Subject : Import of ' Dry fruits' ( S. No. 21 (a) ( i) ( IV) from IRAN during Aprli December, 1972 licensing period-Extension in the validity period.
No. 203 ITC ( PN) 73.-Attention of importers is invited to paragraph 2 of Ministry of Com- merce Public Notice No. 83 - ITC ( PN ) 73 , dated the 2nd June , 1973 , in terms of which , licences issued for import of ' Dry fruits ' from Iran for the period April- December , 1972 were valid upto 31st October , 1973 .
2. On a review of the position , it has been decided that the validity period of unutilized partially utilized licences , issued for import of ' Dry fruits ' from Iran in terms of the erstwhile Ministry of Foreign Trade Public Notice No. 135 - ITC (PN ) / 72 , dated the 15th September , 1972 may be deemed to have been extended upto 31st December , 1973. No endorsement to this effect is necessary to be made on the licences by the licensing authority concerned . The customs autho- rities will allow clearance within the extended date on the basis of this Public Notice, if the im- ports are otherwise in order.

विषयः--लाइसेन्स अवधि अप्रैल - दिसम्बर , 1972 के दौरान ईरान से ' सूखे फलों' ( क्रम सं० 21 ( ए ) ( 2 ) / 4 , का श्रयात- गंधता अवधि में वृद्धि:
संख्या 203 आई ० टी ० सी० पी ० एन ० ) / 73.--श्रायातकों का ध्यान वाणिज्य मंत्रालय की सार्वजनिक सूचना सं ० 83 - आई ० टी ०सी ० पी ० एम ० ) / 73, दिनांक 2 जून, 1973 के पैरा 2 की ओर आकृष्ट किया जाता है जिसके अनुसार अप्रैल - दिसम्बर 1972 अवधि के लिए ईरान से 'सूखे फलों' के आयात के लिए जारी किए गए लाइसेन्स 31 अक्तूबर , 1973 तक बंध थे ।
2. स्थिति की पुनरीक्षा करने पर यह निश्चय किया गया है कि भूतपूर्व विदेश व्यापार , मंत्रालय की सार्वजनिक सूचना सं ० 135 - आई ० टी ० सी ० ( पी ० एन ० ) / 72 दिनांक 15 दिसम्बर, 1972 के अनुसार ईरान से ' सुखे फलों' के आयात के लिए जारी किए गए बिना उपयोग किए गए / आंशिक उपयोग किए गए लाइसेन्सों की वैधता अवधि 31 दिसम्बर 1973 तक बढ़ा दी गई समझी जाए । सम्बद्ध लाइसेन्स प्राधिकारी द्वारा इस संबंध में लाइसेन्सों पर कोई पृष्ठांकन करना आवश्यक नहीं है । यदि आयात अन्य प्रकार से उचित होंगे तो सीमाशुल्क प्राधिकारी इस मार्वजनिक सूचना के आधार पर बढ़ाई गई अवधि के भीतर निकासी की अनुमति देंगे :
Subject :-Import of ' dates' ( S. No. 21 ( b ) / IV) from Iraq during 1973-74 Licensing period on annual basis .
No. 204 ITC ( PN ) / 73 .- This Public Notice contains the interim policy for import of ' dates ' from Iraq during 1973-74 licensing period , on annual basis . It has been decided to grant licences for import of ' dates' from Iraq to the established importers , having past import of dates from that country by Sailing vessels / Steamers etc. with in the pescribed basic years on the following basis .
Quota
(i) Established importers having past imports of 25 % subject to a minimum of Rs . 3,125. dates from Iraq upto Rs . 15 lakhs .
(ii ) Established importers having past impors of 23 3 / 4 % , subject to a minimum of Rs . dates from Iraq between Rs . 1,50,001 and Rs . 37,500 . 5 lakhs .
(iii ) Established importers having past imports of dates from Iraq between Rs . 5,00,001 and Rs . 15 lakhs . 20 % , subject to a minimum of Rs . 1,18,750 .
