NOTIFICATION

New Delhi, the 15th April, 1973

S.O. 249(E) Whereas the Central Government is of the opinion that it is necessary and expedient so to do for securing the equitable distribution of fertilisers in the States of India ;

''New, therefore, in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 (10 of 1955), the Central Government hereby makes the following Order, namely:—

1. Short Title and commencement.—(1) This Order may be called the Fertiliser (Movement Control) Order, 1973.

(2) It shall come into force on the date of its publication in the Official Gazette. 2. Definitions.—In this Order unless the context otherwise requires,

(a) 'export' means to take or cause to be taken out of any place within a State to any place outside that State;

(b) ' fertiliser' shall have the same meaning as in item (d) of clause 2 Of the Fertiliser (Control) Order, 1957 ;

(c) 'State' includes a Union Territory and State Government' in relation to a Union Territory means the Administrator thereof.

3. Prohibition of export of fertilisers.—No person shall export, or atterftpt to export, or abet the export of. any Jertiliser from any State :

Provided that nothing in this clause shall apply to the escpoi t ol fertilisers—

(Y) bv any of the manufacturers specified in column 2 of the Schedule to this Order if such fertilisers arc manufactured and exported from the location specified in the cor- lesponding entry in column 1 of the said Schedule ; or

ru) by or on behalf ol the Food Corporation ot India established under Section 3 of the Food Corporations Act, 1964 (37 of 1964) ; or

1111 bv or on bjhilf of th • Central "Warehousing Corporation established under Section 3 ol the Warehousing Cjrp irations Act, 1962 l^S ot 1962) ; or

liv by or on beh ilf ot the State Wai#iousing Corporations eatabliahed under Section 18 of the Warehousing C irpcnations Act, 1962 (58 of 1962¹) ; or

(v) by the Indian Potash Limited , or JI) und r mid iu accordance with an authontj issued by the Government of India, Ministry of Agriculture or the Director ot Agriculture ot a State Government or anj other Offlcei authorised by the State Government in this behalf.

4. Powers of entry, search, seizure etc (ii Any Inspector of fertilisers appointed under Clause 19 of the Fertiliser (Control)j Order, 1957 or am Police Oflicer not below the rank of a head constable or any oilier person authorised in this behalf by the Central Government or the Slate Government may, with a view to securing compliance with this Ofdci or to satisfy himself that this Order has been complied with,

(a) stop and -.rar^h, or autorise any person to stop and search, anv pei wii. boat, motor 01 any other \ehicle or anv receptacle used or intended to be used for the export of fertilisers ;

b) enter and seatcli OL authorise any person to enter and search anv place ;
