New Delhi , the 14th December 1973
S.O. 782 ( E ) .-Whereas the Central Government is satisfied from the docu- mentary evidence in its possession that the industrial undertaking known as Messrs . Arthur Butler and Company ( Mozufferpore ) Limited , Muzaffarpur ( Bihar ) , has been closed for a period exceeding three months and such closure is prejudicial to the concerned scheduled industry namely , Railway Rolling Stock , and that the financial condition of the company owning the industrial undertaking and the condition of the plant and machinery of such undertaking are such that it is possi- ble to re - start the undertaking and such re - starting is necessary in the interests of the general public ;
Now , therefore , in exercise of the powers conferred by clause ( b ) of sub -section ( 1 ) of section 18AA of the Industrles ( Development & Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government hereby authorises Shri Anwarul Huda , District Magistrate, Muzaffarpur ( hereinafter referred to as authorised person ) to take

over the management of the whole of the said industrial undertaking , namely , Messrs . Arthur Butler and Company ( Muzaffarpur ) Limited , Muzaffarpur , sub- ject to the following terms and conditions ; namely :-
( 1 ) The authorised person shall comply with all directions issued from time to time by the Central Government ;
(2) The authorised person shall hold office of four years from the date of publication in the Official Gazette of this order;
( 3 ) The Central Government may terminate the appointment of the authoris- ed person earlier if it considers necessary to do so .
2. This order shall have effect for a period of four years commencing from the date of its publication in the Official Gazette .

नई दिल्ली , 14 दिसम्बर , 1973
एस ० श्रो० 782 ( प्र) -यतः केन्द्रीय सरकार का अपने कब्जे में के दस्तावेजी साध्य आर्थर बटलर एण्ड कम्पनी ( मुजफ्फरपुर ) लिमिटेड, औद्योगिक उपक्रम तीन मास से अधिक की अवधि के में यह समाधान हो गया है कि मैसर्स मुजफ्फरपुर ( बिहार ) के नाम से ज्ञान लिए बन्द कर दिया गया है । और ऐसा बन्द किया जाना संबद्ध अनुसूचित उद्योग , अर्थात्, रेलवे रोलिंग स्टाक , पर प्रतिकूल प्रभाव डालने वाला है और उस कम्पनी की, जिसके स्वामित्व में वह श्रौद्योगिक उपक्रम है , वित्तीय दशा और ऐसे उपक्रम के प्लांट और मशीनरी की दशा ऐसी है कि उपक्रम का पुनः प्रारम्भ किया जाना संभव है तथा ऐसा पुनः प्रारम्भ किया जाना साधारण जनता के हित में है ;
अतः , अब , केन्द्रीय सरकार , उद्योग ( विकास और विनियमन ) अधिनियम , 1951 (1951 का 65 ) की धारा 18 कक की उपधारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , श्री अन्वरुल हुदा , जिला मजिस्ट्रेट, मुजफ्फरपुर ( जिसे इसमें इसके पश्चात प्राधिकृत व्यक्ति कहा गया है ) को उक्त श्रौद्योगिक उपक्रम , अर्थात्, मैसर्स आर्थर बटलर एग्ड कम्पनी ( मुजफ्फरपुर ) लिमिटेड , मुजफ्फरपुर , का समस्त प्रबन्ध निम्नलिखित निवन्धनों और शौ के अधीन ग्रहण करने के लिए प्राधिकृत करती है , अर्थात्:--
( 1 ) प्राधिकृत व्यक्ति केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए सभी निदेशों का अनुपालन करेगा ;

( 2 ) प्राधिकृत व्यक्ति इस श्रादेश के राजपत्र में प्रकाशन की तारीख से चार वर्ष के लिए पद धारण करेगा ;
( 3) यदि केन्द्रीय सरकार ऐसा करना आवश्यक समने तो वह प्राधिकृत व्यक्ति की नियुक्ति पहले ही समाप्न कर सकेगी ।
2. यह आदेश राजपत्र में प्रकाशन की तारीख मे प्रारम्भ होने वाली चार वर्ष की अवधि के लिए प्रभावी होगा ।
