3. O. 417 (E) - In exercise of the powers conferred by clause ( 3 ) of the article 77 of the Constitution, the President hereby makes the following rules further to amend the Government of India (Allocation of Business) Rules , 1961 , namely:-
1. ( 1 ) These rules may be called the Government of India (Allocation of Business) (Ninety- ninth Amendment) Rules , 1973 .
(2) They shall come into force at once .
2. In the Second Schedule to the Government of India ( Allocation of Business ) Rules , 1961 :-
(A) under the heading " MINISTRY OF COMMERCE ( VANIJYA MANTRALAYA) " and under sub -heading "A. DEPARTMENT OF FOREIGN TRADE (VIDESH VYAPAR VIBHAG )" for the existing entries , the following entries shall be subs- tituted , namely:-
" I. General International Trade Policy
1. International Commercial Policy .
2. International agencies principally connected with commercial policy ( e.g. , UNCTAD, ECAFE , ECA, ECIA , EEC , EFTA , GATT ) .
3. International Commodity Agreements other than agreements relating to Wheat .
4.All matters relating to international trade policy including tariff and non- tariff barriers .

5. Tariff Commission ( The Tariff Commission Act , 1951 ) ,Tariff Protection to Industries , International Customs Tariff Bureau ,
II . Foreign Trade
6. All matters relating to foreign trade including trade negotiations and agreements (in- cluding General Agreement on Tariffs and Trade and Commonweatlh Tariff Preferen- ces), trade missions and delegations , trade cooperation and promotion, and protection of interests of Indian traders abroad .
7. Development and expansion of export production in relation to all commodities , products , manufactures , and semi - manufactures including the following:
(a) agricultural produce within the meaning of the Agricultural Produce ( Grading and Marking ) Act , 1937 ( 1 of 1937) ;
(b) marine products;
(c) industrial products (engineering goods , chemicals , plastics , leather products etc.) ;
(d) fuels , minerals and mineral products ;
(e) specific export - oriented products ( textiles , jute products , handicrafts , plantation crops etc. ) which are directly the charge of this Department .
8. All organisations and institutions connected with the provision of services relating to the export effort including :
(a) Export Credit and Guarantee Corporation.
(b) Export Inspection Council .
(c) (c) Directorate General of Commercial Intelligence and Statistics .
(d) Directorate of Exhibitions and Commercial Publicity .
(c) Free Trade Zones .
9. Projects and programmes for stimulating and assisting the export effort .
10. Import and Export Trade Policy and Control excluding the matters relating to ---
(i) import of feature films ;
(if) export of Indian films-both feature length and shorts ; and (iii) import and distribution of cine - film (unexposed ) and other goods required by the film industry.
11. Chief Controller of Imports and Exports .
III . Export - oriented Industries
12. Production, distribution ( for domestic consumption and exports ) and development of :
(a) All textiles , including handlooms and readymade garments , but excluding industries relating to the production of silk and non - cellulosic synthetic fibres ( nylon, terylene polyester , acrylic ) .
(b) jute .
(c) handicrafts .
(d) plantation crops , tea , coffee , rubber and cardamom.
13. ( i) Textile Commissioner .
(ii) Jute Commissioner .
(iii) Cottontton Corporation of India Ltd. (iv) Jute Corporation of India Ltd.

