SUBJECT . Scheme for the licensing of Indian Cotton Textiles for export to France during the licensing year 1973-74.

No. 26 - ETC ( PN ) / 73 .---The Scheme relates to export of all varieties of mill made cotton textiles from India to France during the Licensing year 1st October , 1973 to 30th September , 1974 .

2. For purpose of licensing , the shipment period will be divided into two six monthly periods , 1st October , 1973 to 31st March , 1974 and 1st April , 1974 to 30th September , 1974 .

3. Licences under the scheme shall be issued by the Office of the Joint Chief Controller of Imports & Exports , Bombay on the basis of quota certificate issued by The Cotton Textiles Export Promotion Council , Bombay , on first - come- first- served basis , on the recommendations of the EEC -Austria Textiles Licensing Advisory Committee .

( a ) The quota certificate for shipment during the first six monthly licensing period will be issued , on presentation , by , the exporters , of firm con- tracts and a proforma invoicevoice indicating .ng . along with other details , the net weight in Kgs . of the goods in the Form prescribed by Texprocil for the purpose .

(b) The second six - monthly distribution will be made later in accordance with the decision of the EEC - Austria Textiles Licensing Advisory Committee .

4. For the purpose of exports and issuance of quota / licence , cotton textiles have been divided into the following two groups :

Group 1. Cotton fabrics , grey or bleached mercerised or not . GROUP I covers items classified under categories B , B1 , B2 , B3 , B4 , B5 , B6 , B7 , B8 , C and C1 .

Group II -Other cotton fabrics , made - up articles and miscellaneous articles of cotton :

GROUP II covers items falling under categories C2 , C3 , C4 , C5 , C6 , C7 , D. D1 , D2 , D3 , D4 . E , E1 , E2 , E3 , E4 , E5 , E6 , E7 , E8 , E9 , E10 , E11 . F , F1 , F2 , F3 , and F4 .

Details of the items falling under the above categories are available with the Texprocil in the form of standardised categories and items falling under the same .

5. According to the agreement , imports of cotton textiles into France will be admitted by the competent French Authorities only on presentation of the Green certificates issued by the Cotton Textiles Export Promotion Council , Bombay , on the basis of which French Authorities would issue import licence,

6. Licences shall be valid for shipment from any port in India .

7. Licences and quotas shall not be transferable without the express consent in Writing of the E.E.C. and Austria Textiles Licensing Advisory Committee ,

8. A non- refundable amount of Rs . 10 / - per tonne , subject to minimum of Rs . 3/ - will be charged by the Cotton Textiles Export Promotion Council , for issue of quotas .

9. All quota holders shall have to submit a monthly report to the Cotton Textiles Export Promotion Council giving details of the shipment against individual licences issued to them . These statements should reach the Council by the 10th of the subsequent month .

10. The E.E.C. - Austria Textiles Licensing Advisory Committee shall ( a) super- vise the entire scheme ; ( b ) keep a watch over the performance from time to time; ( c) interpret and give decisions on various matters arising out of the operation of the scheme; and ( d ) make such changes in the scheme as the Committee deems ( 11. from time to time . The Licensing Committee shall be empowered to frame rules and regulations from time to time , unter - alia providing for the conditions to be complied with by an applicant before he would be entitled to quotas . It shall also have the right to withhold or cancel quotas and reject applications for quotas with assigning any reasons . without

संख्या 26 - ई ० टी ० सी ० पी ० एन ० ) /73.-लाइसेंस वर्ष 1 अक्तूबर, 1973 से 30 सितम्बर, 1974 तक सभी प्रकार के मिल निर्मिन मूती वस्त्रों का भारत में फ्रांस को निर्यात करने से यह योजना संबंध रखती है ।

2. लाइसेंम देने के विचार से पोतलदान की अवधि को 1 अक्तूबर , 1973 से 31 मार्च, 1974 और 1 अप्रैल , 1974 से 30 सितम्बर , 1974 की वो छह माही अवधियों में बांटा जाएगा ।

3. ई ० ई ० मी० आस्ट्रिया मूती वस्त्र लाइसेंस मलाहकार ममिति की सिफारिश पर इस योजना के अन्तर्गत लाइसेंस संयुक्त मुख्य नियंत्रक , आयात-निर्यात, बम्बई द्वारा सूती वस्त्र निर्यात संवर्धन परिषद , बम्बई , मे जारी किये गये कोटा प्रमाण-पत्त्र के आधार पर पहले श्राए सो पहले पाए के आधार पर जारी किये जाएंगे ।

