SUBJECT. Import of Fruits , dried, salted or preserved all sorts , N.O.S. excluding Dates (S. No. 21 ( a ) ( it ) / IV ) , ( ii ) Dates ( S. No. 21 ( b ) / IV ) , ( iii ) Medical Herbs (Crude drugs ) ( S. No. 87-109 - IV ) , ( iv ) Asafoetida ( S. No. 31 ( b ) / V ) and other Miscellaneous items from IRAN during January- June , 1974 .
No. 25 - ITC ( PN ) /74.-It has been decided to grant licences for import of various commodities from Iran during January- June , 1974 to the established importers , having past imports within the prescribed basic years , as shown against each item in Annexure I to this Public Notice . The licensing policy for each item has been Indicated in column 6 of the aforesaid Annexure .
2. The established importers , eligible in terms of the current policy may submit their applications to the respective licensing authority viz . Joint Chief Controller

of Imports & Exports , Bombay or Joint Chief Controller of Imports & Exports , (Central Licensing Area ) , New Delhi on or before the 18th March , 1974 in the usual form and manner . No past import documents are required to be produced, provided such documents were submitted to the licensing authority concerned in the past and were accepted by them for issue of licences for import of commodities from Iran, indicated in Annexure I. They should , however , quote details of licences obtained in the preceding two periods . Where , however , the established importers are applying for the first time , they are required to produce unimpeach- able documents relating to past imports from Iran in respect of the items as in Annexure I for any one year within the prescribed basic years .
3. It has also been decided that the imports , who are eligible in terms of Annexure II to this Public Notice will also be granted licences for import of dry fruits only from Iran on equal value basis . They may submit their applications for import of dry fruits only from Iran for January- June , 1974 licensing period to Joint Chief Controller of Imports & Exports , ( Central Licensing Area ) , New Delhi fon or before the 18th March , 1974 , in the usual form and manner , complete in all respects .
4. The minimum value of licences for dry fruits will be Rs . 3,000 . It has also been decided that those Established importers who were granted minimum value licences for Rs . 3,000 for import of dry fruits from Iran , when the quota percentage was 10 per cent , will continue to get minimum value licences for Rs . 3,000 not withstanding the fact that the quota percentage has now been reduced to 8 per cent . The minimum value of licences for dates , Asafoetida and gums & resins , licensable on quota percentage basis , will be Rs . 500 for the half year . It is , however, clarified that in the case of transfer / division of quota by established importers relating to above cases , the succeeding parties will be entitled to get licences in proportion to their share in approved quota of the original firm as provided in para 45 ( 2 ) of the I.T.C. Hand Book of Rules & Procedure , 1973-74 . Where the licences are issued on equal value basis in terms of this Public Notice, the entitlement of each party is to be divided proportionately among the split -up concerns of the parent firm , in case of transfer/ division of quota rights .
5. It may be noted that no double benefit will be given in respect of dry fruits , which is permitted for import both under Annexure I and Annexure II .Annexure II . The applicants for dry fruits should submit only one application efther in terms of Annexure I or in terms of Annexure II ; and they should clearly mention in their application that they have applied in one capacity only and not under both.
6. Established importers , holding quota certificates for Crude Drugs on General Currency Area, which includes Iran , who are desirous of claiming licences under this policy , have to have past imports of Crude Drugs from Iron in a different basic year than the one for which they hold quota certificates on General Currency Area . Evidence to this effect should be produced to the licensing authority , so that no double benefit accrues in respect of the same past imports .
7. Licensing will be done within the monetary limit fixed for each item . All incomplete applications are liable to be rejected .
8. Import licences granted in eligible cases will be valid for import from Iran either by Sailing vessels or Land route . In the case of dry fruits , import will also be allowed by Steamships upto the full face value of the licence and such imports will be on c.i.f. basis. In the case of ' Dates ' import should be effected by Sailing vessels or Land route upto 60 per cent of the face value of the licences and the balance 40 per cent by other means , viz . Steamship ; if the licensees so desire , at any time during the validity period of the licences .
9. Import licences issued in pursuance of this Public Notice will be valid for six months and will not be extended .
10. The provisions of paragraph 84 ( 1 ) and 84 ( 2 ) of Section I of the Import Trade Control Policy Book ( Vol . I ) for the period April 1973 -March 1974 , relating to minimum and maximum value of licences will not apply to the licences issued in terms of this Public Notice .

