NOTIFICATION
New Delhi , the 16th July 1973
S.O. 397 (E) .-Whereas the Central Government is satisfied that in relation to the textile undertakings specified in column ( 2 ) of the Schedule to this notification ( hereinafter referred to as the said industrial undertakings ) it is necessary so to do in the interest of the general public with a view to preventing the fall in the volume of production of the textile industry ;
Now, therefore , in exercise of the powers conferred by clause ( b) of sub - section ( 1 ) of section 7 of the Sick Textile Undertakings ( Taking Over of Management) Act , 1972 ( 72 of 1972) the Central Government hereby declares that the operation of all the contracts , assur- ances of property , agreements , settlements , awards , standing orders or other instruments in force immediately before the date of issue of this notification to which the said industrial under- takings or the companies owning such undertakings as specified in column ( 3 ) of the said Sche- dule are parties or which may be applicable to the said industrial undertakings or companies , shall remain suspended for a period of one year from such date and that all the rights , privileges ' obligations and liabilities ( except those relating to banks and financial institutions ) accruing or arising thereunder before the said date shall remain suspended for the said period .

का० प्रा ० 397 ( प्र) यतः केन्द्रीय सरकार का समाधान हो गया है कि इस अधिसूचना की अनुसूची के स्तंभ ( 2 ) में विनिदिष्ट कनड़ा उपक्रमों ( जिन्हें इसमें इसके पश्चात उक्त औद्योगिक उपक्रम कहा गया है ) के संबंध में, कपड़ा उद्योग के उत्पादन की मात्रा में गिरावट को रोकने की दृष्टि से, लोक हित में ऐसा करना आवश्यक है ;
अतः , अब , रुग्ण कपड़ा उपक्रम ( प्रबन्ध -ग्रहण) , अधिनियम , 1972 ( 1972 का 72) की धारा 7 की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार यह घोषित करती है कि इस अधिसूचना के जारी किए जाने की तारीख से ठीका पूर्व प्रवृत्त ऐसी सभी संविदाओं, सम्पत्ति के हस्तान्तरणों, करारों , ठहरावों, पंचाटों, स्थायी आदेशों या अन्य लिखितों का , जिनकी एक पक्षकार उक्त औद्योगिक उपक्रम या उक्त अनुसूची के स्तम्भ ( 3) में यथाविनिर्दिष्ट ऐसे उपक्रम का स्वामित्व रखने वाली कम्पनी है या जो उक्त श्रौद्योगिक उपक्रमों या कम्पनियों को लागू होता हो, प्रवर्तन ऐसी तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व उनके अधीन उपगत या उत्पन्न होने वाले सभी अधिकार , विशेषाधिकार , बाध्यताएं और दायित्व ( सिवाय उनके जो बैंकों तथा वित्तीय संस्थाओं से सम्बन्धित हैं) , उक्त अवधि के लिए निलम्बित रहेंगे ।