(iv) Established importers having past imports of 17 1 / 2 % , subject to a minimum of Rs . dates from Iraq of over Rs . 15 lasks . 3 lakhs .
2. The basic period for all established importers of ' dates ' from Iraq will be from 1956-57 to 1970-71 ; and for importers detailed in item ( i ) to ( iv ) of the Annexure to this Public Notice , the basic period will be as mentioned under each item .
3. The established importers should submit their applications to the Joint Chief Controller of Imports & Exports , C.G.O. Building , New Marine Lines , Churchgate , Bombay Joint Chief Controller of Imports & Exports , 4 , Esplanade East , Calcutta / Joint Chief Controller of Imports &Exports , 1st Line Beach , Madras / Joint Chief Controller of Imports & Exports , ( Cetral Licensing Indraprastha Bhavan , New Delhi / Dy . Chief Controller of Imports & Exports , T.D. Road, Ernakulam - 1, (according to the jurisdiction under which they fall) , on or before the 18th December, 1973. No past import documents are required to be produced , provided such documents were produced in the past and were accepted in the past by the licensing authority concerned for issue [FART I- S. 1 ] HE GAZETTE OF INDIA EXTRAORDINARY

of licences for import of dates from Iraq . However , the established importers should quote the number and date of licences obtained by them in the preceding two peperiods . The established importers , applying for the first time for grant of licences for import of dates from Iraq according to the current policy , should submit unimpeachabie documentary evidence of past import of 'dates' from Iraq within the prescribed basic years i.e. 1956-57 to 1970-71 .
4.. The importers who are cligible in terms of Annexure to this Public Notice will also be granted licences to the extent of Rs . 3,125 / - each , ( Rupces three thousand one hundred and twen- ty five only) , for import of dates from Iraq , irrespective of their past imports , subject to the pro- vision contained in paragraph 45 ( 2) of the import Trade Control Hand Book of Rules & Pro- cedure , 1973-74 with regard to division of quotas , They may submit their applications for im- 'port of ' dates ' from Iraq for 1973-74 period to Joint Chief Controller of Imports & Exports (Central Licensing Area) , Indraprastha Bhavan , New Delhi , on or before the 18th December 1973 , in the usual form and manner complete in all respects .
5. In addition to the importers mentioned in paragraphs I and 4 above Cooperative Socie- ties of preindependence freedom fighters , who were registered prior to 31st March, 1973 , wil also be granted licences for import of ' dates'of ' dates ' from Iraq , subject to the provision contained in para- graph 6 below. Such societles will be required to produce a certificate from the Home Depart- ment of the State concerned that all the members of the society are bonafide freedom fighters of pre- independence era . These societies should submit their applications to the Joint Chief Con- troller of Imports & Exports , (Central Licensing Area ) , Indraprastha Bhavan , New Delhi , on or before the 18th December , 1973 , in the usual form and manner , complete in all respects .
6. It may be noted that no double benefit will be given and the applicants should submit one application only either in terms of paragraph 1 to 3 or in terms of paragraph 4 of paragraph 5 above and they should clearly mention in their applications that they have applied in one сара- city only and not under both . In the case of Co - operative Societics covered by para ( v) of Annexure to this Public Notice and para 5 above , a certificate to the effect that no member of the society has applied for an import licence in his individual capacity or is the owner , proprietor , partner or share -holder in any body corporate , which has applied for an import licence under this Public Notice , should be produced.
7. All applicants should indicate in their applications the value which remained unutilised as on 1st July, 1973 , out of all the licences for import of dates from Iraq , received by them against Public Notices Nos . 95 - ITC (PN ) / 72 dated 1st July ,July , 1972 , 166 - ITC ( PN ) / 72 dated 22nd November , 1972 and 189 - ITC (PN ) / 72 dated 22nd December , 1972 .