( क ) निर्यातकों को पोप्तलदान के लिये प्रथम छह माही लाइसेंस अवधि के दौरान फर्म संविदा और अन्य व्यौरे के साथ टेक्सेप्रोसिल द्वारा इस उद्देश्य के लिये निर्धारित प्रपत्त में माल का किलोग्राम में वास्तविक बजन दर्शाते हुए एक बीजक प्रश्न प्रस्तुत करने पर कोटा प्रमाण पत्र जारी किया जाएगा ।

( ख ) दूसरी छह माही का वितरण ई ० ई ० सी० श्रास्ट्रिया वस्त्र लाइसेंस सलाहकार समिति के निर्णय के अनुसार बाद में किया जाएगा ।

4' निर्यातों और कोटे , लाईसेंसों को जारी करने के लिए सूती वस्त्रों का निम्नलिखित वर्गों में विभक्त किया गया हैः--

वर्ग 1: -- सूती वस्त्र, भूरे या विरंजिप्त रेशमी सा बनाया हुआ या बिना विरंजित रेशमी सा बना हुआ । वर्ग 1 में नीचे लिखी श्रेणियों के अन्तर्गत वर्गीकृत मदें आती हैं:-

बी, बी 1 , बी 2 , बी 3 , बी 4 , बी 5 , बी 6 , बी 7 , बी 8 , सी और सी 1 ।

वर्ग 2: -- अन्य मूती वस्त्र, तैयार सामग्री , और सूती की विवधि सामग्री :-

वर्ग 2 में नीचे लिखी श्रेणियों के अन्तर्गत आने वाली मदे श्राती है:-

मी 2 , मी 3 , सी 4 , सी 5 , सी 6, सी 7 डी, डी 1 , डी 2 , डी 3 , डी 4, ई, ई 1 , ई 2 , ई 3 , ई 4 , ई 5 , ई 6 , ई 7 ई 8 , ई 9 , ई 10 , ई 11 , एफ , एफ 1 , एफ 2 , एफ 3 और एफ 4 ।

उपर्युक्त श्रेणियों के अन्तर्गत आने वाली मदों का विवरण वस्त्र निर्यात संवर्धन परिषद के यहां मानकीकृत वर्गीकरण के रूप में उनके अन्तर्गत आने वाली मदों के रुप में उपलब्ध हैं ।

5. करार के अनुसार , फ़ान्म में मूती वस्त्रों के आयात की अनुमति केवल सूती वस्त्र निर्यात संवर्धन परिषद , बम्बई, द्वारा जारी किये गये ग्रीन सर्टिफिकेट के प्रस्तुतीकरण पर ही फ़ान्स के समर्थ प्राधिकारियों द्वारा दी जाएगी , जिसके आधार पर फ़ान्म के प्राधिकारी आयात लाइसेंस जारी करेंगे ।

6. लाइसेम भारत के किसी भी पत्तन से पोतलदान के लिये बंध होंगे ।

7. ई ० ई ० सी० और अस्ट्रिया वस्त्र लाइसेंस सलाहकार समिति की लिखित रूप में स्पष् स्वीकृति के बिना लाइसेंस और कोटा हस्तान्तरणीय नहीं होंगे ।

8. कोटा जारी करने के लिये सूती वस्त्र निर्यात मंबंर्धन परिषद द्वारा प्रति टन 10 के हिसाब से एक आदेय शुल्क बमूला जाएगा । इसकी न्यूनतम राशि 5 १० होगी ।

9. मभी कोटाधारी जिनको व्यक्तिगत लाइसेंस जारी किये गये हैं, उसके लिये उन्हें पोतलदान का विवरण देते हुए सूती वस्त्र निर्यात संवर्धन परिषद को एक मासिक रिपोर्ट प्रस्तुत करनी पड़ेगी । ये ब्यौरे परिषद के पाम अनुवर्ती माह की 10 तारीख तक पहुंच जानें चाहिये ।

