SUBJECT : Import Policy for Registered Exporters for the period April 1973 -March 1974 .

No. 114 - ITC (PN)/73.- Attention is invited to the import policy for Registered Exporters as contained in the Red Book (Vol . II ) for the period April , 1973 -March , 1974 , published under the Ministry of Commerce Public Notice No. 46- ITC (PN)/ 73 dated the 2nd April , 1973 .
2. The following amendments may be made in Part ' C ' , Section I of the Red Book (Vol . II) pertaining to eligible Export Houses :-

The existing sub - para 11 (1 ) may be substituted by the following :- "Eligible Export Houses may acquire by transfer the licences issued to Registered Exporters or their nominees under the import policy for Registered Exporters , provided that an Export House shall not be allowed to acquire by transfer during

the licensing period licences for an aggregate value of more than 25 % of the f.o.b. value of exports of the non - traditional ng group ( s) mentionedmentione in para 9 above , effected by the Export Houseouse during However , in order to encourage Export Houses to increase their export performance , the facility of acquiring licences by transfer may be increased to 33-1 / 3 % on the additional export performance during 1972-73 as compared to 1971-72 . A statement in the proforma annexed to this Public Notice , and certified by an authorised dealer in foreign exchange or a Chartered Accountant , indicating the f.o.b. value of exports during 1972-73 as admissible for this purpose, should be furnished to the licensing authority with which the Export House is registered under sub - para ( ii ) below . The Export Houses claiming the benefit of additional export performance should also furnish a similar statement in respect of their exports during 1971-72 . "

23 After the existing sub - para ( iii ) , the following new sub - para may be added :-
Para 12 "(iv) If an Eligible Export House claims an import replenishment licence in its own name against its own exports pertaining to a product outside the product group ( s ) for which the Export House has been granted Eligibility Certificate , it can ask for only those items which are indicated in Col. 4 against the product exported . If the product exported has no item in Col. 4, the Export House may be allowed import items appear- ing in a valid and unexpired A.U. licence of its supporting manufacturer issued for the same end - product as the exported product . The restrictions / conditions indicated in Col. 5 of Section II in respectpect of any import items will also be appli- cable while allowing such items to Export Houses ." ANNEXURE

भाग "सी" वर्तमान उप -पारा 11 ( 1 ) को' निम्नलिखित के ---द्वारा प्रतिस्थापित किया जाएः-
पारा ( 11 ) ( 1 ) " पास्न निर्यात सदन पंजीकृत निर्यातकों के लिए आयात नीति के अन्तर्गत पंजीकृत निर्यातकों या उनके नामजदों को जारी किए गए लाइसेंसों को हस्ता- न्तरण द्वारा प्राप्त कर सकत है , बशर्ते कि एक निर्यात सदन को 1972-73 वर्ष के दौरान निर्यात सदन द्वारा प्रभावित उपर्युक्त पारा ( 9 ) में उल्लिखित उत्पाद वर्ग ( वर्गो ) के भीतर आने बाली गैर परम्परागत मदों के निर्यातों के जहाज पर निशुल्क मूल्य के 25 प्रतिशत से अधिक के कुल मूल्य के लिए लाइसेंस अवधि के दौरान स्थानान्तरण द्वारा लाइसेंस प्राप्त करने की अनुमति नहीं दी जाएगी । लेकिन , निर्यात सदनों को उनके निर्यात निष्पादन में उन्नति करने के लिए प्रोत्साहन देने के विचार से स्थानान्तरण द्वारा लाइसेंस प्राप्त करने की सुविधा 1971-72 वर्ष की तुलना में 1972-73 के दौरान अतिरिक्त निर्यात निष्पादन पर 33 प्रतिशत तक की वृद्धि दी जा सकती है । इस सार्वजनिक्का (PART I-SEC . 1 ]

सूचना में अनुबन्धित और विदशी मुद्रा देने में प्राधि- कृत व्यापारी या सनदी लेखापाल द्वारा प्रमाणित प्रपत्त्र में एक विवरण उस लाइसेंस प्राधिकारी को भजना चाहिए जिसके पास निर्यात सदन नीचे के पारा ( 2 ) के अन्तर्गत पंजीकृत है और उसमें इस उद्देश्य के लिए यथा अनुमेय 1972-73 के दौरान के निर्यातों के जहाज पर निःशुल्क मूल्य का भी संकेत करना चाहिए । "

भाग "सी"
वर्तमान उप -पारा ( 3 ) के बाद निम्नलिखित नया
उप-पारा को जोड़ा जाए:--
पारा 12 " ( 4) यदि एक पात्र निर्यात मदन उस उत्पाद वर्ग ( वर्गो ) से बाहर के उत्पाद के सम्बन्ध में अपने खुद निर्यातों के मद्दे अपने खुद के नाम में एक आयात प्रतिपूति लाइसेंस का दावा करता है जिसके लिए निर्यात सदन को पात्रता प्रमाण -पत्र जारी कर दिया गया है , तो यह केवल उन्हीं मदों के लिए मांग कर सकता है जो निर्यातित उत्पाद के सामने के कालम 4 में संकेतित है । यदि निर्यात उत्पाद के लिए कालम 4 में कोई मद नहीं है तो निर्यात सदन को उसको सहयोग देने वाले विनिर्माता के वैध तथा समाप्त नहीं हुए उस लाइसेंस में आए हुए मदों के आयात की स्वीकृप्ति दी जा सकती है जो लाइसेंस निर्यातित उत्पाद के रूप में उसी अन्तिम उत्पाद के लिए जारी किया गया था । निर्यात सदनों को इस प्रकार की मदोंकी स्वीकृति देते समय खंड 2 के कालम 5 में संकेलिप्त प्रतिबन्ध / शर्ते किसी श्रायात मषों के सम्बन्ध में भी लागू होंगे । " 934
