MINISTRY OF INDUSTRIAL DEVELOPMENT
ORDER
New Delhi , the 24th December 1973
S.O. 793 ( E ) .- Whereas the industrial undertaking known as Messrs , Britannia Engineering Works ( Wagons Division ) , Mokameh , in the State of Bihar , is engaged in the Scheduled industries , namely , metallurgical and transportation industries ;
And whereas the company owning the said industrial undertaking , namely , the Britannia Engineering Company Limited , is being wound - up by the Calcutta High Court ;
And whereas the Central Government is of the opinion that it is necessary in the interests of the general public , and in particular , in the interests of production , supply and distribution of articles relatable to the concerned scheduled industry, to investigate into the possibility of re - starting the sald industrial undertaking :
And whereas on an application made by the Central Government under section 15A of the Industries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) to the Calcutta High Court praying for permission to make an investigation into such possibility , the Calcutta High Court has granted the permission ;
Now, therefore , in exercise of the powers conferred by section 15A of the Indus- tries (Development and Regulation ) Act , 1951 ( 65 of 1951 ) , the Central Government

hereby appoints , for the purpose of making an investigation into the possibility of re- starting the aforesaid industrial undertaking , a body of persons consisting of-

( 2) Shri R. N. Dash , District Magistrate , Patna .
( 3 ) Shri R. N. Chowdhry , Industrial Adviser ( Engineering ) , Government of Bihar.
(4 ) Shri M. K. Mandal , Manager ( Technical ) , Industrial Reconstruction Cor- poration of India , Calcutta .
2. The above body shall submit its report within a period of 15 days from the date of publication of this Order in the Official Gazette .

एस ० प्रो० 793 ( श्र ) यतः बिहार राज्य में मैसर्स ब्रिटानिया इंजीनियरिंग वर्क्स (बैंगन डिविजन ) , मोकामा, नामक औद्योगिक उपक्रम अनुसूचित उद्योगों, अर्थात् धातुकामिव और परिवहन उद्योगों में लगा है ;
श्रऔर यतः जिस कम्पनी के स्वामित्व में उक्त औद्योगिक उपक्रम , अर्थात् ब्रिटानिया इंजीनियरिंग कम्पनी , लिमिटेड है उसका कलकत्ता उच्च न्यायालय द्वारा परिसमापन किया जा रहा है ;
और यतः केन्द्रीय सरकार की राय यह है कि साधारण लोकहितों में , और विशिष्ट रूप से, सम्बद्ध अनुसूचित उद्योग से सम्बन्धित वस्तुश्रो के उत्पादन, प्रदाय और वितरण के हितो में उक्त श्रौद्योगिक उपक्रम को फिर से चालू किए जाने की संभावना में अन्वेषण करना श्रावश्यक है ।
और यतः केन्द्रीय सरकार द्वारा उद्योग ( विकास और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 15 क के अधीन कलकत्ता उच्च न्यायालय को किए गए आवेदन पर, जिसमें ऐसी संभावना के बारे में अन्वेषण करने की अनुशा के लिए प्रार्थना की गई है , कलकत्ता उच्च न्यायालय ने अनुज्ञा दे दी है ;
श्रनः , श्रब , केन्द्रीय सरकार , उद्योग ( विकाम और विनियमन ) अधिनियम , 1951 ( 1951 का 65 ) की धारा 15 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उपर्युक्त औद्योगिक उपक्रम को फिर से चालू किए जाने की संभावना के बारे में अन्वेषण करने के प्रयोजन के लिए एक निकाय नियुक्त करती है जिममें निम्नलिखित व्यक्ति होंगे