B) under the heading " MINISTRY OF HOME AFFAIRS ( GRIH MANTRALAYA) " after entry 41 , the following entries shall be inserted, namely:-
"41A . Government servants having families in Pakistan-cases regarding grant of per- mission to Government servants to visit Pakistan.
41B . Matters relating to Code of Conduct for Legislators .
41C. Code of Conduct for Minister .
41D. Employment of wives or dependents of Government servants in foreign Missions in India .
41E . Exchange of visits between Civil and Military Officers .
41F . Declaration of a service as an essential service and where other Ministries propose to issue notifications in this behalf , consideration of such proposals ." ;
(C) under the heading " MINISTRY OF INFORMATION AND BROADCASTING ( SOOCHANA AUR PRASARAN MANTRALAYA ) " , for entries 3 to 10 under sub - item "II. Films" , the following entries shall be substituted,be substituted, namely: ---
"3. ( i ) import of films feature - length and shorts for Theatrical and non -Theatrical use ;
(ii) export of Indian films-feature- length and shorts ;
(iii) import and distribution of cine - film ( unexposed ) and other goods required by the film industry .
4. ( i) Production and distribution of documentaries and newsreels and other films and film strips for internal and external publicity .
( ii) Creation of distribution and exhibition chains for films .
5. Developmental and promotional activities relating to film industry , including teaching and research .
6. ( 1 ) Legislation under entry 60 of the Union List , viz . , " Sanctioning of Cinematograph Films for Exhibition" .
(11 ) Administration of Cinematograph Act , 1952 , which includes-
(a) Examination and certification of cinematograph films for pulic exhibition by the Central Board of Film Censors ; and
(b) Regulation of exhibitions by means of cinematograph in Union Territories .
7. Grant of State Awards for films produced in India ,
8. Grants to Children's Film Society.
9. Implementation of the recommendations of the Film Enquiry Committee .
10. The National Film Corporation and the Indian Motion Pictures Export Corporation (IMPEC) ." ;

राष्ट्रर्पाल, मंविधान के अनुच्छेद 77 के खण्ड ( 3 ) द्वारा प्रदश का० ग्रा ० 417 ( श्र ) शक्तियो का प्रयोग करते हुए , भारत सरकार ( कार्य-श्रावंटन ) नियम , 1961 मे और संशोधन करने के लिए निम्नलिखित नियम बनाते है , अर्थात्:--
1 ( 1) इन नियमों का नाम भारत सरकार ' ( कार्य-आवंटन ) ( निन्यानवा संशोधन) नियम, 1973 है ।

( 2) ये सुरम्स प्रवृत होंगे ।
2. भारत सरकार ( कार्य-आवंटन ) नियम , 1961 की द्वितीय अनुसूची में -- ( क) " वाणिज्य मंत्रालय " शीर्षक के अन्तर्गत भौर "विदेश व्यापार विभाग " उप -शीर्षक के अन्तर्गत विद्यमान प्रविष्टियों के स्थान पर मिम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्ः- " I. साधारण अन्तर्राष्ट्रीय व्यापार नीति
1. अन्तर्राष्ट्रीय वाणिज्य नीति ।
2 वाणिज्यक नीति मे मुख्यता सम्बन्धित अन्तर्राष्ट्रीय अभिकरण ( उदाहरणार्थ अंकटाड, एकाफे, ऐका , ऐकला , ई ई सी , एफ्टा, गाट )
3. गेहूं से सम्बन्धित करारों से भिन्न अन्तर्राष्ट्रीय वस्तु करार ।
4. अन्तर्राष्ट्रीय व्यापार नीति से सम्बन्धित सभी मामले जिसमें टैरिफ और टैरिफ- इतर अवरोध सम्मिलित है ।
5. टैरिफ आयोग अन्तर्राष्ट्रीय ( टैरिफ प्रायोग अधिनियम , 1951 ) . उद्योगों को टैरिफ संरक्षण- सीमा शुल्क टैरिफ ब्यूरो ।
II. विदेश व्यापार
6. विदेश व्यापार से मम्बन्धित सभी मामले जिसमे व्यापार सम्बन्धी पत्राचार और करार (जिसमें टैरिफ और व्यापार) विषयक साधारण करार और राष्ट्रमण्डल टैरिफ अधिमान भी हैं ) व्यापार मिशन और प्रतिनिधिमण्डल, व्यापारिक सहयोग और संवर्द्धन और विदेशस्थ भारतीय व्यापारियों के हितो का संरक्षण भी है ।
7. सभी वस्तुओ , उत्पादो, विनिर्माणों, और अर्ध-विनिर्माणो (जिसमें निम्नलिखित भी सम्मिलित है ; ) के सम्बन्ध में निर्यात उत्पादन का विकास और विस्तार :
( क) कृषि उपज ( श्रेणीकरण और अंकन) अधिनियम, 1937 ( 1937 का 1) के अर्थ में कृषि उपज
(ख) समुद्री उत्पाद
(ग ) श्रौद्योगिक उत्पाद ( इंजीनियरी का सामान , रासायनिक , प्लास्टिक , अमडे के उत्पाद श्रादि )
( घ) इंधन , खनिज और खनिज उत्पाद ;
( ङ) निर्यात की दृष्टि से विनिविष्ट उत्पाद ( वस्त्र, पटसन उत्पाद , हस्तशिल्प , वामान फसलें आदि ) जो सीधे इस विभाग के भारसाधन मे है ।
8. निर्यात -प्रयत्न से सम्बन्धित सेवाओ की व्यवस्था से सम्बन्धित सभी सगठन और संस्थान जिनमें निम्नलिखित भी है:--
(क) निर्यात साखा और प्रत्याभूति निगम ।
( ख) निर्यात निरीक्षण परिषद् ।
( म ) वाणिज्यिक आसूचना और सांख्यिकी महानिदेशालय ।
(घ) प्रदर्शनी और वाणिज्यिक प्रचार निदेशालय ।
( ङ ) मुक्त व्यापार जोन ।