(iii) Established Importers who have imports of fresh fruits to their credit from any of the count- ries in the ' General Area' including Pakistan but exclu- ding Afghanistan during the period from 1945-46 to 1950-51 , provid- ed these imports had been accept- ed by the licens- ing authority for grant of ad -hoc licences for import of fresh fruits from Pakistan during 1960 to 1964 .
(iv) Established importers who have imports of dry fruits to their credit from Pakistan during the period from 1951-52 1970-71 . to

विषय-- जनवरी--जून, 1974 के दौरान फलों , मेवे , नमकीन अथवा हर प्रकार के परिरक्षित खजूरों को छोड़कर अन्यथा जो उल्लिखित नहीं हैं ( क्र ० सं ० 21 ( ए ) ( 2 ) 1 ( 4 ) , खजूरक्रम संख्या: 21 ( बी ) 14, ( 3 ) औषधीय बूटियां ( अपरिष्कृत औषधियां ) क्रम संख्या : 87क 109-4) , ( 4) हींग (क्र० सं० 31 (बी ) 15 तथा अन्य विविध मदों का ईरान से आयात ।
सं०: 25- आई ० टी ० सी० पी ० एम ० )/ 74.- प्रस्तुत सार्वजनिक सूचना के अनुबन्ध- 1 के लिये दिखाई गई मदों में से हर एक अलग मद के लिए जनवरी-जून , 1974 की अवधि के लिए संस्थापित श्रायातकों को , जिन्होंने विहित आधार पर भूत वर्ष में आयात किया था , ईरान से विभिन्न पदार्थों के आयात के लिए लाइसेंस देने का निश्चय किया गया है । हर एक मद के लिए लाइसेंस देने की नीति णित अनुबन्ध के कालम 6 में बताई गई है ।

2 . वर्तमान आयात नीति के अन्तर्गत पात्र संस्थापित श्रायातकों को चाहिए कि वे अपना आवेदन पत्त्र सम्बन्धित लाइसेंस जारी करने वाले प्राधिकारी अर्थात् संयुक्त मुख्य नियंत्रक , आयात-निर्यात , बम्बई या संयुक्त मुख्य नियंत्रक ( केन्द्रीय लाइसेंस क्षेत्र ) , नई दिल्ली को विहित प्रपत्न में और विधिरूप से 18 मार्च, 1974 तक अथवा उससे पहले भेज दें । पिछले किए गए आयात से सम्बद्ध दस्तावेजों को प्रस्तुत करने की आवश्यकता नही है , बशर्ते कि उन दस्तावेजों को सम्बद्ध लाइसेंस प्राधिकारी को ईरान से पदार्थों के आयात लाइसेंसों के लिए , जिन पदार्थों का उल्लेख अनुबन्ध 1 में किया गया है, पहले भेजा गया था और वे मंजूर कर लिए गए थे । परन्तु, उनके लिए यह आवश्यक होगा कि उन्होंने पूर्वगत दो अवधियां में जो लाईसेंम लिए थे , उनका ब्यौरा ३, परन्तु जहां संस्थापित आयात पहली बार पत्र भेज रहे हैं, उन्हें चाहिए कि विहित आधार भूत वर्ष में में किसी एक वर्ष में ईरान से आयात की गई मदों का, जिनका ब्यौरा अनुबन्ध -1 में दिया गया है, उससे सम्बन्धित संशयातीत दस्तावेजों को प्रस्तुत करें ।
3. यह भी निश्चय किया गया है कि ऐसे आयातक , जो प्रस्तुत सार्वजनिक सूचना के अनुबन्ध- 2 के अन्तर्गत योग्य है , उन्हें केवल ईरान से ममान मूल्य के आधार पर सूखे फलों के आयात के लिए लाइसेंस भी दए जायेंगे । उन्हेंचाहिए कि वे जनवरी , जन , 1974 की लाइसेंस अवधि के लिए ईरान से केवल सूखे फलों के आयान के लिए आवेदन-पत्त्रों को हर प्रकार से पूरा करके विहित प्रपत्त्र में और विधिरूप से संयुक्त मुख्य नियंत्रक, श्रयान- निर्यात ( केन्द्रीय लाइसेंस क्षेत्र ) , नई दिल्ली को 18 मार्च , 1974 तक अथवा उससे पहले भेज दें ।
4. सूख फलों के लिये लाइसेंसों का न्यूनतम मूल्य 3,000 रुपये होगा । इस बात का भो निश्चय किया गया है कि जिस समय कोटा प्रतिशतता 10 प्रतिशत थी , उन संस्थापित आयातकों को जिन्हें ईरान से सूखे फलों के आयात के लिए न्यूनतम मूल्य 3,000 रुपये के लिए लाइसेंस स्वीकृत किए गए थे जब कोटा प्रतिशत 10 प्रतिशत थी, कोटा प्रतिशत घटाकर 8 प्रतिशत कर दिया गया है तो भी वे न्युनतम मुल्य 3,000 रुपये के लिए लाइसेंस प्राप्त करते रहेंगे । खजूर , हींग और गोंद तथा रेजिन्स जो कोटा प्रतिशतता के श्राधार पर लाइसेंस के योग्य है, उनके लिए 6 मास के लिए लाइसेंस का न्यूनतम मूल्य 500 रुपये होगा । लेकिन इस बात का स्पष्टीकरण किया जाता है कि उपर्युक्त मामलों से सम्बन्धित सस्थापित आयातकों द्वारा कोटा के स्थानान्तरण विभाजन की स्थिति में आयात व्यापार नियत्रण नियम और कार्यविधि , हैंउबक , 1973-74 की कडिका 45 ( 2 ) में दी गई व्यवस्थाओं के अनुसार अनुवर्ती पार्टियां मूल फर्म के स्वीकृत फौटे में से अपने हिस्से के अनुपात में लाइसेंस प्राप्त करने के अधिकारी होंगी । प्रस्तुत सार्वजनिक सूचना के अनुसार जहां समान मुख्य के आधार पर लाइसेंस दिए जाते हैं, कोटा अधि- कारों के स्थानान्तरण । विभाजन होने की स्थिति में मूल फर्म से सम्बन्धिप्त विपाटी के भीतर हर एक पार्टी के हक का अनुपातिक रूप से आवंटन किया जाता है ।
5. यह ध्यान रहे कि सूखे फल जो अनुबन्ध 1 तथा 2 दोनों के अन्तर्गत आयात के लिए अनुजप्त है , इनके संबन्ध में दोनों प्रकार के लाभ नहीं दिए जाएगे । सूखे फलों के आयात करने वाले आवेदकों को चाहिए कि वे या तो अनुबन्ध 1 की शर्तों के अनुसार अथवा अनुबन्ध 2 की शर्तों के अनुसार केवल एक ही आवेदनपत्त्र भेजे और उन्हें चाहिए कि वे अपने आवेदन पत्रों में स्पष्ट रूप से लिख दें कि उन्होंने केवल एक के लिए आवेदनपत्र भेजा है न कि दोनों के लिए । :
6. मामान्य मुद्रा क्षेत्र , जिसमें ईरान सम्मिलित है, से अपरिष्कृत भेषजों के लिए कोटाधारी संस्थापित आयातक जो इस नीति के अन्तर्गत लाइसेंस प्राप्त करने के इच्छुक है, उनके लिए यह श्रनिवार्य है कि जिस वर्ष के लिए उनके पास सामान्य मुद्रा क्षेत्र के लिए कोटा प्रमाण - पत्र है , उससे भिन्न किसी एक मूल " वर्ष में , भूतकाल में उन्होंने ईरान से अपरिष्कृत भेषजों का गायात किया हो । इस THE GAZETTE OF INDIA EXTRAORDINARY

