New Delhi , the 22nd October 1971
S.O. 4035.-In exercise of the powersowers conferred by sub - clause ( ix) of clause (a) of sub - section ( 1 ) of section 2 of the Essential Services Maintenance Act, 1968 (59 of 1968 ) , the Central Government , being of opinion that strikes in any service connected with the supply of electrical energy to the public in the State of West Bengal or with the generation , storage or transmission of electrical energy for the purpose of such supply [ not being any such service falling under sub- clause (viii ) of clause ( a) aforesaid ] would result in the inflication of grave hard- ship on the community , hereby declares every such service to be an essential service for the purposes of the said Act.

का० प्रा ० 4035.- आवश्यक सेवाएं बनाए रखने का अधिनियम , 1968 ( 1968 का 59 ) की धारा 2 की उपधारा ( 1 ) खण्ड ( क ) उपखंण्ड ( ix ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय सरकार, जिसकी यह राय है कि पश्चिमी बंगाल राज्य में जनता को विद्युत्त उर्जा के प्रदाय से या ऐसे प्रदाय के प्रयोजनार्थ विद्युत्त ऊर्जा के उत्पादन , भंडारकरण या पारेषण संबंधित ऐसी किसी सेवा में [ जो पूर्वोक्त खंण्ड ( क ) उपखण्ड ( viii ) के अधीन आने वाली सेवा न हो ] हड़तालों के परिणामस्वरूप समुदाय को गंभीर कठिनाई उत्पन्न हो जाएगी , उक्त अधिनियम के प्रयोजनार्थ हर ऐसी सेवा को , एनद्वारा [आवश्यक सेवा घोषित करती है ।

ORDER
New Delhi , the 22nd October 1971
8.O. 4036.Whereas the Central Government is satisfied that in the public interest it is necessary to make the following order ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of sec- tion 3 of the Essential Services Maintenance Act , 1968 ( 59 of 1968 ) , the Central Government hereby prohibits strikes in any service in the State of West Bengal connected with the supply of electrical energy to the public or with the genera- tion, storage or transmission of electrical energy for the purpose of such supply , which has been declared by the notification of the Government of India in the Ministry of Irrigation and Power , S.O. 4035 , dated the 22nd October , 1971 , to be an essential service for the purposes of the said Act or which falls under sub- clause (vifi ) of clause (a ) of sub- section ( 1 ) of section 2 of said Act .

का ० प्रा ० 4036.यतः केंद्रीय सरकार का यह समाधान हो गया है कि लोक हित में निम्नलिखित आदेश करना आवश्यक है :
अतः अब आवश्यक सेवाएं बनाए रखने का अधिनियम , 1968 ( 1968 का 59) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केंद्रीय सरकार एतद्वारा पश्चिमी THE GAZETTE OF INDIA EXTRAORDINARY

बंगाल राज्य में ऐसी किसी सेवा में हड़तालों का प्रतियेत्र करनी है जो जनता को विद्युत् ऊर्जा के प्रदाय से या एसे प्रदाय के प्रयोजनार्थ विद्युत् ऊर्जा के उत्पादन , भंडारकरण या पारेषण से संबंधित है जो भारत सरकार के सिचाई और विद्युत् मंत्रालय की अधिसूचना सं ० का ० आ० 4035 तारीख अक्तूबर 22 , 1971 द्वारा उक्त अधिनियम के प्रयोजनों के लिए आवश्यक सेवा घोषित की जा चुकी है या जो उक्त अधिनियम की धारा 2 की उपधारा ( 1 ) के खंण्ड ( क) के उपखण्ड ( viii ) के अधीन आती है ।
