8.Ο. 250 (E) / 18FB / IDRA / 73 . Whereas by the Order of the Government of India in the Ministry of Industrial Development No. S.O. 137 (E)/ 18A/ IDRA / 73 , dated the 12th March 1973 , the management of the industrial undertaking known as M/ s Hindustan Tractors Limited , Vishwamitri , Baroda ( hereinafter in this Order referred to as the indus- trial undertaking ) has been taken over under clause ( b ) of sub - section ( i) of section 18A of the Industries ( Development and Regulation ) Act, 1951 ( 65 of 1951 ) for a period of five years commencing from the 12th March 1973 :
And whereas the Central Government is satisfied that it is necessary so to do in the interests of the general public with a view to preventing fall in the volume of production in the scheduled industry , namely Tractors:

Now , therefore , in exercise of the powers conferred by clause (b) of sub- section ( i) of section 18 - FB of the said Act , the Central Government hereby declares that the operation of all contracts ,, assurances of property , agreements , settlements , awards , standing orders or other instruments in force immediately before the date of issue of this order (other than those relating to liabilities to banks and financial institutions ) to which the said industrial undertaking or the company owning such undertaking is a party or which may be appli- cable to such industrial undertaking or company shall remain suspended for a period of one year from the date of issue of this order and that all the rights , privileges , obligations and liabilities accruing or arising thereunder before the said date shall remain suspended for the said period .

का० श्र ० 250 ( अ ) 18 वस / आई ० डी ० आर ० ए ० / 73.-यतः भारत सरकार के औद्योगिक विकास मंत्रालय के श्रादेण स ० का ० आ ० 137 ( अ ) / 18 क/ आई० डी० आर ० ए ० / 73, तारीख 12 मार्च , 1973 द्वारा मैमर्स हिन्दुस्तान ट्रैक्टर्स लिमिटेड , विश्वामित्र, बड़ौदा नामक औद्योगिक उपक्रम का ( जिसे इम आदेश में इसके पश्चात् औद्योगिक उपक्रम, कहा गया है ) प्रबन्ध, उद्योग ( विकाम और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 क की उपधारा ( 1 ) के खण्ड ( ख ) के अधीन 12 मार्च , 1973 मे प्रारम्भ होने वाली पाच वर्ष की अवधि के लिए ग्रहण कर लिया गया है:
और यतः केन्द्रीय सरकार का यह समाधान हो गया है कि अनुसूचित उद्योग , अर्थान ट्रैक्टर्स , में उत्पादन के परिणाम में कमी को रोकने की व्रष्टि से जनसाधारण के हितों में ऐसा करना आवश्यक है:
अतः अब , उक्त अधिनियम की धारा 18 - चख की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय सरकार यह घोषणा करती है कि डम श्रादेश के जारी होने की नारीख के ठीक पूर्व प्रवृत्त ऐसी मभी संविधाओं, सम्पत्ति के हस्तान्तरण - पत्रों , करारों , व्यवस्थापनों , पश्चाटो, स्थायी आदेशों या अन्य लिखतो का , ( उनसे भिन्न, जो बैंकों और वित्तीय संस्थाओं के दायित्वों से संबंधित है ) प्रवर्तन , जिनका उक्त औद्योगिक उपक्रम या ऐसे उपक्रम का स्वामित्व रखने THE GAZETTE OF INDIA EXTRAORDINARY

वाली कम्पनी एक पक्षकार है या जो ऐसे श्रौद्योगिक उपक्रम या कम्पनी को लागू हों, इस आवेश के जारी होने की तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख के पूर्व उनके अधीन प्रोदभूत या उद्भूत होने वाले सभी अधिकार , विशेषाधिकार, बाध्यताएं और दायित्व उक्त अवधि के लिए निलम्बित रहेंगे ।