8. Licences issued in terms of this Public Notice will be valid for import of dates from Iraq , subject to the condition that not less than 60 % of the face value of the licence shall have to be utilised for import of " dates " from Irag by Sailing vessels only and the balance 40 % by steamers etc.
9. All incomplete applications are liable to be rejected .
10. The licences issued in terms of this Public Notice will be valid upto the 30th June 1974 from the date of issue and no further extension in the validity period of the licences will be granted.
II . It may be noted that under the interim policy , the minimum value of import licences for dates from Iraq during 1973-74 will be Rs . 3,125/ - (Rupees three thousand one hundred and twenty five only) , subject to the provisions contained in para 45 (2 ) of I.T.C. Hand Book of Rules & Procedure , 1973-74 with regard to division of quotas .
12. The provisions of paragraph 84 ( 1 ) and 84 ( 2 ) of Section I of the Import Trade Control Policy Book (Vol . I ) for the period April , 73 - March 74 , relating to minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice .

(iii ) Established importers who have imports of fresh fruits to their credit from any of the countries in the 'General Area' including Pakistan but excluding Afghanistan during the period from 1945-46 to 1950-51 provided these imports had been accepted by the licensing authority for grant of ad-hoc licenses for import of fresh fruits from Pakistan during 1960 το 1964.
(i )Established importers who have imports of dry fruits to their credit from Pakistan during the period 1951-52 to 1970-71
(v) Co - operative Societies, dealing in fresh fruits subject to the production of a fresh certificate of registration from the con- cerned Registrar , Co- operative Sccieties , that they are still dealinging in fresh fruits , and also subject to the condition that the annual turnover is not less than Rs . 25,000/- The Cooperative Societies are required to produce the following certificatescertificates in respect of the prescribed turnover of Rs . 25,00/ .
(a) A certificate from a Chartered Accountant to the effect , that they had an internal turn- over of Rs . 25,000/- (Rupees twenty five thousand ) during any one of the financial ycars 1.e. 1967-68, 1968-69, 1969-70, 1970-71 and 1971-72 in fresh fruits ;

विषय .--लाइसेन्स अवधि 1973-74 के दौरान वार्षिक आधार पर ईराक से "खजूरों" ( क्रम संख्या 21 ( बी ) / 4 ) का श्रायात