10. ई ० ई ० सी ० आस्ट्रिया वस्त्र सलाह‌कार समिति के ये कार्य होंगे ( क ) सम्पूर्ण योजना का पर्यवेक्षण करना , ( ख ) समय समय पर कार्य पालन की निगरानी रखना, ( ग) योजना के परिचालन से सम्बन्धित उत्पन्न विभिन्न मामलों का विवेचन करना और निर्णय देना तथा ( घ ) योजना में समय समय पर ऐसे परिवर्तन करना जैसे समिति उपयुक्त समझे । कोटा प्राप्त करने के लिये पात्त्र बनने से पहने की शर्तों का श्रश्वेदक से पालन कराने के साथ- साथ लाइसेंस समति समय - समय पर नियम तथा विनियम बनाने के लिये अधिकृत है । उसे यह भी अधिकार होगा कि वह कोटा को रोक ले या उसे रद्द करदे और बिना किसी कारण के समनुदेशित किये ही कोटा के लिये दिये गये आवेदनपत्र को रद्द करदे ।

No. 27 - ETC ( PN ) /73.- The Scheme relates to export of all varieties ofmillmade cotton textiles from India to Italy during the Licensing year 1st October , 1973 to 30th September , 1974 .

2. For purpose of licensing , the shipment period will be divided into two SIX mouthly periods , 1st October , 1973 to 31st March , 1974 and 1st April , 1974 to Suth September , 1974 .

3. Licences under the scheme shall be issued by the Office of the Joint Chief Controller of Imports & Exports , Bombay on the basis of quota certificate issued by The Cotton Textiles Export Promotion Council , Bombay , on first-come -first - se ved basis on the recommendations of the EEC - Austria Textiles Licensing Advisory Committee.

विषय: लाइसेंस वर्ष 1973-1974 के दौरान भारतीय सूती वस्त्रों का इटली को निर्वा के लिए लाइसेंम देने से सम्बन्धित योजना ।

सं ० 27 -ई ० हो ० सो ० (पी ० एम ० ) / 73.-लाइसेंस वर्ष 1 अक्तूबर , 1973 से 30 सितम्बर , 1974 तक मभी प्रकार के मिल निर्मित्र मूत्री वस्त्रों का भारत से इटली को निर्वान करने से यह योजना सम्बन्ध रखती है ।

3. ई ० ई ० सी० - आस्ट्रिया मूनी वस्त्र लाइसेंस सलाहकार समिति की सिफारिश पर इस योजना के अन्तर्गन लाइसेंस संयुक्त मुख्य नियंत्रक , आयात-निर्यात, बम्बई द्वारा सूती वस्त्र निर्यात संवर्धन परिषद्, बम्बई से जारी किए गए कोटा प्रमाण -पत्र के ग्राधार पर पहले आए सो पहले पाए के आधार पर जारी किए जाएंगे ।

( क) निर्यानकों को पोनलदान के लिए प्रथम छह माहो लाइसेंम अवधि के दौरान फर्म संविदाओं और अन्य ब्योरे के साथ टैक्सत्रोसिल द्वारा इम उद्देश्य के लिए निर्धारित प्रपत्र में माल का किलोग्राम में वास्तविक वजन दर्शाने हुए एक बोजक प्रपत्र प्रस्तुत करने पर कोटा प्रमाणपत्र जारी किया जाएगा ।

( ख) दूमरी छह माही का वितरण ई ० ई ० सी ० श्रास्ट्रिया वस्त्र लाइसेंस मलाहकार समिति के निर्णय के अनुसार किया जाएगा ।

4. निर्यातों और कोडे लाइसेंसों को जारी करने के लिए सूती वस्त्रों को निम्नलिखित वर्गों में विभक्त किया गया है:-

वर्ग 2 में नीचे लिखी श्रेणियों के अन्तर्गत आने वाली भवें आती हैं: -

सी2 , सी 3 , सी 4 , सी 5 , सी 6 , सी 7 , डी, डी 1 , डी 2 , डी 3 , डी 4 , ई, ई 1 , ई 2 , ई 3 , ई 4 , £ 5 , 26 , ई 7, 8 , 9 , ₤ 10 , ई 11 , एफ, एफ 1 , एफ 2 , एफ 3 , और एफ 41

उपर्युक्त श्रेणियों के अन्तर्गत श्राने वाली मदों का विवरण वस्त्र निर्यात संवर्धन परिषद् के यहां मानकी कृत वर्गीकरण के रूप में और उनके अन्तर्गत आने वाली मदों के रूप में उपलब्ध है ।