9. निर्यात -प्रयत्न को प्रोत्साहन देने बौर उसमें सहायता करने की परियोजनाएं और कार्यक्रम ।
10. श्रायात और निर्यात व्यापार नीति और नियन्त्रण , जिसमें निम्नलिखित से सम्बन्धित विषय नहीं हैं-
( i) फीचर फिल्मों का प्रायात ;
( ii ) भारतीय फिल्मों का निर्यात -फीचर लम्बाई वाली और लघु बोबों; चौर ( iii) फिल्म उद्योग द्वारा अपेक्षित चलचित्र फिल्म ( भ्रनश्चनिशित ) और अन्यमाल का आयात और वितरण ।

III. निर्यात की दृष्टि से उद्योग
12. निम्नलिखित का उत्पादन , ( घरेलू उपभोग और निर्यात के लिए ) वितरण और विकास
( क) सभी वस्त्र जिसमें हाथकरभा और सिले- सिलाए कपड़े भी हैं , किन्तु रेशम और सेलुलोजरहित संश्लिष्ट फाइवर ( मायलान , टैरीलिम , पोलिएस्टर, एक्रि- लिक) के उत्पादन से सम्बन्धित उद्योग नहीं है ।
(ख) पटसन ।
(ग ) हस्तशिल्प ।
( च) बागान फसलें, आय, काफी , रबड़ और इलाइची ।
13. ( 1 ) वस्त्र आयुक्त ।
( ii ) पटसन श्रायुक्त ।
( iii) काटम कारपोरेशन ग्राफ इण्डिया लिमिटेड ।
( iv) जूट कारपोरेशन आफ इण्डिया लिमिटेड ।
(v) टी ट्रेडिग कारपोरेशन आफ इण्डिया लिमिटेड ।
(vi ) अखिल भारतीय हस्तशिल्प बोर्ड ।
(vii ) अखिल भारतीय हाथकरघा बोर्ड ।
(viii) चाय बोर्ड ।
( ix) काफी बोर्ड ।
(X) रबड़ बोर्ड ।
(xi ) इलाइची बोर्ड ।
IV राज्य व्यापार
14. राज्य व्यापार की नीतियां , और उस प्रयोजन के लिए स्थापित संगठनों का निष्पादन जिसमें निम्नलिखित भी हैं :
( i ) राज्य व्यापार निगम और उसके समनुपंगी जिसमें निम्नलिखित भी है:-
( क ) इस्तशिल्प और हाथ करघा निर्यात निगम ।
(ख ) भारतीय काजू निगम ।