संख्या 204 आई ० टी ०सी ० पी ० एन ० ) / 73-इस सार्वजनिक सूचना में लाइसेन्स अवधि 1973-74 के दौरान वार्षिक आधार पर ईराक से खजूरों के आयात के लिए अन्तरिम नीति निहित है । ईराक से 'खजूरों के आयात के लिए उन संस्थापित श्रायातकों को निम्नलिखित प्राधार पर लाइसेन्स प्रदान करने का निश्चय किया गया है जिन्होंने पालपोतों/स्टीमरों भादि द्वारा निर्धारित मूल वर्षों के भीतर उस से भूतकाल में खजूरों का आयात किया है: -
कोटा
25 प्रति शत न्यूनतम 3,125, रुपये की शर्त के अधीन
( 1 ) संस्थापित आयातक जिन्होंने भूतकाल में, ईराक रुपये तक के खजूरों के आयात किए है :
23 3/4 प्रति शत न्यूनतम 37,500 रुपये की शर्त के अधीन
( 2 ) संस्थापित श्रायातक जिन्होंने भूतकाल में ईराक से 1.50,001 रुपये और 5 लाख रुपये के बीज में खजूरों का मायात किया हो :
20 प्रति शत 1,18,750 रुपये की शर्त के अधीन
( 3) संस्थापित आयातक जिन्होंने भूतकाल में ईराक से 5,00,001 रुपये और 15 लाख रुपये के बीच खजूरों का मायात किया हो :
171/2 प्रति शत न्यनतम 3 साच रुपये की शर्त के अधीन
( 4 ) संस्थापित आयातक जिन्होंने भूतकाल में ईराक से 15 लाख रुपये से अधिक का आयात किया है:
2. ईराक के 'खजूरों' के सभी संस्थापित प्रायातकों के लिए अवधि 1956-57 से 1970-71 तक होगी, और इस सार्वजनिक सुचना के अनुबंध की मद ( 1 ) से ( 4 ) में वणित सा यातकों के लिए मूल अवधि प्रत्येक मद के अन्तर्गत उल्लिखित अनुसार होगी :

3. संस्थापित श्रायातकों को अपने श्रात्रेदनपत्न संयुक्त मुख्य नियंत्रक , आयात- निर्यात सी० जी ० ओ० बिल्डिंग्ज न्यू मेरिन लाइन्स , चर्चगेट , बम्बई, संयुक्त मुख्य नियंत्रक, आयात- निर्यात 4 , ऐस्प्लेनेड ईस्ट, कलकत्ता संयुक्त मुख्य नियंत्रक, आयात-निर्यात , आयात- निर्यात , फर्स्ट लाइन बीच, मंदास संयुक्त मुख्य नियंत्रक, श्रायात-निर्यात , ( केन्दीय लाइसेस क्षेत्र ) इन्द्रप्रस्थ भवन, नई दिल्ली , उप- मुख्य नियंत्रक, आयात- निर्यात टी० ड्री ० रोड एर्नाकुलम -1 ( जिसके अधिकार क्षेत्र में वे पड़ते हैं उसको ) 18 दिसम्बर , 1973 को या इस से पहले प्रस्तुत करने चाहिए । कोई भूतकालीन आयात दस्तावेज प्रस्तुत करने की आवश्यकता नहीं बशर्ते कि ऐसे दस्तावेज भुतकाल में प्रस्तुत किए गए थे । और वे सम्बद्ध लाइसेन्स प्राधिकारी द्वारा ईराक से खजूरों के आयात के लिए लाइसेन्स जारी करने के लिए स्वीकार कर लिए गए थे । लेकिन , संस्थापित श्रायातकों को पिछली दो अवधियों में उन के द्वारा प्राप्त किए गए लाइसेन्सों की संख्या और दिनांक उद्धत करने चाहिए वर्तमान नीति के अनुसार ईराक से प्रथमबार खजूरों का श्रायात करने के लिए लाइसेन्सों की स्वीकृति के लिए आवेदन करने वाले संस्थापित आयातकों को निर्धारित मूल वर्णों अर्थात 1956-57 को 1970-71 के भीतर ईराक से 'खजूरों' के भूतकालीन आयात का निर्दोष दस्तावेजी साक्ष्य प्रस्तुत करना चाहिये ।