5. करार के अनुसार, इटली में सूती वस्त्रों के श्रायात की अनुमति केवल सूती वस्त्र निर्यात संवर्धन परिषद्, बम्बई द्वारा जारी किए गए ग्रीन टिफिकेट के प्रस्तुतीकरण पर ही इटली के समर्थ प्राधिकारियों द्वारा दी जाएगी , जिस के आधार पर इटली के प्राधिकारी आयात लाइसेंस जारी करेंगे ।

6. लाइसेंस भारत के किसी भी पत्तन से पोतलदान के लिए वैध होंगे ।

7. ई ० ई ० सी० और आस्ट्रिया वस्त्र लाइसेंस सलाहकार समिति की लिखित रूप में स्पष्ट स्वीकृति के बिना लाइसेंस और कोटा हस्तान्तरणीय नहीं होंगे ।

8. कोटा जारी करने के लिए सूती वस्त्र निर्यात संवर्धन परिषद् द्वारा प्रति टन 10 रु० इसकी न्यूनतम राशि 5 रु ० होगी ।

के हिमाब से एक अदेय शुल्क बसूला जाएगा ।

9. सभी कोटाधारी जिनको व्यक्तिगत लाइसेंस जारी किए गए हैं , उसके लिए उन्हें पोतलदान का विवरणदेते हुए सूती वस्त्र निर्यात संवर्धन परिषद् को एक मासिक रिपोर्ट प्रस्तुत करनी पड़ेगी । ये ब्योरे परिषद् के पास अनुवर्ती माह की 10 तारीख तक पहुंच जाने चाहिए ।

SUBJECT. Scheme for the licensing of Indian cotton millmade textiles for export to the U.S.A. during the licensing year 1st October , 1973 to 30th September , 1974.

No. 28 - ETC ( PN ) /73 . The Scheme relates to the export of all the 64 ICTA cate- gories of cotton millmade textiles from India to the USA under the quota for the Ilcensing year 1st October , 1973 to 30th September , 1974 .

2. For purpose of licensing the shipment period will be divided into two six monthly periods . 1st October , 1973 to 31st March , 1974 and 1st April , 1974 to 30th September , 1974 .

3. Exports will be allowed from any port in India ,

4. Licenses under the Scheme shall be issued by the Joint Chief Controller of Imports & Exports . Bombay , on the basis of the quota certificates issued by the Cotton Textiles Export Promotion Council , Bombay ( TEXPROCIL ) on the recom- mendations of the U.S.A. Textiles Licensing Advisory Committee . This shall apply in the case of exports of:

ICTA Code No.009 / 10 (sheeting carded / combed yarn )

ICTA Code No.018 / 19 ( print cloth , shirting types carded yarn )

ICTA Code No.022 ( twill and sateen carded yarn)

ICTA Code No. 026 (woven fabrics n.e.s. carded yarn , duck only )

ICTA Code No. 026 (woven fabrics r.e.s. carded yarn , other than duck. )

ICTA Code No.028 / 29 ( pillow cases , carded / combed yarn )

ICTA Code No. 030 (dish towels)

ICTA Code No.031 (towels , other than dish towels)

ICTA Code No.034/ 35 ( bed sheets , carded/ combed yarn) ard

ICTA Code No.064 ( only in respect of terry napkins , terry wash cloth & terry mops of size 12 " x 12 " or below , napkins other than terry and table covers ) .

(a) For the purpose of exports of cotton textiles of ICTA Categories 1 to 8 . 11 to 17 , 20 , 21 , 23 to 25 , 27 , 32 , 33 , 36 , 37 to 63 and 64 ( items other than terry napkins , terry wash cloth and terry mops of size 12 " x12 " or below , napkins other thau terry and table covers ) the quotas / licences will be issued against individual shipments , by way of endorsements on the shipping bill on first-come- first - served basis subject to the condition that as soon as the ceiling laid down is reached , exports thereunder shall be stopped forthwith . In respect of bedspreads falling under category 036 , the quotas will be allotted on shipping bills on first- come-first - served basis provided the condition ofof minimum price of 23 US $ f.o.b. or 25 $ c.i.ff. per square yard is fulfilled .

