New Delhi , the 29th November 1973
S : O. 719 ( E) .-Whereas the Central Government is satisfied that in relation to the textile undertaking specified incoln of the to thistheotification thereinafter refere gs in lumn (2 ) the Schedule to this notification ( hereinafter refered to Industrial a view to preventing the fall in the volume of production of textile industry :
Now, therefore , in exercise of the powers conferred by clause (b ) of sub - section ( 1 ) of section 7 of the Sick Textile Undertakings ( Taking Over of Management ) Act , 1972 ( 72 of 1972 ) the Central Government hereby decdeclares that the operation of all the concontracts , assurances of property , agree- ments , settlements , awards , standing orders or other instruments in force immediately before the date of issue of this notification to which the said industrial undertakings or the companies owning such undertaking as specified in column (3 ) of the said Schedule are parties or which may be applicable to the said industrial undertakings or companies , shall rer ain suspended for a period of one year from such date and that all the rights , privileges , obligations and liabilities (except those relating to banks and financial institutions ) accruing or arising thereunder before the said date shall remain suspended for the said period .

फा ०८०० 719 ( प्र) .-यत: केन्द्रीय सरकार का समाधान हो गया है कि इस अधिसूचना की अनुसूची के स्तंभ 2 में विनिर्दिष्ट कपड़ा उपक्रम ( जिन्हें इसमें इसके पश्चात् उक्त श्रौद्योगिक उपक्रम कहा गया है ) के संबंध में , कपड़ा उद्योग के उत्पादन की मात्रा में गिरावट को रोकने की दृष्टि से , जन- साधारण के हित में ऐसा करना आवश्यक है ;
श्रत : अब, रुग्ण कपड़ा उपक्रम ( प्रबन्ध- ग्रहण ) अधिनियम, 1972 ( 1972 का 72 ) की धारा 7 की उपधारा ( 1 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार यह घोषित करती कि है इस अधिसूचना के जारी किए जाने की तारीख से ठीक पूर्व प्रवृत्त ऐसी सभी संविदाओं: सम्पत्ति के हस्तान्तरणों, करारों , व्यवस्थाप्नों, पंचाटों , स्थायी आदेशों या अन्य लिखतों का , जिनकी उक्त औदयोगिक उपक्रम या उक्त अनुसूची के स्तंभ ( 3 ) में यथा विनिर्दिष्ट ऐसे उपक्रम का स्वामित्व रखने वाली कम्पनियां पक्षकार हैं या जो उक्त श्रौद्योगिक उपक्रमों या कम्पनियों को लागू होते हैं , प्रवर्तन ऐसी तारीख से एक वर्ष की अवधि के लिए निलम्बित रहेगा और उक्त तारीख से पूर्व उनकी अधीन प्रोद्भूत या उद्भूत होने वाले सभी अधिकार, विषेषाधिकार , बाध्यताएं और दायित्व ( सिवाय उनके जो नकों तथा वित्तीय संस्थाओं से संबंधित हैं ) उक्त अवधि के लिए निलम्बित रहेंगे ।
