ORDER
New Delhi , the 11th December 1973
S.O. 779 ( E ) .- Whereas the Central Government is satisfied from the docu- mentary evidence in its possession that the Bally unit of Messrs . Abrasives and Castings Limited , Calcutta (hereafter in this Order referred to as the said indus- trial undertaking ) has been closed for a period of not less than three months and that such closure is prejudicial to the concerned scheduled industry , namely , the iron and steel castings and forging industry and that the financial condition of the company owning the said industrial undertaking and the condition of the plant and machinery of such undertaking are such that it is possible to re- start the undertaking and such re- starting is necessary in the interests of the general public ;
Now, therefore , in exercise of the powers conferred by clause ( b ) of sub - section (1) of section 18AA of the Industries ( Development and Regulation ) Act , 1951 ( 65 of 1951) the Central Government hereby authorises a body of persons (hereinafter referred to as the authorised person ) , consisting of :-

1. Shri J.V.R. Prasad Rao , Deputy Secretary , ( Department of Labour ) , Gov ernment of West Bengal, Calcutta .
Member
2. Shri N. Ray , Deputy Secretáry, ( Department of Closed and Sick Indus- tries ) , Government of West Bengal, Calcutta .
to take over the management of the whole of the sald industrial undertaking subject to the following terms and conditions , namely :-
( 1 ) the authorised person shall comply with all directions issued from time to time by the Central Government .

(2) the authorised person shall hold office for a period of five years from the date of publication of this Order in the official Gazette, and ( 3 ) the Central Government may terminate the appointment of the authoris- ed person , earlier , if it considers it necessary to do so .
2. This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette .

का० ग्रा ० 779 ( श्र) यतः केन्द्रीय सरकार का अपने कब्जे में के दस्तावेजी माध्य से यह समाधान हो गया ह मेमर्स एग्रामिक्स एण्ड कास्टिंग लिमिटेड , कलकत्ता की बेली यूनिट (जिमे इसके पश्चात् आदेश में उक्त औद्योगिक उपक्रम कहा गया है ) तीन मास से श्रन्यून अवधि के लिए वद कर दी गई है और ऐसा बंद कर दिए जाने से संबद्ध अनुसूचित उद्योग , अर्थात् लोहा और इन्प्पान कलाई तथा गढ़ाई उद्योग पर प्रतिकूल प्रभाव पड़ता है और उक्त औद्योगिक उपक्रम के स्त्रामिन्य वाली कम्पनी की वित्तीय दशा तथा ऐगे उपक्रम के संयंत्र और मशीनरी की दशा ऐसी है कि उपक्रम को फिर चालू करना संभव है और इस प्रकार फिर से प्वालू करना जनसाधारण के हित मे श्रावश्यक है ;
श्रनः , अब, केन्द्रीय सरकार, उद्योग ( विकाम और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) की धारा 18 क की उपधारा ( 1 ) के खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए व्यक्तियों के एक निकाय ( जिसे इसमें इसके पश्चात् प्राधिकृत व्यक्ति कहा गया है ) को, जिसमें निम्नलिखित व्यक्ति होंगे

उप सचिव ,
(श्रम विभाग ) ;
पश्चिमी बंगाल सरकार , कलकत्ता ।
मदम्य
2 . श्री एन ० रे,
उप सचिव ,
(बन्द और बीमार उद्योग विभाग ) ;
पश्चिमी बंगाल ,
कलकत्ता ।
उक्त औद्योगिक उपक्रम का सम्पूर्ण प्रबन्ध ग्रहण करने के लिए, निम्नलिखित निबंधनों और णों के अधीन रहते हुए, प्राधिकृत करती है , अर्थात्: --
( 1 ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय समम पर जारी किए गए सभी निदेशों का अनुपालन करेगा ;
( 2 ) प्राधिकृत व्यक्ति इस आदेश के राजपत्त्र में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए पद धगरण करेगा, और THE GAZETTE OF INDIA EXTRAORDINARY

( 3) केन्द्रीय सरकार , प्राधिकृत व्यक्ति की नियुनत , यदि वह ऐसा करना काश्रयः समझती हो, उसके पहले ही समाप्त कर सकेंगी
2. यह आदेश राजबल में प्रकाशन की तारीख से प्रारम्भ हो कर पांच वर्ष की अवधि के लिए प्रभावी रहेगा ।