(b) The first six - monthly distribution will be made on the above basis . The second six - monthly distribution will be made later in accordance with the decision of the U.S.A. Textiles Licensing Advisory Committee.

( c) The list of 64 ICTA Categories and details of the items falling under the same are available with the Cotton Textiles Export Promotion Council , Bombay .

5. The U.S.A. Textiles Licensing Advisory Committee consists of three represen- tatives nominated by the Indian Cotton Mills' Federation and three by the Cotton Textiles Export Promotion Council , one representative from the clothing manufac- turer's Association of India, Bombay and one representative each nominated by the Joint Chief Controller of Imports & Exports , Bombay , and the Textile Commis sioner , Bombay .

6. Licences and quotas shall not be transferable without the express consent in writing of the U.S.A. Textiles Licensing Advisory Committee .

7. Quotas under each of the above categories will be allotted in terms of the decisions taken from time to time by the U.SA Textiles Licensing Advisory Committee .

8. All Shipments of cotton textiles made during each month from any port in India shall be reported by the exporters concerned to the Cotton Textiles Export Promotion Council , Bombay , by the 10th of the subsequent month .

9. A non - refundable amount of Re.1 / - for every 1000 square yards , subject to minimum of Rs . 5 / - , will be charged by the Cotton Textiles Export Promotion Council , for issue of quotas .

10. The U.S.A. Textiles Licensing Advisory Committee is empowered to frame rules and regulations from time to time inter - alia , to provide for the conditions to be complied with by an applicant before he would be eligible to quota.

11. The U.S.A. Textiles Licensing Advisory Committee shall also :

( a) supervise the entire scheme ;

(b ) keep watch over the performance from time to time;

( c ) interpret and give decisions on various matters arising out of the opera- tion of the scheme ; and

(d) make such changes in the scheme as the Committee may consider fit from time to time .

संख्या 28 - ई ० टी ०मी ० ( पी ० एन ० ) / 73.--यह योजना लाइसेंस वर्ष 1 अक्तूबर , 1973 से 30 मिनम्बर , 1974 नक के लिये कोटा के अन्तर्गत भारत से संयुक्त राज्य अमरीका को मिल निर्मित सूती वस्त्रों की सभी 64 आईटीसी टी ए श्रेणियों के निर्यात से संबंध रखती है ।

2. लाइमेस देने के प्रयोजन हेतु , पोतलदान की अवधि को 1 अक्तूबर , 1973 से 31 मार्च, 1974 तक तथा 1 अप्रैल , 1974 मे 30 सितम्बर, 1974 तक छः छः मास की दो अवधियों में बांटा जाएगा ।

3. भारत के किसी भी पत्तन में निर्यात की स्वीकृति दी जाएगी ।

4. इम योजना के अन्तर्गत लाइसेंस, संयुक्त मुख्य नियंत्रक, आयात-निर्यात , बम्बई द्वारा मयुक्त राज्य अमरीका वस्त्र लाइसेम सलाहकार ममिनि की सिफारिश पर सूती वस्त्र निर्यात संवर्धन परिषद , बम्बई ( टेक्सोमिल ) द्वारा जारी किये गए कोटा प्रमाण पत्र के आधार पर जारी किये जाएंगे । यह निलिखित निर्यातो के मामले में लागू होगा:-

ग्राई ०सी ०टी ० ए ० कोड सं ० 031 ( भोजन के समय प्रयोग में आने वाले तौलियों से भिन्न तौलिए ) ।

आई ०सी ०टी० ए ० कोड सं ०34/ 35 (बिछाने के लिये चादरें, धुने हुए/ साफ किये हुए धागे ) , तथा

आई ० मी ० टी ० ए ० कोड सं ०064 ( केवल टेरि नेपकिन्स , टेरि वाश क्लाथ तथा 12 " X12" अथवा इससे कम साइज के टेरि मोप्स , टेरि तथा मेजपोशों में भिन्न नेपकिन ) ।

