S. O. 2I7(E).—In pursuance of clause (a) of sub-section (2) of section 9 of the Delimitation Act, 1972 (76 of 1972), read with the second proviso to section 4 of the said Act, and sections 3 and 39 of the Government of Union Territories Act, 1963 (20 of 1963), the Delimitation Commission hereby publishes its proposals together with dissenting proposals for the delimitation of the 30 single member territorial constituencies assigned to the Legislative Assembly of the Union Territory of Pondicherry and specifies 12th May, 1973, as the date on or after which the proposals will be further considered by it.

Any objection or suggestion in regard to these proposals should reach the Secretary, De- limitation Commission, Nirvachan Sadan, Ashok Road, New Delhi (Pin-noooi), befor the said date. It will facilitate prompt consideration if the objections and suggestions are sent in English and a copy of the representation is also endorsed to the Chief Electoral Officer, Pondicherry.

Proposals

(1) The territorial constitutencies into which the Union Territory of Pondicherry shall be delimited for the purpose of elections to the legislative Assembly of the Union Territory and the extent of each such constituency, shall be as shown in the Table below.

(2) Where the name of a constituency as shown in the Table is distinguished by the brackets and letters "(SC)", the seat in that constituency is reserved for the Scheduled Castes.

Yesterday, when I attended the meeting of the Delimitation Commission iu Pondichcrry, the Chairman was of the view that the distribution of seats in various regions of the Union Territory of Pondicherry may be as follows :

The reason attributed for the above view was that the population of the Union Territory .ihaffl~bc distributed equally, as far as possible, among all constituences in all the four regions. But, as the Chairman and Members of the Commission are aware, all the five Associate Mem- bewftf the Commission have expressed their •unanimous view that the allocation of seats In the Union Territory shall be as follows, as at present, and that the status quo shall be maintained because of the popular feelinjrs:

difference between these two. It may not also be proper to vary the extent of the constituencies often and often on a bigger scale. (The last delimitation allocating 20 seats for Pondicherry region and 7 seats for Karaikal region was done for General Elections held in the year 1969). Talking all these into consdicration, I am of the firm view that no alteration In the distribution of seats in different regions shallbe made and thestatut quo shall be maintained.

*NOTE. No longer unanimous since other parties gave alternative suggestions which

have been duly considered.

4. Assuming that the Delimitation Commission will agree to my suggestion to allocate 20 seats for Pondicherry region, 7 seats for Karaikal region, 2 seats for Mahe region and iseat for Yapam region, I consider that no alteration need be made in my letter dated 5th April, 1973 addressed to the Chairman and Members of the Commission, which is enclosed herewith. ,

5. I hope that the Commission will give its benign consideration to all my suggestions madein this letter as well as in my letter dated 5th April 1973 and order the delimitation of Assembly consti- tuencies in the Union Territory of Pondicherry as shown in the Annexure to my letter dated 5th April, 1973-

I have carefully gone through all the records sent to me on the delimitation of Assembly consti- tuencies in the Union Territory of Pondicherry, particularly the Delimitation Proposals.

2. I find from the Delimitation Proposals that it has been proposed to allot 21 seats for Pondi- cherry region, 6 seats for Karaikal region, 2 scats for Mahe region and 1 seat for Yanam region. In this connection I want to state that the Union Territory of Pondicherry consists of four separate enclaves, vl-. Pondicherry, Karaikal, Mahe and Yanam. There are 20 constituencies inPondichcrry region, 7 constituencies in Karaikal region, 2 constituencies in Mahe region and 1 constituency in Yanam region. The average population (1971 Census) per seat comes to 17,012 in Pondichcrry region, 14,371 in Karaikal region, 11,567 in Mahe region and 8,291 in Yanam region. Since the average population per sent in Karaikal and Pondicherry regions are not so high, it may not be necessary to reduce the number of constituencies in Karaikal region from 7 to 6. Moreover, the people of that region may not also want to minimise the number of their representatives in the Assembly from 7 to 6. It would therefore be in fitness of things if the natut quo, i.e. 7 constituen- cies in Karaikal region, is maintained.

3. By allowing to continue 7 constituencies as at present in Karaikal region, the allotment of scats in the Union Territorty of Pondicherry will come as follows :—

To effect this alteration, I have made some minor changes in the Delimitation proposals which was prepared and sent to me by the Commission. In fact I have retained as it is the Delimitation Proposals in respect of 8 constituencies. In so far as the constituencies in Oulgaret and Villianur communes arc concerned, I suggested the Extent of those constituencies (with those of 1971 Census figures) as was for General Elections, 1969. Consequential minor changes have been made in the cases of other constituencies. In suggesting these changes, I have given due weightage to practical considerations, compactness and contiguity of the areas, facilities of communications and public conveniences and popular feeling.

4. Alter carrying out the changes proposed by me in the extent of constituencies, the seats reserved for Scheduled Castes will be as follows :

Even though the percentage of Scheduled Caste population in No. 10—Kuruvinatham cons tuegcy comes to 33- 70, I have not suggested that constituency for the Scheduled Caste for the reawm that the Scheduled Caste reserved seats shall be distributed in different parts of the Union Territory j in accordance with section 9(i)(c) of the Delimitation Act, 1972.

5. My suggestions for delimiting the Assembly constituencies in the Union Territory of

Pondicherry have been shown in Anncxure.

6. I hope that the Delimitation Commission will kindly approve all my suggestions BB well

as the names uroposcd and delimit the constituencies, as stated in the Annexuie of this letter.