4. वे आयातक जो इम सार्वजनिक सूचना की शर्तों के अनुसार पात्र हैं, उन्हे भी कोटों के बंटवारे को ध्यान में रखते हुए आयात व्यापार नियंत्रण हैंडबुक क्रियाविधि 1973-74 की कंडिका 45 ( 2) दी गई व्यवस्थाओं के अनुसार उनके भूत के निर्यातों को ध्यान में रखे बिना ही ईराक से खजूरों के आयात के लिए प्रत्येक 3,125 रुपये तीन हजार ( एक सौ पच्चीस रुपये मात्र ) की सीमा तक लाइसेस प्रदान किए जाएंगे 1973-74 की अवधि के लिए वे ईराक से "खजूरों " के आयात के लिए अपना आवेदन पत्र सामान्य रूप से और विधि के अनुसार सब प्रकार से पूर्ण करके 18 दिसम्बर 1973 को या उसके बाद संयुक्त मुख्य नियंत्रक , आयात- निर्यात ( केन्दीय लाइसेस क्षेत्र ) इन्द प्रस्थ भवन , नई दिल्ली को प्रस्तुत कर सकते हैं :
5. उपर्युक्त कंडिका 1 और 4 में उल्लिखित श्रायतकों के अतिरिक्त स्वतंत्रतापूर्व के स्वतंत्रता सेनानियों की ऐसी सहकारिता समितियों को भी ईराक से ' खजूरों ' के आयात के लिए नीचे की कंडिका 6 में उल्लिखित व्यवस्थाओं के अधीन लाइसेस प्रदान किए जाएंगे जो 31 मार्च, 1973 से पूर्व पंजीकृत हो चुकी हैं । ऐसी समितियों को संबंधित राज्यों के गृह विभाग से एक प्रमाण -पत्र प्रस्तुत करमा आवश्यक होगा कि समिति के सभी सदस्य पूर्व -स्वतंत्रता युग के मूल स्वतंत्रता सेमानी हैं । इन समितियों को अपना आवेदन पत्त्रसामान्य रूप से और विधि के अनुसार सभी प्रकार से पूर्ण करके 18 दिसम्बर 1973 को या इसके बाद संयुक्त मूख्य नियंत्रक , आयात - निर्यात ( केन्दीय लाइसेस क्षेत्र ) इन्द्रप्रस्थ भवन , नई दिल्ली को प्रस्तुत करना चाहिए ।
6. इसे जान लिया जाए कि दुहरा लाभ नहीं दिया जाएगा और आवेदकों को उपर्युक्त कंडिका 1 से 3 की शर्तों के अनुसार या कंडिका 4 या 5 की शर्तों के अनसार केवल एक ही आवेदन पत्र प्रस्तुत करना चाहिए और उन्हे अपने आवेदन पत्रों में स्पष्ट रूप से यह उल्लेख कर देना चाहिए कि उन्होंनें केवल एक हैसियत से ही अ वेदन किया है न कि दोनों को इस सार्वजनिक सूचना के अनुबंध की कंडिका ( 5 ) और उपर्युक्त कंडिका 5 के अन्तर्गत श्राने वाली सहकारिता समितियों के मामले में एक प्रमाण -पत्र प्रस्तुत करना चाहिए कि समिति के किसी सदस्य व अपनी व्यक्तिगत हैसियत से आयात लाइसेस के लिए आवेदन नहीं किया है या ऐसे निकाय निगम में स्वामी, मालिक , साक्षीदार या हिस्से- दार नहीं है जिस इसने सार्वजनिक सूचना के अन्र्तगत आयात लाइसेस के लिए आवेदन किया है :

7. सभी आवेदकों को चाहिए कि वे अपने आवेदन पत्नों में ऐसे मूल्य का संकेत करे जो उनके द्वारा सार्वजनिक सूचना संख्या 95 -आई ० टी ० सी (पी ० एन ० )/ 72, दिनांक 1 जुलाई 72, 166- आई ० टी० सी० ( पी ० एन ० )/ 72 दिनांक 22 नवम्बर 1972 तथा 189 - श्राई ० टी ० सी ० ( पी ० एन ० ) / 72 दिनांक 22 दिसम्बर , 1972 के मद्दे ईराक से खजूरों के आयात के लिए प्राप्त किए गए लाइसेंस में से 1 जनवरी 1973 की बिना उपयोग किए ही बच रहा था ।
8. इस सार्वजनिक सूचना के अन्तर्गत जारी किए गए लाइसेस ईराक से खजूरों के आयात के लिए इस शर्त के अधीन बंध होंगे कि लाइसेस के अंकित मूल्य का 60 प्रतिशत से कम का उपयोग ईराक से खजूरों के आयात करने के लिये केवल जलयान से नहीं किया जायेगा और बाकी 40 प्रति शत का स्टीमर आदि से ।
9. सभी अपूर्ण आवेदन पत्न रद्द कर दिये जायेगे ।