( ए) आई ०सी ० टी ० ए ० 1 से 8 , 11 से 17 , 20 , 21 , 23 से 25 , 27 , 32 , 33 , 36 , 37 से 63 तथा 64 श्रेणियों ( टेरि नेपकिन्स , टेरिवाश क्लाथ तथा 12 " 12 " अथवा इससे कम साइज के टेरी सोप्स से भिन्न मदे , टेरि तथा मेजपोशी से भिन्न नेपकिन ) के सूती वस्त्रों के निर्यात के प्रयोजन हेतु कोटे/लाइसेंस लदान बिल पर पृष्ठांकन करके , अलग अलग पोतलदान के मद्दे पहले आए सो पहले पाए के आधार पर जारी किये जाएँगे और ये इम पार्टी के अधीन होंगे कि जैसे ही निर्धारित उच्चतम मूल्य सीमापूर्ण हो जाती है, इसके अन्तर्गत तुरन्त ही निर्यात रोक दिये जायेगे । श्रेणी सं ०036 के अन्तर्गत आने वाले पलग/ पोशों के मामलों में कोटे, लदान बिलों प'र पहले आए सो पहले पाए के आधार पर नियत किये जाएँगे , बशर्ते कि प्रति वर्ग गज के जहाज पर निशुल्क मूल्य की न्यूनतम कीमत 23 /एस न्यूमतम कीमत 25 यू एस शिलिंग की गर्ल को शिलिग अथवा लागत बीमा - भाड़ा मूल्य की पूरा किया जाता है ।

आधार पर किया जाएगा । दूसरा छः मासिक (बी) पहला छ. मासिक वितरण उपर्युक्त वितरण , सूयुक्तराज्य अमरीका सूती वस्त्र लाइसेंस सलाहकार समिति के निर्णय के अनुसार बाद में किया जाएगा ।

(सी) 64 आई ० सी ० टी ० ए ० श्रेणियों तथा इन के अन्तर्गत आने वाली मधों के विवरण की सूची, सूती वस्त्र निर्यात संवर्धन परिषद, बम्बई के पास उपलब्ध है ।

5. संयक्त राज्य अमरीका सूती वस्त्र लाइसेंस सलाह‌कार समिति में , भारतीय मूती मिल संगठन द्वारा नामित 3 प्रतिनिधि और सूती वस्त्र निर्यात संवर्धन , बम्बई द्वारा नामित 3 प्रतिनिधि , भारतीय कपडा निर्माण संघ , बम्बई द्वारा नामित 1 प्रतिनिधि और प्रत्येक संयुक्त मुख्य नियंत्रक , आयात -निर्यात , बम्बई तथा वस्त्र आयुक्त , बम्बई द्वारा एक एक प्रतिनिधि है ।

6. संयुक्त राज्य अमरीका वस्त्र लाइसेस सलाहकार समिति की लिखित में स्पष्ट स्वीकृति के बिना लाइसेंस और कोटा अहस्तान्तरणीय नही होंगे ।

7. उपयुक्त प्रत्येक श्रेणी के अधीन कोटा संयुक्त राज्य अमरीका वस्त्र लाइसेंस सलाह- कार समिति द्वारा समय समय पर लिए गए निर्णयों के अनुसार आवटित किए जाएंगे ।

8. भारत के किसी भी पत्तन से प्रत्येक महीने के दौरान सूती वस्त्रो के किए गए पोतलदानो की सूचना सम्बद्ध निर्यातको द्वारा सूती वस्त्र निर्यात सवर्धन परिषद , बम्बई को आगामी माह की 10 तारीख तक दी जाएगी ।

9 सूती वरन निर्यात सवर्धन परिषद द्वारा कोटा जारी करने के लिए प्रति 1,000 वर्ग गज पर 1.00 स्पये के हिसाब से अदेय धनराशि उगाही जाएगी , यह धनराशि कम से कम 5.00 रुपये होगी ।

10. आवेदक को कोटे के लिए पात्र बनने से पहले शर्तों का उसके द्वारा अनुपालन- कराने के साथ ही साथ सयुक्त राज्य अमरीका वस्त्र लाइसेंस सलाहकार समिति को ममय- समय पर नियम तथा विनियम बनाने के अधिकार है ।

11. सयुक्त राज्य अमरीका वस्त्र लाइभैंस सलाहकार समिति निम्नलिखित कार्य भी करेगी ;

(क ) सम्पूर्ण योजना का पर्यवेक्षण ;

( ख ) समय समय पर कार्य निष्पादन की निगरानी रखना ;

( ग ) योजना के परिचालन से सम्बन्धित उत्पन्न विभिन्न मामलो का विवेचन करना और निर्णय देना ; और