सम्बन्ध में , लाइनेंस प्राधिकारी को साक्ष्य प्रस्तुत करना चाहिए जिससे कि भूतकाल में किए गये एक ही प्रकार के आयातकों के लिए दो तरफा लाभ उपार्जित न किया जाए ।
7 . हर एक मद की निश्चित मौद्रिक सीमा के भीतर ही लाइसेंस दिया जायगा । सभी अधूरे आवेदन - पलों को अस्वीकृत कर दिया जायगा ।
8. वैध मामलों में दिए जाने वाले आयान लाइमसों का ईरान से नौ प्रस्थान पोतों अथवा स्थल मार्गों से आयात के लिए वैध माना जायगा । सूखे फलों के मामले में , लाइसेंसों के पूरे अकित मुल्य तक पोतनाव द्वारा आयात करने की भी इजाजत होंगी और ऐसे आयातों का आधार लागत- बीमा -भाड़ा होगा । खजूरों के आयात के मामले में , 60 प्रतिशत तक के लाइसेंस के अंकित मुल्य तक आयात नौप्रस्थान पोतों अथवा म्थल मार्गों द्वारा होना चाहिए और यदि लाइसेंसधारी लाइसेंस की वैध अवधि के दौरान किसी भी समय आयात करने के इच्छुक है तो शेष 40 प्रतिशत दूसरे साधनों जैसे पोत नाव द्वारा कर सकते हैं ।
9. प्रस्तुत सावजनिक सूचना के विषय में जारी किए गए लाइसेंस छः मास के लिए वैध होंगे तथा भविष्य में उनकी अवधि नहीं बढ़ाई जायगी ।
10. अप्रैल , 73 -- मार्च , 74 अवधि के लिए आयात व्यापार नियंत्रण नीति पुस्तक ( वा ०1 ) के खंड 1 की कंडिका 84( 1) तथा 84 ( 2 ) में दी गई व्यवस्थाए जो लमइसेंमों के न्यूनतम तथा अधिकतम मूल्य से सम्बन्धित है , इस सार्वजनिक सूचना के अनुमार जारी किए गए लाइसेंसों के लिए लागू नहीं होंगी ।
