ORDER
New Delhi , the 6th June 1971
G.S.R. 263 ( E ) .- In exercise of the powers conferred by section 3 of the Essen- tial Commodities Act , 1955 ( 10 of 1955 ) , the Central Government hereby makes the following Order, namely : -
1. Short title , extent and commencement .-( 1 ) This Order may be called the High Speed Diesel Oil and Light Diesel Oil ( Restriction on Use ) Order , 1974 .
(2) It extends to the whole of India .
( 3 ). It shall come into force on the 10th day of June , 1974 .
2. Definitions. In this Order , High Speed Diesel Oil and Light Diesel Oll shall have the meanings respectively assigned to them in Item No. 8 and Item 9 of the First Schedule to the Central Excises and Salt Act , 1944 ( 1 of 1944 ) .
3. Restriction on use of High Speed Diesel Oil and Light Diesel Oil . No person shall , without the previous permission in writing of the State Government or any officer authorised by it in this behalf , use or permit the use of High Speed Diesel Oil or Light Diesel Oil in generating electricity for the purpose of providing electric Hghting on any festive occasion .
Explanation. In this clause, " festive occasion " means any marriage , religious or funeral ceremony and includes any other occasion of a ceremonial nature .

4. Power of entry , searchsear and seizure . Any police officercer not below the rank of a Head Constable , or any other officer of Government or of above an equivalent rank authorised in this behalf by the State Government may , with a view to securing compliance with this Order or to satisfying himself that this Order or any order made thereunder has been complied with.-
(a ) enter and search any place , premises , or vessel , which , the officer has reason to believe , has been , or is being , or is about to be , used for the contravention of this Order or any order made thereunder ;
(b ) seize stocks of iligh Speed Diesel Oil or Light Diesel Oil in respect of which he has reason to believe that a contravention of the provisions of this Order or of any order made thereunder has been , or is being . or is about to be , made .

सा ० फा ० नि ० 263 ( प्र) केन्द्रीय सरकार , श्रावण्यथ वस्तु अधिनियम, 1955 ( 1955 फा 10 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित श्रादेण करती है, श्रर्थासः--
1. सक्षिप्त नाम, विंग और प्राग्भ्भ ( । ) इम श्रादेश का मक्षिप्त नाम हाई स्पीड डीजल तेल और लाइट डीजल तेल ( उपयोग पर निर्बन्धन ) आदेश, 1974 है ।
( 2 ) इसका विस्तार समर। भारत पर है ।
( 3 ) यह 10 जून . 1974 को प्रवृत्त होगा ।
2. परिभ षाए - इम आदेश में . हाई स्पीड डीजल तेल और लाइट डीजल तेल के यही अर्थ होंगे जो केन्द्रीय उत्पाद शुल्क और नमक अधिनियम. 1944 ( 1944 का 1 ) की प्रथम अनुसूची में क्रमणः मद में ० 8 और मद स ० 9 म उन्हें दिया ग है ।
3. हाई स्पीड डीजल तेल श्रीः लाइट तेल डीजल उपयोग कनिर्वाभ्धन- कोई भी व्यक्ति. राज्य सरकार या इस निमित्त उगके द्वारा प्राधिकृत किसी अधिकारी की लिखित पूर्व अनुशा के चिना, किसी उत्सव के अवसर पर विद्ययुन प्रकाश की व्यवस्था के प्रयोजनार्थ बिजली जनन में हाई स्पीडीजल तेन्न या लाइट डीजल तेल का उपयोग नहीं करेगा या न करने देगा ।
स्पष्टीकरणः इस खण्ड, उत्सव अवसर में कोई विवाह, धार्मिक या अत्येष्टि कमे अभिप्रेम है जिसके अनर्गत समारोह सम्बन्धी कोई अन्य अवसर भी आता है ।
4. प्रश्वा तत्राशी श्री अनिग्रहक की शक्ति हवलदार गे निम्न पक्नि का कोई पुलिग अधिकारी, या राज्य मरकार द्वारा इम निमित्त प्राधिकृत उसके ममनुल्य या उच्च पद का भरकार का कोई अन्य अधिकारी, इस आदेश का अनुपालन करने या अपना यह ममाधान करने की दृष्टि से कि इस आदेश या तीन बनाए गए किसी श्रादेश का अनुपालन किया गया है:--
(क ) किसी ऐसे स्थान परिसर या जलयान में प्रवेश कर सकेगा और तलाशी ले सकेगा जमके बारे में उसके पास यह विश्वास करने का कारण हो कि उसका THE GAZETTE OF INDIA EXTRAORDINARY

उपयोग इस आदेश या उसके अधीन बनाए गए किसी यादेश के उल्लंघन के लिए किया गया है या किया जा रहा है , या किए जाने वाला है;
( ख) ऐसे हाई स्पीड डीजल तेल या लाइट डीजल तेल के स्टाफ का अभिग्रहण कर मकेगा उसके बारे में उसके पास यह विश्वास करने का कारण है कि इस भादेश या तद्धीन बनाए गए किसी श्रादेश के उपबन्धों का उल्लघन क्रिया गया है या किया जा रहा है या किए जाने वाला है ।
