ORDER
New Delhi , the 24th October 1973
S.O 663 ( E ) .- Whereas by the Order of the Government of India in the Ministry of Commerce S.O. No. 3981 , dated the 22nd December , 1965 , read with the Orders of the Government of India in the late Ministry of Foreign Trade Nos . S. O. 3495 , dated the 24th October, 1970 and S.O. 5535 , dated the 20th December , 1971 , and in the Ministry of Industrial Development No. S.O. 523 ( E ) dated the 27th September, 1973 , the management of the industrial undertaking known as Muir Mills Limited , Kanpur ( hereinafter referred to as the said industrial under- taking ) has been taken over under section 18A of the Industries ( Development & Regulation ) Act , 1951 ( 65 of 1951 ) , for a period upto and inclusive of the 21st December , 1974 ;
And whereas by the Order of the Government of India in the Ministry of Industrial Development (Department of Industrial Development ) No. S.O. 681 ( E ) / 18FB / IDRA / 72 dated the 25th October , 1972 ( hereinafter referred to as the said Order) , the Central Government in exercise of the powers conferred by clause

(b) of sub - section ( 1 ) of section 18FB of the Industries ( Development & Regula- tion ) Act , 1951 ( 65 of 1951 ) declared that the operation of all contracts , assu- rances of property , agreements , settlements , awards , standing orders or other in- struments in force immediately before the date of issue of the said Order ( other than those relating to secured liabilities to Banks and financial institutions and statutory liabilities payable to workers ) to which the industrial undertaking known as the Muir Mills Limited , Kanpur or the company owning such industrial undertaking is a party or which may be applicable to such industrial undertaking or company shall remain suspended for a period of one year and all the rights , privileges , obligations and liabilities accruing or arising thereunder before the said date shall remain suspended for the said period;
And whereas , the Central Government is satisfied that the duration of the said order should be extended by a further period of one year ;
Now , therefore , in exercise of the powers conferred by clause (b ) of sub- section ( 1 ) , read with sub - section ( 2 ) , of section 18FB of the Industries (Develop- ment and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby extends the duration of the said Order by a further period of one year .

का ० प्रा० 663 ( प्र ): -यतः भारत सरकार के भूनपूर्व विदेश व्यापार मंत्रालय के आदेश सं ० का ० आ ० 3495 , तारीख 24 अक्तूबर , 1970 तथा का ० आ ० 5535 , तारीख 20 दिसम्बर , 1971 तथा औद्योगिक विकास मंत्रालय के आदेश सं ० का ० श्र ० 523 (ई ) तारीख 27 सितम्बर , 1973 के साथ पठित भारत सरकार के वाणिज्य मंत्रालय के आदेश सं ० का ० आ ० 3981 , तारीख 22 दिमम्बर, 1965 द्वारा म्यूर मिल्स लिमिटेड , कानपुर ( जिसे इसमें इसके पश्चात उक्त औद्योगिक उपक्रम कहा गया है ) के नाम से शात औद्योगिक उपक्रम का प्रबन्ध , उद्योग ( विकास तथा विनियमन) अधिनियम , 1951 ( 1951 का 65 ) की धारा 18 क के अधीन 21 दिसम्बर , 1974 जिसमें यह दिन सम्मिलित है, ग्रहण कर लिया गया है ।
और यतः भारत सरकार के औद्योगिक विकास मंत्रालय ( औद्योगिक विकास विभाग ) के श्रादेश सं ० का ० आ ० 681 ( ई ) / 18 एरु बी/ आई डी आर ए/ 72 तारीख 25 अक्तूबर 1972 ( जिसे इसमें इसके पश्चात उक्त आदेश कहा गया है ) , द्वारा केन्द्रीय सरकार ने उद्योग ( विकास तथा विनियमन ) अधिनियमन 1951 ( 1951 का 65) की धारा 18 ( च ) (ख) की उपधारा ( 1 ) खण्ड ( ख , द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा की थी कि उक्त आदेश जारी होने की तारीख से ठीक पूर्व प्रवृत ( बैंकों और वित्तीय संस्थाओं के प्रतिशत दायित्व से सम्बन्धित , सांविधिक देयतायें जो कर्मचारियों को दी जानी हैं से भिन्न ) सभी संविदाओं, सम्पत्ति के हस्तान्तरण पत्नों, करारों, व्यवस्थापनों , अधिनिर्णयों, स्थायी आदेशों या लिखितों का प्रवर्तन जिनका म्यूर मिल्स लिमिटेड़, कानपुर , गामक औद्योगिक उपक्रम या ऐसे औद्योगिक उपक्रम का स्वामित्व करने वाली कोई कम्पनी THE GAZETTE OF INDIA EXTRAORDINARY

पक्षकार है या जो ऐसे औद्योगिक उपक्रम या कम्पनी को लागू है , एक वर्ष की अवधि के लिए नियंबिल रहेगा और उक्त तारीख के पूर्व तद्धीन उत्पन्न या उद्भूत होने वाले सभी अधिकार , विशेषाधिकार, वध्यनायें और दायित्त्व उक्त अवधि के लिए निनंबित रहेगा ।
श्रीर यनः केन्द्रीय सरकार का यह समाधन हो गया है कि उक्त आदेश की अवधि एक वर्ष के लिए और बढ़ा दी जानी चाहिए ।
अतः अब उद्योग ( विकास और विनियमन) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 (च ) ( ख ) की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतदत्र । रा उक्त आदेश की अवधि को एक और वर्ष के लिए बढ़ाती है ।