( ग ) परियोजना कोश उपस्कर निगम ।
( ii ) खनिज और खान व्यापार निगम ।
V. शत्रु के साथ व्यापार , शत्रु सम्पत्ति
15 शत्रु के साथ व्यापार , शत्रु फर्म और शस्त्र-सम्पत्ति , हानिपूर्ति ( जर्मन श्रौद्योगिक उपस्कर से भिंत्र) , शत्रु व्यापार नियन्त्रक; शत्तु फर्म नियंत्रक , भारत का शत्रु- सम्पत्ति श्रभिरक्षकं ।
(ख) "गृह मन्त्रालय " शीर्षक के अन्तर्गत , प्रविष्टि 41 के पश्चात् निम्नलिखित प्रविष्टिया जोडी जाएगी, अर्थात्
" 41 क सरकारी सेवक जिनके कुटुम्ब पाकिस्तान मे है-- मरकारी सेवको को पाकिस्तान जाने की अनुज्ञा दिए जाने के मामले ।
41ख विधायको के लिए श्राचरण - सहिता से सम्बन्धित मामले ।
41ग. मत्रियो के लिए आचरण संहिता ।
41घ सरकारी सेवको की पत्नियो या आश्रितो का भारत मे विदेशी मिशनो मे नियोजन ।
41ङ सिविल और सैनिक अधिकारियो का परस्पर आना-जाना
41च. किसी सेवा की आवश्यक सेवा के रूप मे घोषणा और जहा अन्य मत्तत्रालय इस निमित अधिसूचनाए जारी करने की प्रस्थापना करे वर्हा ऐसी प्रस्था- पनाओ पर विचार । " ,
( ग) "सूचना और प्रसारण मत्तालय " शीर्षक के अन्तर्गत उप - मद " 11. फिल्म" के अन्तर्गत प्रविष्टि 3 से 10 तक के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात् --
" 3 ( i ) प्रदर्शन के और इतर प्रयोग के लिए फीचर लम्बाई की और लघु फिल्मो का आयात
( ii ) फीचर लम्बाई का और लघु भारतीय फिल्मों का निर्यात , ( iii ) फिल्म उद्योग द्वारा अपेक्षित चलचित्त फिल्म ( अनअभिशित ) और अन्य माल का आयात और वितरण ।
4 ( i ) अन्तदंशीय और विदेश प्रचार के लिए वृत्त चित्त्रो और समाचार चित्त्री तथा अन्य फिल्मो और फिल्मो के टुकडो का उत्पादन और वितरण ।
( ii ) फिल्मो के लिए वितरण और प्रदर्शन श्रृखलाश्रो का सूजन
5 फिल्म उद्योग से सम्बन्धित विकासकारी और संवर्धक क्रियाए , जिनमे शिक्षण और अनुसधान भी है ।
6. ( i ) सघ सूची को प्रविष्टि 60 अर्थात् प्रदर्शन के लिए " चलचित्रो की मजूरी" के अधीन विधान ।

( ii ) चलचित्र अधिनियम , 1952 का प्रशासन जिसमें निम्नलिखित भी हैं-- ( क ) सार्वजनिक प्रदर्शन के लिए चलचित्त्रों की केन्द्रीय फिल्म सेमर बोर्ड द्वारा परीक्षण और प्रमाणन; और
( ख ) संघ राज्य क्षेत्रों में चलचित्न यंत्र द्वारा होने वाले प्रदर्शनों का विनियमन ।
7. भारत में निर्मित फिल्मों के लिए राज्य पुरस्कार प्रदान करना ।
8. बाल फिल्म सोसाइटी को अनदान ।
9. फिल्म जांच समिति की सिफारिशों का कार्यान्वयन ।
10. राष्ट्रीय फिल्म निगम और भारतीय चलचित्र निर्यात निगम ( इम्पेक )";
( घ) " मंत्रिमण्डल सचिवालय " शीर्षक के अन्तर्गत और उप- शीर्षक " मा कार्मिक और प्रशाशनिक सुधार विभाग " के अन्तर्गत
( i ) प्रविष्टि 20 ( ङ ) में "विधायकों के श्राचरण संहिता मम्बन्धी मामले" शब्दों का लोप कर दिया जाएगा :
( ii) प्रविष्टि 33 का लोप कर दिया जाएगा ।
