NOTIFICATION
Calcutta , the 20th August 1973
S.O. 446 ( E ) -Whereas by the notification of the Government of India in the late Ministry of Foreign Trade ( Office of the Jute Commissioner ) No. S.O. 5262 , dated the 1st December , 1971 ( hereinafter referred to as the said notification ) , the Jute Commissioner had fixed Rs . 207.77 per 100 bags as the maximum ex - factory price at which B. Twills , mentioned in the said notification , shall be purchased or Bold during the month of December , 1971 ;
And whereas it was specifically provided in the said notification that the said price is liable to be revised and fixed by the Central Government after taking into consideration the recommendations of the Tariff Commission and the price so fixed shall be the price at which suppliers are entitled to be paid for deliveries made during the said month ;
And whereas the recommendations of the Tariff Commission made in this behalf have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by clause 8 of the Jute (Licensing and Control ) Order , 1961 , the Jute Commissioner hereby fixes Rs . 213.32 per 100 bags as the final maximum ex - factory price at which suppliers

shall be entitled to be paid for deliveries made in respect of the said variety of jute textiles during the months of December , 1971 , subject to the condition that the other terms specified in the said notification shall remain unaltered .
Explanatory Memorandum
The price fixed under Notification No. S.O. 5262 dated the 1st December , 1971 was provisional and liable to be revised after taking into consideration the recom- mendations of the Tariff Commission . Government's decisions on the Tariff Commission's recommendations were announced on the 12th December , 1972 , and the price has been determined on that basis . No one will be adversely affected by the revised price and its retrospective operation .

फा०ग्रा० 446 ( श्र ) . यतः भारत सरकार के भूतपूर्व विदेश व्यापार मंत्रालय ( जूट आयुक्त का कार्यालय ) की अधिसूचना सं ० का ०आ ० 5262 , तारीख 1 दिसम्बर, 1971 ( जिसे इसमें इसके पश्चात् उक्त अधिसूचना कहा गया है ) द्वारा जूट श्रायुक्त ने प्रति 100 बैग 207.77 रु ० उस अधि- कतम कारखाना द्वार कीमत के रूप में नियत किया था जिस पर उक्त अधिसूचना में वर्णित बी ट्विल्स, 1971 के दिसम्बर मास के दौरान खरीदे या बेचे जाएंगे ;
और यतः उक्त अधिसूचना में यह विर्नािदष्ट रूप से उपबन्धित था कि उक्त कीमत , केन्द्रीय सरकार द्वारा टैरिफ आयोग की सिफारिशों पर विचार कर लेने के पश्चात् पुनरीक्षित और नियत किए जाने के दायित्व के अधीन है और इस प्रकार नियत कीमत वह कीमत होगी जिस पर प्रदायक उक्त मास के दौरान किए गए परिधानों के लिए संदत्त किए जाने के हकदार होंगे ;
और यतः इस निमित्त की गई टैरिफ आयोग की सिफारिशों पर केन्द्रीय सरकार द्वारा विचार कर लिया गया है ;
अतः , श्रन, जूट ( अनुज्ञापन और नियंत्रण ) आदेश , 1961 के खण्ड 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , जूटश्रायुक्त प्रति 100 बैग 213.32 रु ० उस अन्तिम अधिकतम कारखाना- द्वार कीमत के रूप में नियत करता है जिस पर प्रदायक-जूट -वस्त्रों की उक्त किस्म की बाबत 1971 के दिसम्बर मास के दौरान किए गए परिदानों के लिए संदत्त किए जाने के इस शर्त के अधीन रहते हुए हकदार होंगे कि उक्त अधिसूचना में विनिदिष्ट अन्य निबन्धन अपरिर्तित रहेंगे ।

स्पष्टीकारक ज्ञापन
अधिसूचना सं ० का ० आ ० 5262 , तारीख 1 दिसम्बर , 1971 के अधीन नियत की गई कीमत अन्तिम थो और टरिफ आयोग की सिफारिशों पर विचार करने के पश्चात् पुनरीक्षित किए जाने के दायित्व के अधीन थी । डैरिफ आयोग की सिफारिशों के संबंध में सरकार के विनिश्चय 12 दिसम्बर , 1972 को आख्यापित किए गए थे और कीमत इम आधार पर अवधारित की गई है । पुनरीक्षित कीमत और उसके भूतलक्षी प्रवर्तन से किसी पर भी प्रतिकूल प्रभाव नहीं पड़ेगा ।