( ब ) योजना में ऐसे परिवर्तन करना जो समिति समय समय पर उचित समझे ।

No. 29 - ETC ( PN ) / 73 - The Scheme relates to export of all varieties of millmade cotton textiles from Indian to BENELUX ( Belgium , Netherlands and Luxembourg ) Countries during the Licensing year 1st October , 1973 to 30th September , 1974 2 For purpose of licensing the shipment period will be divided into two six montnly periods , 1st October , 1973 to 31st March , 1974 and 1st April , 1974 to 30th September , 1974

Licences under the scheme shall be issued by the Office of the Joint Chief Controller of Imports & Exports Bombay on the basis of quota certificate issued by The Cotton Textiles Export Promotion Council , Bombay , on first -come - first- served basis , on the recommendations of the EEC - Austria Textiles Licensing Advisory Committee

( a) The quota certificate for shipment during the first six monthly licensing period will be issued on presentation , by the exporters , of firm con- tracts and a proforma invoice indicating , along with other details , the net weight in Kgs of the goods in the Form prescribed by Texprocil for the purpose ,

( b ) The second six - monthly distribution will be made in accordance with the decision of the EEC -Austria Textiles Licensing Advisory Committee .

4 For the purpose of exports and issuance of quota / licence , cotton textiles have been divided into the following two groups

Group I -Cotton fabrics grev or bleached mercerised or not GROUP I covers items classified under categories B, B1 , B2 , B3 , B4 , B5 , B6 , B7 , B8, C and C1 .

Group II . Other cotton fabrics , made - up articles and misetiancous articles of cotton :

GROUP II covers items falling under categories C2 C3 C4 C5 , C6 , C7 , D , D1 , D2 , D3 , D4 , E E1 , E2 , E3 , E4 , E5 , E6 , E7 , E8 , E9 , E10 , E11 , F , F1 , F2 , F3 , and F4 .

Details of the items falling under the above categories are available with the Texprocil in the form of standardised categories and items falling under the same .

5. According to the agreement , imports of cotton textiles will be admitted by the competent Authorities in the Benelux countries only on presentation of the Green Certificates issued by the Cotton Textiles Export Promotion Council , Bombay , on the basis of which the Benelux Authorities would issue import licences .

6. Licences shall be valid for shipment from any port in India .

7. Licences and quotas shall not be transferable without the express consent in writing of the E.E.C. and Austria Textiles Licensing Advisory Committee .

8. A non - refundable charge of Rs . 10 / - per ton will be levied by The Cotton Textiles Export Promotion Council for the issue of quotas , subject to a minimum ofRs . 5 / -.

10. The EE.C. - Austria Textiles Licensing Advisory Committee shall ( a ) super- vise the entire scheme ; ( b ) keep a watch over the performance from time to time , ( c) interpret and give decisions on various matters arising out of the operation of the scheme ; and ( d ) make such changes in the scheme as the Committee deems fit from tirne to time .e . The Licensing CoCommittee shall be empowered to frame rules and regulations from time to time , inter - alia providing for the conditions to be complied with by an applicant before he would be entitled to quotas . It shall also have the right to withhold or cancel quotas and reject applications for quotas without assigning any reasons .

3. ई ० ई ०सी० श्रास्ट्रिया सूती वस्त्र लाइसेंस सलाहकार समिति की सिफारिश पर इस योजना के अन्तर्गत लाइसस संयुक्त मुख्य नियंत्रक, आयात-निर्यात , बम्बई द्वारा सूती वस्त्र निर्यात संवर्धन परिषद बम्बई से जारी किए गए कोटा प्रमाण-पत्त के आधार पर पहले श्राए से पहले पाए के आधार पर जारी किए जाएंगे ।

( क) निर्यातकों को पोतलदान के लिए प्रथम छहमा ही लाइसेंस अवधि के दौरान फर्म संविदा और अन्य ब्यौरे के साथ टेक्सेप्रोसिल द्वारा इस उद्देश्य के लिए निर्धारित प्रपत्न में माल का किलोग्राम में वास्तविक वजन दर्शाते हुए एक बीजक प्रपत्त्र प्रस्तुत करने पर कोटा प्रमाणपत्र जारी किया जाएगा ।

( ख ) दूसरी छ‌माही का वितरण ई ० ई ०सी ०-श्रास्ट्रिया वस्त्र लाइस स सलाहकार समिति के निर्णय के अनुसार किया जाएगा ।

