NOTIFICATION
New Delhi , the 30th June 1973
G.S.R. 330 ( E ) . In exercise of the powers conferred by section 3 of the Essen- tial Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order further to amend the Light Diesel Oil ( Fixation of Ceiling Prices ) Order , 1973 :
1. ( 1 ) This Order may be called the Light Diesel Oil (Fixation of Ceiling Prices ) Second Amendment Order , 1973 .
(2) It shall come into force on the date of its publication in the Official Gazette,
2. In the Light Diesel Or. ( Fixation of Ceiling Prices) Order , 1973 (hereinafter referred to as the said Oraer ) , in paragraph 1 , for clause ( 2) and ( 3 ) , the follow- ing clauses shall be substituted , namely : -
'(2) It extends to the whole of India .
( 3 ) It shall come into force in the States of Punjab , Rajasthan , Guzrat and Haryana on the 1st day of April , 1973 and in the remaining States and in the Union territories on the date of publication of the Light Diesel Oil ( Fixation of Ceiling Prices ) Second Amendment Order , 1973 in the Official Gazette and any reference in this Order to " the date of commencement of this Order " shall , in relation to any State or Union territory , mean the date on which this Order comes into force in such State or Union territory. ' .

3. In paragraph 2 of the said Order ,一
(a) in clause (b ) , in sub - clause ( 1 ) , the words " in the case of an area in the . State" shall be omitted ;
(b) after clause ( d) , the following clauses shall be inserted , namely: - '( e) " State " includes a Union territory;
( 1) " State Government " , in relation to a Union territory , means the Administrator thereof appointed by the President under article 239 of the Constitution .' .
4. In paragraph 3 of the said Order , in clause ( 3 ) , the words " as the Central Government may , by notification in the Official Gazette , specify in this behalf" shall be omitted.
5. In the Schedule to the said Order , after item ( b ) , the following items shall be inserted , namely :-

सा० का ० नि ० 330 ( श्र) -श्रावश्यक वस्तु अधिनियम 1955 ( 1955 का 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , लाइट डीजल आयल ( अधिकतम कीमतों का नियतन) आदेश , 1973 का और संशोधन करने के लिये केन्द्रीय सरकार एतद्वारा निम्नलिखित आदेश बनाती है:--
( अधिकतम कीमतों का नियतन ) , दूसरा जासकेगा । 1. ( 1 ) यह आदेश लाइट डीजल आयल संशोधन आदेश, 1973 कहा
प्रकाशन की तारीख को प्रवृत्त होगा । ( 2 ) यह शासकीय राजपत्र में अपने
2. लाइट डीजल आयल ( अधिकतम कीमतों का भियतन ) आदेश , 1973 ( इस में इस के पश्चात उक्त आदेश कहा गया है) में, पैराग्राफ-1 में, धाराओं ( 2 ) और ( 3 ) के लिने , निम्नलिखित धाराएं प्रतिस्थापित की जाएंगी; अर्थातः-
' ( 2 ) इस का विस्तार सम्पूर्ण भारत पर है ।
( 3 ) यह पंजाब , राजस्थान , गुजरात और हरियाणा के राज्यों में अप्रैल, 1973 के प्रथम दिन से लागू होगा और शेष राज्यों में तथा संघ राज्य क्षेत्रों में शासकीय राजपत्र में लाइट डीजल आयल ( अधिकतम कीमतों का नियतन) द्वितीय संशोधन आदेश , 1973 प्रकाशन की तारीख को प्रवृत्त होगा और इस आवेश में " इस आदेश के लागू होने की तारीख " संबंधी कोई संदर्भ, किसी राज्य या संघ राज्य क्षेत्र के संबंध में , का तात्पर्य उस तारीख से होगा जिस तारीख को ऐसे राज्य या संघ राज्य क्षेत्र में यह आदेश प्रवृत्त होगा । ' SEC . 3 ( 1 ) ]

3. उक्त भ्रादेश के पैराग्राफ 2 में:-
( क) धारा ( ख ) में , उपधारा ( I ) में , शब्द " राज्य में किसी क्षेत्र के बारे में" निकाल दिये जाएंगे ,
(ख ) धारा ( ध) के पश्चात निम्नलिखित धाराएं जोड़ी जाएंगी , अर्थात्ः---
' ( ङ) " राज्य" में एक संघ राज्य क्षेत्र शामिल है ;
(च) " राज्य सरकार " संघ राज्य क्षेत्र के बारे में, का तात्पर्य संविधान के अनुच्छेद 239 के अधीन राष्ट्रपति द्वारा नियुक्त उस के प्रशासक से है' ।
4. उक्त आदेश के पैराग्राफ 3 में , धारा ( ख ) में, शब्द "जैसा कि केन्द्रीय सरकार, निकाल दिये जाएंगे । शासकीय राजपत्त्र में अधिसूचना द्वारा , इस बारे में विनिर्दिष्ट करे"
5. उक्त आदेश की अनुसूची में, मद ( ख ) के पश्चात् जाएंगी, अर्थात्ः-- निम्नलिखित मदें जोड़ी
रुपये 385.66 " ( ग ) कलकत्ता/ गोहाटी । दिग्बोई/बरौनी
