S.O. 344 (E ) . In pursuance of paragraph 25 of the Drugs ( Prices Control ) Order 1970 the Central Government hereby makes the following further amend- ment in the Order of the Government of India in the Ministry of Petroleum and Chemicals No. S.O. 2602, dated the 30th July, 1970 , namely:-
In the said Order . for the figures and word " 10 lakhs" , the figures and word " 30 lakhs " shall be substituted .

एस ० श्री० 344 ( अ ) केन्द्रीय सरकार, औषधि ( कीमत नियंत्रण ) आदेश , 1970 के पैरा 25 के अनुसरण में , भारत सरकार के पैट्रोलियम और रसायन मंत्रालय के आवेश संख्या का० प्रा० 2602 , तारीख 30 जुलाई , 1970 , में निम्नलिखित और संशोधन करती है , अर्थात:-
उत्न आदेश में, " 10 लाख अंकों और सब्द के स्थान पर 50 लाख " अंक और शब्द रखे जाएंगे ।

S.O. 345 ( E ) . In pursuance of paragraph 25 of the Drugs ( Prices Control ) Order, 1970 , and in supersession of the Order of the Government of India in the Ministry of Petroleum and Chemicals No. S.O. 1487 , dated the 1st April , 1971 , the Central Government hereby exempts every drug manufacturing unit, with an annual turnover not exceeding fifty lakhs of rupees as recorded in the last accounting period,-
( a) from the operation of paragraph 10 of the said Order in so far as it relates to new packs , subject to the conditions that
(i) the pricesprices to be fixed for new packs , larger than the existing packs , will be proportionately lower than the prices of the existing packs;
( it ) the prices to be fixed for new packs , smaller than the existing packs , will be fixed pro rata on the basis of the prices of the existing packs;
( ii ) a report that new packs have been introduced shall be made to the Central Government within a week of the marketing thereof toge- ther with the details of how the prices have been fixed:
(b) from the operation of paragraph 10 of the said Order in so far as it relates to new formulations and sub - paragraph ( 1 ) of paragraph 13 of the said Order relating to revision of price , subject to the condition that a report shall bebe made to the Central Government within a week of the introduction of the new formulation or revision of retail price of an existing formulation together with the details showing how the price has been fixed , or revised , as the case may be .
Explanation.- For the purposes of this Order , a drug manufacturing unit which is established after the date of publication of this Order in the Official Gazette and markets its products for the first time shall , during the first accounting year of its existence , be deemed to be a unit with an annual turnover not exceed- ing fifty lakhs of rupees .

एस ० श्री० 345 ( प्र ) . औषध ( कीमत नियंत्रण ) आवेश , 1970 के वैरा 25 के अनु सरण में और, भारत सरकार के पैट्रोलियम तथा रसायन मंत्रालय के आदेश संख्या का ० ० 1487 , तारीख 1 अप्रैल, 1971 को अधिक्रान्त करते हुए , केन्द्रीय सरकार , ऐसे प्रत्येक औषध निर्माण करने वाले एकक को जिसकी गम लेवा अवधि में यथा अभिलिखित वाषिक कुल बिक्री पचास लाख रुपये से अधिक नहीं हो,
(क ) उस आदेश के पैरा 10 के प्रवर्तन से , जहां तक उसका सम्बन्ध नये बैंकों में है, निम्नलिखित शर्तों पर छूट देती है, अर्थात् ---
( i ) वर्तमान पैकों की तुलना में बड़े नये पैकों के लिए निर्धारित की जाने बाली कीमतें वर्तमान पैकों की कीमतों की तुलना में अनुपातमः कम होगी ;
( ii ) वर्तमान पंकों की तुलना में छोटे नये पैकों के लिए निर्धारित की जाने वाली कीमतें वर्तमान पैकों की कीमतों के आधार पर अनुपानी रूप से निर्धारित की जाएंगी;
( iii ) इस बात की सूचना कि नये पैक प्रचन्नन में लाए गए हैं, उनकी बिक्री के एक सप्ताह के भीतर , इस ब्यौरे सहित कि कीमतें किस प्रकार निर्धारित की गई है , केन्द्रीय सरकार को भेजी जाएगी.
(ख ) जहां तकः उ५ त आदेश का सम्बन्ध नये सूत्रयोगों से है उक्त आदेश के पैरा 10 , तथा कीमतों के पुनरीक्षण के सम्बन्ध में उक्त आदेश के पैरा 13 के उप-पैरा ( 1 ) , के प्रवर्तन में इस शर्त पर छूट देती है कि सये सूवयोगों के प्रचलन या वर्तमान THE GAZETTE OF INDIA EXTRAORDINARY

सूत्रयोगों की फुटवार कीमतों के पुनरीक्षण के एक सप्ताह के भीतर , इस ब्यौरे सहित कि कीमतें यथास्थिति , किस प्रकार निर्धारित वा पुनरीक्षित की गई हैं , एक रिपोर्ट केन्द्रीय सरकार को भेजी जाएगी ।
स्पष्टीकरण. इस आवेश के प्रयोजनों के लिए , औषध निर्माण करन वाला ऐसा एकक ओ इस आदेश के राजपत्र में प्रकाशन की तारीख के पश्चात् स्थापित किया जाए तथा पहली बार अपने उत्पादों का विक्रय करे, अपने स्थापन के प्रथम लेखा वर्ष के श्रीगन ऐसा एकक समझा जाएगा जिसकी कुल वार्षिक विक्री पचास लाख रुपये में अधिक नहीं है ।