10. इस सार्वजनिक सूचना की शर्तों के अनुसार जरी किये गये लाइसेस उनको जारी करने की तारीख से 30 जून 1973 तक बंध होंगे और लाइसेमों को पुनर्बंध करने की आगे की कोई अवधि प्रदान नहीं की जायेगी ।
11. यह मोट कर लिया जाये कि अन्तरिम नीति के अन्तर्गत 1973-74 के दौरान ईराक से खजूरों के आयात के लिये लाइसेसों का न्यूनतम मुल्य 3125/ - रुपया ( तीन हजार एक सौ पच्चीस रुपये मात्त ) होगा और यह कोटे के बंटवारे को ध्यान में रखते हुए आयात व्यापार नियंत्रण है डंबुक क्रिया विधि, 1973-74 की कंडिका 45 ( 2 ) में उल्लिखित शर्तों के अधीन होगा ।
12. लाइसेंसों के न्यूनतम और अधिकतम मूल्यों मे संबंधित अप्रैल , 1973 मार्च 1974 अवधि के लिये श्रायात व्यापार नियंत्रण नीति पुस्तक ( वा ०1 ) के खंड -1 को कंडिका 84 ( 1 ) तथा 84 ( 2) की व्यवस्थाएं इस सार्वजनिक सूचना की शर्तों के अनुसार जारी किये गये लाइसेसों में लागू नहीं होंगी ।

( 2) वे संस्थाति आयातक जिनके क्रेडिट में 1951-52 से 1970-71 तक की अवधि के दौरान अफगानिस्तान को छोड़ कर किन्तु पाकिस्तान शामिल है , " सामन्य क्षेत्र" के किसी भी देश से ताजे फलों के आयात है ।
( 3 ) ये संस्थापित श्रायातक जिनके क्रेडिट में 1945-46 से 1950-51 तक की अवधि के दौरान अफ- गानिस्तान को छोड फर किन्तु पाकिस्तान शामिल है , "सामान्य क्षेत्र के किसी भी घेरा से ताजे फलों का आयात है बशर्ते कि 1960 से 1964 के दौरान पाकिस्तान से ताजे फलों के आयात के लिए तदर्थ लाइसेंस प्रदान किए जाने के लिए लाइसेंस प्राधिकारियों ने इन आयातों को स्वीकार कर लिया था ।
( 4 ) वे संस्थापित आयातक जिनके क्रेडिट में 1951-52 से 1970-71 तक की अवधि के दौरान पा- किस्तान से सूखे फलों के आयात है ।
d ( 5) वे सहकारिता समितियां जो ताजे फलों का व्यापार कर रही हैं । किन्तु यह इस शर्त के अश्रोन होगा कि ये संबद्ध सहकारिता समिति पंजीयक से पंजीकरण का एक नया प्रमाण -पत्र प्रस्तुत करे कि ये अब भी ताजे फलों के व्यापार कर रही ह और यह इस शर्त के भी अधीन होगा कि इनका वार्षिक कुल व्यापार 25,000 रुपये से कम नहीं है । सहकारितः समि- तियों को निर्धारित 25,000 रुपये PART I- SEC . 1 ] THE GAZETTE OF INDIA EXTRAORDINARY

के व्यापार के संबंध में निम्नलिखित प्रमाण-पत्र करना आवश्यक है :-
(क ) सनदी लेखापाल से इस संबंध में एक प्रमाण-पत्र कि वित्तीय वर्ष अर्थात 1067-68 , 1968-69. 1969-70 , 1970-71 और 1971-72 में से किसी भी एक वर्ष में ताजे फलों के व्यापार में इनका 25000 रुपये का अन्तरिम ब्यापार था ।
(ख ) निम्नलिखित प्रपत्तन में अनुसूचित बैंक से एक प्रभाण-पत्र :---

जारी करने की संख्या दिनांक .. यह प्रमाणित किया जाता है कि सर्वश्री का हमारे साथ बकिंग कारोबार है । इनकी अच्छी साख है । इन्होंने ......... रुपये मूल्य के आयात लाइसेंस के लिए आवेदन किया है ।
ये .......... का व्यापार करते हैं और इस व्यापार को करने के लिए तथा सीमा- शुल्क करों के भुगतान करने के लिए इनकी वित्तीय क्षमता है ।
बैंक द्वारा प्राधिकारी के हस्ताक्षर और मुहर ।
