूर्ति को अनुशात करने के अध्यधोन छह रुपये साठ पैसे प्रति किलोलीटर की दर से कमीशन ।
( घ) ( i ) इस आवेश के प्रारंम्भ की तारीख को हल्के डीजल -तेल की मात्रा, यथास्थिति निकटतम संस्थापन या परिष्कारणी से विक्रय स्थान तक परिवहन करने के लिए वस्तुतः संदेह रेंल भाड़ा और उस तारीख के पश्चात् ऐसे भाड़े में बुद्धि या कमी , यदि कोई हो ।
( ii ) इस आदेश के प्रारंम्भ की तारीख को व्यवहारी द्वारा हल्के डीजल -तेल के प्रवायों के, किसी तेल कंपनी के निकटतम भंडार या विक्रय केन्द्र से विक्रय स्थान तक सड़क द्वारा परिवहन करने के लिये वस्तुतः संदेह सड़क परिवहन प्रभार, जो राज्य सरकार या राज्य सरकार के पूर्व अनुमोदन 'से जिला कलक्टर'या राज्य के किसी क्षेत्र का उपायुक्त, माल'का सबसे छोटे मार्ग द्वारा परिवहन करने के लिए संदेय परिवहन प्रभार को ध्यान में रखते हुए श्रनुज्ञातं करे और उस तारीख के पश्चात् उसमें वृद्धिया या कमी, यदि कोई हो ;
(ङ) इस आदेश के प्रारम्भ की तारीख को हल्के डीजल -तेल की मात्रा पर संदेह विक्रय कर और अन्य स्थानीय कर और उस तारीख के पश्चात् उसमें वृद्धि या कभी , यदि कोई हो ;
(च) इस आदेश से संलग्न अनुसूची में वर्णित कीमतों पर अधिभार, यदि कोई हो, जो केन्द्रीय सरकार द्वारा समय , समय पर अधिरोपित किया जाए ।
4. हल्के डीजल - तेल स्टाक का संप्रदर्शित किया जाना. प्रत्येक व्यत्त्रहारी विक्रय स्थान पर या उसके प्रवेश के समीप हम प्रयोजन के लिये रखे गए विशेष बोर्ड पर--
(क ) समय समय पर उसके पास रखे और परिदान के लिए तैयार हल्के डीजल -तेल के स्टाक ;
(ख ) हल्के डीजल तेल की घोषित कोमत ; और
(ग ) वह कीमत, जिस पर वह हल्के डीजल -तेल को विक्रय करने की प्रस्थापना करता है, मुख्य रुप से संत्रदर्शित कराएगा ।
5. हल्के डीजल-तेल को बिक्री से विधारित करने के विरुद्ध प्रतिषेधः-हल्के डीजल -तेल का स्टाक रखने वाला कोई भी व्यवहारी उसको बिक्री से निर्धारित नहीं करेगा ।

6. लेखा- बहियों, दस्तावेजों, और अभिलेखो का निरीक्षण और उनको बनाए रखना-किसी राज्य के किसी क्षेत्र के सबंध में राज्य सरकार द्वारा इस निमित्त प्राधिकृत कोई अधिकारी , इस आदेश का अनुपालन सुनिश्चित करने की दृष्टि से--
( क ) किसी व्यवहारी से उसके कारबार से संबंधित ऐसी लेखा बहियों या अन्य दस्तावेजों और अभिलेखों को निरीक्षण के लिए बनाए रखने और पेश करने की और उससे संबधित ऐसी जानकारी जैसी वह विनिर्दिष्ट करें , देने की अपेक्षा कर रकेगा ; और
( ख ) वह रीति विहित कर सकेगा, जिसमें हल्के डीजल -तेल की बिक्री या क्रय या अन्य संव्यवहार का खाता रखा जाएगा ।
7. प्रवेश तलाशी और श्रभिग्रहण की शक्ति ( 1 ) किसी राज्य के किसी क्षेत्र के संबंध में राज्य सरकार द्वारा इस निमित्त प्राधिकृत कोई अधिकारी , इस आदेश का अनुपालन सुनिश्चित करने की दृष्टि से या अपना यह ममाधान करने के लिए कि इस आदेश का अनुपालन किया गया है और ऐसी महायता , यदि कोई हो, सहित जैसा वह ठीक समझे--
( क ) किसी स्थान या परिसर, यान या जलयान में, जिसके लिए उसके पास विश्वास करने का कारण है कि इस आदेश के उल्लंघन के लिए प्रयोग किया गया है या किया जा रहा है , प्रवेण कर सकेगा उसका निरीक्षण कर या उमे तोड़ कर उसमें घुस सकेगा तथा उसकी तलाशी ले सकेगा , और
( ख ) हल्के डीजल-तेल के स्टाक की और इस आदेश के उपबंधों के उल्लघंन में प्रयुक्त पशुओं, यानों, जलयानों या अन्य गाड़ियों की तलाशी ले सकेगा, उसका श्रभिग्रहण कर सकेगा और उसे हटा सकेगा और तत्पश्चात् इस प्रकार अभिगृहीत उक्त स्टाक और पशुओं , यानों, जलयानों या अन्य गाड़ियों को न्यायालय में पेश करने के लिए सुनिश्चित करने हेतु और इस प्रकार पेश किए जाने तक उनकी सुरक्षित श्रभिरक्षा के लिए सभी आवश्यक उपाय कर सकेगा या करने के लिए प्राधिकृत कर सकेगा ।
( 2 ) दण्ड प्रक्रिया महता, 1898 ( 1898 का 5) की धारा 102 और 103 के तलाशी और अभिग्रहण से संबंधित उपबंध भावन्यणक्य इम आदेश के अधीन तलाशी और अभिग्रहण को लागू होंगे ।
१. इस आदेश के उपबंधों का राज्य सरकारों के पूर्व आदेशों पर श्रभिभाषी होना.- इस आदेश के प्रारम्भ की तारीख के पूर्व राज्य सरकार या राज्य सरकार के किसी अधिकारी द्वारा किए गए किमी आदश में अन्तर्विष्ट क्रिसी बात के प्रतिकूल होने हुए भी इस आदेश के उपबंध , ऐसे प्रारम्भ के पूर्वं उसके अधीन की गई या की जाने से रह गई क्रिपी बात की बाबत के मिवाय , प्रभावी होगे ।