4. निर्यातों और कोटो/ लाइससों को जारी करने के लिए सूती वस्त्रों को निम्नलिखित वर्गों में विभक्त किया गया है:--

वर्ग -1 : सृती वस्त्र, भूरे या विरंजित रेशमी सा बनाया हुआ था बिना विरंजित रेशमी मा बना हुआ । वर्ग 1 , मे मीचे लिखी श्रेणियों के अन्तर्गत वर्गी- कृत मदें आती हैं:-

बी, बी 1 , बी 2 , बी 3 , बी 4 , बी 5 , बी 6 , बी 7 , बी 8 , सी और सी 1 ।

वर्ग -2 : अन्य सूती वस्त्र, तैयार सामग्री और सूत की विविश्व सामग्री:--

वर्ग 2 में नीचे लिखो श्रेणियों के अन्तर्गत आने वाली मदें श्राती है:-

सी2, सी 3. सी 4 , सी 5 , सी 6 , सी 7' डी, डी 1 , डी 2 , डी 3 , डी 4 , ई , ई 1 , ई 2 , ई 3 , ई 4, ई 5 , ई ७ , ई 7 , ई 8 , ई 9 , ई 10 , ई 11 , एफ, एफ 1 , एफ 2 , एफ 3 , और एफ 4 ।

उपर्युक्त श्रेणियों के अन्तर्गत आने वाली मदों का विवरण वस्त्र निर्यात संवर्धन परिषद के यहां मानकीकृत वर्गीकरण के रूप में और उनके अन्तर्गत आने वाली मदों के रूप में उपलब्ध है ।

5. करार के अनुसार, बेनिलक्स में सूती वस्त्रों के आयात की अनुमति केवल सूती वस्त्र निर्यात संवर्धन परिषद् , बम्बई द्वार। जारी किए गए ग्रीन सटिफिकेट के प्रस्तुतीकरण पर ही बेनिलक्स के समर्थ प्राधिकारियों द्वारा दी जाएगी , जिस के आधार पर बेनिलक्स के प्राधिकारी आयात लाइसेंस जारी करेगे ।

6. लाइसेंस भारत के किसी भी पत्तन से पोतलदान के लिए वैद्य होंगे ।

7. ई ० ई ० सी ० और आस्ट्रिया वस्त्र लाइसेंस सलाह‌कार समिति की लिखित रूप में स्पष्ट स्लीकृति के बिना लाइसेंस और कोटा हस्तान्तरणीय नहीं होंगे ।

8. कोटा जारी करने के लिए सूती वस्त्र निर्यात संवर्धन परिषद द्वारा प्रति टन 10 रु ० के हिसाब से एक अवेय शुल्क वसूली जाएगा । इसकी न्यूनतम राशि 5 रु ० होगी ।

9. मभी कोटाधारी जिनको व्यक्तिगत लाइसेंस जारी किए गए हैं, उसके लिए उन् हें पोतलदान का विवरण देते हुए सूती वस्त्र निर्यात संवर्धन परिषद को एक मासिक रिपोर्ट प्रस्तुत करनी पड़ेगी । ये ब्यौरे परिषद के पास श्रनुवर्ती माह की 10 तारीख तक पहुंच जाने चाहिए ।

10. ई ० ई ०सी० आस्ट्रिया वस्त्र सलाहकार समिति के ये कार्य होंगे ( क ) सम्पूर्ण योजना का पर्यवेक्षण करना, ( ख ) समय -समय पर कार्य पालन की निगरानी रखना , ( ग ) योजना के परिचालन से सम्बन्धित उत्पन्न विभिन्न मामलों का विवेचन करना और निर्णय देना तथा ( घ ) योजना में समय -समय , पर ऐसे परिवर्तन करना जिसे समिति उपयुक्त समझे कोटा प्राप्त करन के लिए पात्र बनने से पहले की शर्तों का आवेदक से पालन कराने के साथ-साथ ला सेंस समिति समय - समय पर नियम तथा विनियम बनाने के लिए भी अधिकृत है । उसे यह भी अधिकार होगा कि वह कोटा को रोक ले या उसे रद्द कर वे और बिना किसी कारण के समनुदेशित किए ही कोटा के लिए दिए गए आवेदन को रद्द कर दे ।
