G.S.R. 338 ( E ) . In exercise of the powers conferred by sub - section ( 3 ) of section 9 of the Salaries and Allowances of Members of Parliament Act , 1954 (30 of 1954 ) , the Joint Committee constituted under sub - section ( 1 ) of that section , after consultation with the Central Government , hereby makes the following rules further to amend the Members of Parliament ( Travelling and Daily Allowances) Rules , 1957 , the same having been approved and confirmed by the Chairman of the Council of States , and the Speaker of the House of the People , as required by sub - section ( 4) of the said section , namely :-
1. ( 1 ) These rules may be called the Members of Parliament ( Travelling and Daily Allowances ) Amendment Rules , 1973 .
( 2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Members of Parliament ( Travelling and Daily Allowances ) Rules , 1957, after rule 3 , the following rule shall be inserted , namely: -
" 3 -A ( 1) Save as otherwise provided in these rules , the air fare referred to in clause ( b ) of sub - section ( 1 ) of section 4, or in clause ( b) of section 5 shall be calculated by the direct route:
Provided that where there are more routes than one , the air fare shall be calculated by the route by which a Member may most speedily reach his destination .

(2) Where the direct route is temporarily closed , or there is no service on a particular day , and the journey is performed by the Member by the next cheapest route , the air fare shall be allowed by that route.
(3 ) Where it is not convenient for a Member to travel by the direct route , he may travel by any route more convenient to him and in such a case, he shall be allowed an amount which is equal to-
( 1 ) the air fare by the route by which he had actually travelled , or ( ii) the air fare by the direct route plus a sum of rupees one hundred and twenty,
whichever is less .
(4) Where a Member travels by a circuitous air - cum - rail route , he shall be allowed travelling allowance under section 4 for the journey actually performed by air -cum - rall or the travelling allowance by air by the direct route , whichever is less :
Provided that where the air portion of the journey performed is less than half the total distance by the direct route , the travelling allowance by air shall be allowed for the distance actually travelled by air and for the remainder of the journey , travelling allowance by rail shall be allowed by working out the total rail mileage by the direct route from the starting point to the destination and reducing therefrom the rall mileage from the starting point upto the place a Member travelled by air .
( 5 ) Where a Member had actually performed his journey by air under section 4 or section 5, he shall produce the counterfoil of the air ticket :
Provided that where the counterfoil is lost or has been misplaced , the Member shall produce a certificate from the Indian Airlines for having performed the journey by air . "

सा० का ० ति ० 338 ( च) संसद् सदस्यों के संबलमों और भत्तों से सम्बन्धित अधिनियम, 1954 ( 1954 का 30 ) की धारा 9 की उपधारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उस धारा की उपधारा ( 1 ) के अधीन गठित संयुक्त समिति, केन्द्रीय सरकार से परामर्श के पश्चात् संसद्-सवस्य ( यात्रा और दैनिक भत्ते) नियम, 1957 में भौर संशोधन करने के लिए निम्नलिखित नियम एतद्वारा बनाती है, जो उक्त धारा की उपधारा ( 4 ) द्वारा यथा- अपेक्षित राज्य सभा के सभापति और लोक सभा के अध्यक्ष द्वारा अनुमोदित और पुष्ट कर दिए गए हैं , अर्थात्:-
1. ( 1) इस नियमों का नाम संसद्सवस्य ( यात्रा और दैनिक भत्ते ) संशोधन नियम , 1973 है ।
( 2) ये राजपत्ता में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. संसद्सदस्य (यात्रा और दैनिक भत्ते ) नियम, 1957 में, नियम 3 के पश्चात , निम्नलिखित नियम अन्तः स्थापित किया जाएगा , अर्थात्:--
" 3-क, ( 1 ) इन नियमों में यथा अन्यथा उपबन्धिप्त के सिवाय , धारा 4 की उपधार ( 1 ) के खण्ड ( ख ) या धारा 5 के खण्ड ( ख) में निर्दिष्ट विमान किराया सीधे रास्ते से संगठित किया जाएगा ;

परन्तु जहां एक से अधिक मार्ग हैं, वहां विमान किराया उस रास्ते से संगणित किया जाएगा, जिसके द्वारा सदस्य अपने गंतव्य स्थान पर अतिशीघ्रता से पहुंच जाए ।
( 2) जहां मीधा मार्ग अस्थायी रूप से बन्द कर दिया गया है या किसी विशिष्ट दिन पर कोई सेवा उपलब्ध नहीं है , और सदस्य ने अगले सस्ते से सस्ते मार्ग द्वारा यात्रा की है ; उस मार्ग से विमान किराया अनुज्ञात किया जाएगा ।
( 3 ) जहां किसी सदस्य के लिए सीधे मार्ग से यात्रा करना सुविधापूर्ण नहीं है , वहां , वह अधिक सुविधापूर्ण किसी मार्ग द्वारा यात्रा कर सकेगा और ऐसी बशा में, उसे निम्नलिखित के बराबर रकम अनुज्ञात की जाएगी--
( i) उस मार्ग से विमान किराया, जिससे उसने वास्तविक रूप से यात्रा की है, या
( ii ) सीधे मार्ग द्वारा विमान किराया धन , और एक सौ बीस रु ० की रकम, जो कुछ भी कम हो ।
( 4 ) जहां कोई सदस्य चक्रदार वायु-एवं-रेल मार्ग द्वारा यात्रा करता है , वहां उसे वायु - एवं - रेल द्वारा की गई वास्तविक यात्रा के लिए धारा 4 के अधीन यात्रा-भत्ता, या सीधे मार्ग द्वारा विमान का यात्रा- भत्ता, जो कुछ भी कम हो , अनुज्ञात किया जाएगा :
परन्तु जहां की गई यात्रा का विमान यात्रा भाग सीधे मार्ग द्वारा यात्रा के कुल अन्तर के आधे से कम है , वहां विमान द्वारा की गई वास्तविक यात्रा के अन्तर के लिए विमान का यात्रा- भत्ता अनुज्ञाप्त किया जाएगा और बाकी यात्रा के लिए प्रारम्भिक स्थान से गंतव्य स्थान तक सीधे मार्ग द्वारा फुल रेल- मील- भत्ता निकाल कर और उससे प्रारम्भिक स्थान से जो तक सदस्य ने विमान द्वारा यात्रा की है उस स्थान तक रेल- मोल -भत्ते की कटौती करके , रेल द्वारा यात्रा- भत्ता अनुज्ञाप्त किया खाएगा ।
( 5) जहां किसी सदस्य ने धारा 4 या धारा 5 के अधीन विमान द्वारा अपनी यात्रा वास्तविक रूप से की थी, वहां वह विमान के टिकट का प्रतिपर्ण पेश करेगा:
परन्तुजहां प्रतिपर्ण नष्ट हो गया है या कहीं खोया गया है , वहां सदस्य इंडियन एयर लाइन्स से विमान द्वारा यात्रा किए जाने का प्रमाण-पत्र पेश करेगा ।
